RESOLUTION NO. 2025-216
APPROVING THE TRANSFER OF LAND COMMONLY KNOWN AS ASSESSOR PARCEL NUMBER 0180-401-060 FROM ADS WEST, LLC TO THE CITY OF FAIRFIELD AND AUTHORIZING THE CITY
MANAGER TO EXECUTE A GRANT DEED
WHEREAS, ADS West , LLC (ADS West) owns fee title interest in the property located on 521 Yarrow Drive and identified as Solano County Assessor’s Parcel Number (APN) 0180 -401-060 (Property); and
WHEREAS, on May 17, 2022, the City Council adopted Resolution No. 2022 -92 authorizing an improvement agreement for the Red Top Zone II Pump Station Improvements. Pursuant to Section 3(f) of the Restated and Amended Development Agreement No. 2014 -1 (DA) executed between the City and the Developer, require the Developer to design and constr uct a zone II hydro-pneumatic pump station; and
WHEREAS, the zone II water pump station is necessary to provide water services to current and future developments along Red Top Road, including the enclave subdivision; and
WHEREAS, ADS West has constructed and completed the Zone II Water Pump Station; and
WHEREAS, ADS West, LLC wishes to grant the Property to the City of Fairfield; and
WHEREAS, the City wishes to accept the Property from ADS West, LLC.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. The council finds and determines that the recitals contained herein are true and correct.
Section 2. The council hereby approves the grant deed and authorizes the city manager to execute the certificate of acceptance and cause it to be recorded.
Section 3. The city manager is further authorized to execute such additional instruments and undertake such measures as may be necessary to complete the transaction contemplated by this Resolution.
