RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
Adoption of the resolution will formally accept the improvements for the Canon Station Planning Area 4 Lake Park Landscape – Phase 1 Construction as complete.

DISCUSSION
One Lake Holding, LLC (Developer) has completed all required improvements in accordance with the improvement agreement adopted by the City Council on September 17, 2019, by Resolution 2019-215. The completed improvements include over four acres of landscape improvements, a parking lot, a meandering pedestrian trail around the entire lake, boardwalk, pathway lights, and various amenities including: play structures, exercise equipment, park tables, and trash receptacles.

Staff inspected the landscape improvements and found them to be complete in accordance with City standards and the requirements of the landscape improvement agreement. The final punch list was completed on September 26, 2025. The proposed resolution accepts the landscape improvements as being complete, except for the obligation of the Developer to repair or reconstruct defective work for a period of one year after final acceptance.

FINANCIAL IMPACT
There is no fiscal impact to the City. The Homeowner’s Association (HOA) will be responsible to maintain the lake park including landscaping, trash and debris, structures and improvements, lighting, security cameras, etc. The city and Developer have executed a Maintenance, Access Easement, Reimbursement and Lease Agreement dated November 12, 2019, which specifics the roles and responsibilities for on -going lake park maintenance obligations and operations. A portion of funding for lake maintenance is provided by revenue collected by the Train Station Specific Plan Community Facilities District Tax.
