Government Code Section 6500 et seq. consisting of the County of Solano and the Cities of Benicia, Dixon, Fairfield, Rio Vista, Suisun, Vacaville and Vallejo (“ STA
”), and the
CITY OF
FAIRFIELD
, a
municipal corporation
(“
City
”)
, co
llectively, the “
P
arties
”.
1. RECITALS
A.
The
P
arties entered into a funding agreement dated
September 13, 2024
(the “
Agreement
”),
in which STA allocated Transit and Intercity Rail Capital Program (“
TIRCP
”) grant funding
in the
amount of $600,0
0 0 for Plans, Specifications, and Estimate
(“
PS&E
”)
, $500,000 for Right-of-
Way
(“
R/W
”)
, and $900,000 for construction
(“
CON
”)
for a total funding amount of $2 million to
the City of Fairfield for
the Travis Safe Routes to Schools and Transit Trail project (“
Project
”)
.
B.
The Parties desire to amend the Agreement (“ First Amendment ”) to reallocate the TIRCP grant
funding
for PS&E
in
the
amount
of $600,000
and
R/W
in the amount of $500,000 (“ First
Amendment”).
C.
The
P
arties
agree to amend the Agreement as set forth below.
2. AGREEMENT
A.
Reallocate
$1.1 million
from PS&E and RW
to the Project’s construction,
for a total
funding
amount of
$2
million.
3. EFFECTIVENESS OF
CONTRACT
Except as set forth in this
First
Amendment, all other terms and conditions specified in the Agreement remain in full force and
effect.
