Introduction
I represent the Downtown Theater Foundation of the Arts ("DTFA") and Dae Spering. I write to address and respond to your recent cease-and-desist letters directed at DTFA supporters, specifically, Casey Ellis, Tia Madison, and Barbara McFadden, and to raise the serious matter of defamatory statements that your client, David Rodgers, is circulating regarding Ms. Spering and her family.
After reviewing your letters and the publicly available footage of the November 4, 2025 Fairfield City Council meeting, it is clear that your allegations lack factual and legal merit. Notably, your 'correspondence fails to identify any specific false statements made by DTFA supporters at the meeting.
Most comments were expressions of opinion about public contracting, which are protected by law.
California Civil Code§ 47(b) is central here. This statute establishes absolute privilege for statements made during official legislative proceedings-such as city council meetings-so long as those statements have some logical connection to the matter at hand. Its core purpose is to encourage open and honest participation in public proceedings without fear of defamation claims. In other words, statements made in this context-whether or not they are later shown to be false--cannot serve as the basis for a defamation, slander, or similar tort claim.
Your reliance on Rider v. Superior Court is misplaced. That case concerns speech not covered by absolute privilege. Here, because the statements at issue were made during a legislative proceeding and relate to its subject matter,§ 47(b) applies fully and blocks any such claims.
As established by California law, when absolute privilege applies, no lawsuit for defamation or related torts can proceed based on those statements. Thus, your threats of legal action are unsupported and should be withdrawn.
Further, your letters assert that these supporters "misconstrued events" or made "false statements," and demand that they cease speaking, stop repeating their accusations, and avoid any communication with your client or his business. These demands are not only vague and unsupported, but they also directly conflict with these individuals' rights under both state and federal law. • First Amendment to the U.S. Constitution: Guarantees the right to free speech, especially on matters of public concern, such as government contracting and transparency. • California Constitution, Article I,§ 2: Reinforces the right to free expression in California, further protecting speech in public forums.
• Government Code§ 54954.3(c): Prohibits any restriction on public criticism of city policies, procedures, or services at official meetings.
I have communicated to clients to advise their supportors to not comply with demands that violate these clearly established legal rights.
Additionally, your letters refer to "groundless" or "misleading" social media posts but fail to specify any statement, provide evidence, or quote any alleged falsehood. Defamation law requires specificity and proof of falsity; broad accusations and insinuations are legally insufficient.
If your client pursues litigation on these grounds, I will be reaching out to assist in the filing of an anti- SLAPP motion. This will stay all discovery, require your client to demonstrate a likelihood of success (which is impossible here due to§ 47(b)), and entitle these individuals to recover mandatory attorneys' fees. The threatened litigation is therefore baseless and exposes your client to additional liability.
Turning to your client's conduct, I have received credible information from a third-party witness that Mr.
Rodgers is spreading a false and damaging rumor about Ms. Spering, alleging inappropriate conduct with a former student and claiming her father paid to conceal it. These statements are categorically false, unsupported by any evidence, and are unequivocally denied by Ms. Spering and her family.
Such conduct constitutes actionable defamation under California law. Specifically, as you attempted to alleged with Ms. Ellis, Ms. Madison, and Ms. McFadden, under Civil Code § 46(3), a statement is considered "slander per se" if it:
• Harm s a person's professional reputation,
• Accuses them of wrongdoing, or
• Exposes them to contempt or ridicule.
Unlike the privileged statements made by these individuals in a public forum, Mr. Rodgers' statements were made privately, without privilege, and with evident malice. This creates a strong, actionable claim for defamation per se, which does not require pro of of special damages.
On b eh alfo f M s. Spering, we demand that M r. Rodgers:
1. Immediately cease and desist from making any statements-oral, written, or otherw ise=-about M s.
Spering that impugn her professional character;
2. Stop disseminating an y rumors or allegations concerning M s. Spering;
3. Provide written confi rmation within seven (7) days that he will refrain from further defamatory conduct.
If these deman ds are not met, we will promptly pursue all available legal remedies, including claims for genera l, special, and punitive dam ages.
As to your cease an d desist deman ds, ifl was representing these individuals, I would be rejecting them and would be reserving all rights and remedies, including but not limited to:
• An ti-SLAP P fees an d san ctions,
• Claim s under Civil Code § 52.1 for attempts to chill pro tected speech, • Defamation claims against Mr. Rodgers,
• Punitive damages, and
• All other statutory and common law remedies.
Thank you for your and your client's immediate attention.
Sincerely,
Bernadette S. Curry

My presentation is to provide additional feedback from the residents of the new district Paradise Valley 2023-11 and comments on the process of working with LLMD Residents that want to do another campaign.
1- In our conversations with the residents the most common comments were "I see lots of workers working, I think we're looking better." 2- the landscape is looking nicer but it seems to be inconsistent with some areas of having little to no landscaping and others looking ok. 3- The trees are really tall, will they be pruning their height to prevent branches from falling?
We talked to the same people over the course of three days and their observations became more specific and more detailed, with increasing observations that the landscape appears very dated and is missing a lot of plants.
During the last campaign NBS and Civic Mic told the residents that if there are some additional things they would like to see in the new scope of work, or things they would like to see removed, to please let them know. I like that process, getting the residents involved with their landscaping and what they want to look like in the future. The problem is, the Residents had very little technical understanding of the conditions of their landscape, any deferred maintenance or broken irrigation systems were unknown to them. My understanding is no meaningful requests were surfaced by the residents

maintenance and eventual replacement as needed, with a CPI inflater to address increasing costs, None of our districts would have failed.
The landscape oversight committee is working to identify these issues and bring them to your attention with recommendations for your consideration.
Finally, The Waterman Highlands and N. Cordelia LLMDs are in the early stages of forming their working groups with the goal of increasing their landscape assessments through a new 218 campaign, with substantial Resident involvement and interaction. The Landscape Oversight Committee will work with these Residents throughout the process.
More to come in our next update.
