STATEMENT OF ISSUE
The adoption of the resolution formally accepts the Allan Witt Community Park - Phase 3 All Inclusive Playground Project (Project) as complete.

DISCUSSION
On May 21, 2024, the City Council adopted resolution No. 2024 -122, approving a contract with R&R Pacific Construction (R&R) to construct a new all-inclusive playground and restroom facility at Allan Witt Community Park. The Project redeveloped approximately three acres of the park located east of the Aquatics Center and south of the dog park. Improvements included the installation of drainage, water, sewer, and electrical utilities; construction of concrete pathways, an asphalt roadway and parking lot; development of picnic areas and shade shelters; installation of a gateway entry arch; installation of pl ay equipment; incorporation of decomposed granite paving; ramps and a prefabricated restroom building; construction of retaining walls and fencing; landscaping; and the implementation of an irrigation system.

Construction started on July 29, 2024. The Project experienced three schedule delays. The first delay was due to inclement weather, unworkable site conditions, and material manufacturing lead times. R&R submitted a time extension letter request on January 30, 2025, which the City approved on February 6, 2025, extending the contract completion date from January 22, 2025,

to April 4, 2025. A ribbon-cutting ceremony was held on May 12, 2025, and opened to the public, as construction was substantially complete, with only minor landscaping work outstanding.

The second delay resulted from insufficient hydro-seeded growth in the turf area, which required an additional two months beyond the planned three-month landscape maintenance period. The final delay was due t o vandalism at the park, which damaged portions of the playground’s resilient surfacing. To preserve the product warranty, it was necessary to have the original contractor to complete the repairs, resulting in additional schedule impacts.

During construction of the Project, 19 increase change orders, and two deductive change orders were issued, resulting in a total contract adjustment of $705,534.73.

The increase change orders included the removal of three trees not included in the plans ; the installation of a custom junction box for a new storm drain; the demolition and off haul of asphalt under the existing picnic areas; saw cutting, demolition and paving of the asphalt area in front of the new concrete by the pickle ball; installation of locking lids for the park lighting boxes, a new drinking fountain; irrigation improvements behind the sports center ; grading and tilling behind the sports center ; installation of perforated drain pipe for the whirl play structure ; additional irrigation lateral lines and rotors ; modifications to concrete mounds for safety compliance ; installation of an electrical braker to power the restroom facility ; installation of logs at the retaining wall ; installation of two sprinklers ; removal of sand and pressure washing of the vandalized playground area ; turf repair; and the installation of bars to cover open panels to match the surrounding park fencing. The total additions by change order were $122,864.83.

The two deductive change orders were issued because the playground equipment and restroom structure were pre -purchased prior to the bid process to reduce Project costs. The total deductions by change order were $828,399.56. The final punch list items for the Project were completed on October 14, 2025.

The construction authorization for the Project was approved in the amount of $6,269,072 which included a total bid of $5,699,155.96 and a 10% contingency of $569,916.04. The final cost for the Project was $4,993,621.23, which is approximately 20.34 % below the amount authorized for construction.

Following the council’s acceptance of the Project as completed, a notice of completion will be filed with the County of Solano’s Recorders Office.

FINANCIAL IMPACT
After council acceptance, the Public Works Operation Division will manage expenses associated with the ongoing maintenance of the park, which will be funded by the General Fund ). While sufficient funding is available in the current fiscal year, the park budget for Allan Witt Community Park will need to be reevaluated and closely monitored in future years to ensure long -term sustainability.
