RESOLUTION NO. 2025-246
AUTHORIZING A TIME EXTENSION OF THE IMPROVEMENT AGREEMENT FOR THE CANON EXTENSION – PLANNING AREA 4 – LINEAR PARK TRAIL SEGMENT 3A
WHEREAS, on December 6, 2022, the City Council previously adopted Resolution No. 2022-324 authorizing an Improvement Agreement (Agreement) with One Lake Holding LLC (Developer) to construct Linear Park – Segment 3A improvements; and
WHEREAS, the Department of Toxic Substances Control (DTSC) paused construction following the discovery of contaminated soils within the construction area and required mitigation plan review and permitting from DTSC prior to continuing construction; and
WHEREAS, the Developer has successfully mitigated the contaminated soil in accordance with DTSC’s requirements; and
WHEREAS, the Developer is now prepared to resume constructing the park improvements and amenities consistent with the plans previously authorized under Resolution No. 2022-324; and
WHEREAS, per s ection 5 of the executed Agreement requires council approval to authorize extensions.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. The time extension authorized by this resolution shall extend the term of the Agreement for an additional 12 months, or until December 31, 2026, whichever is later, unless further extended by the City Council.
Section 2. The director of public works is authorized and directed to do all things necessary and proper to extend the Agreement between the City and the Developer.
