Contact: Ryan Panganiban, (707) 428-7017

RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
The Aviatrix Development, proposed by Republic Fairfield, LLC (Developer), within Planning Area 1 of the Train Station Specific Plan requires off-site roadway improvements along Peabody Road and a future public road referred to as Street A. These public roadway improvements cannot be constructed without temporary ac cess to adjacent property owned by James A. Ewing, Trustee of the Velma J. Ewing Trust (Ewing Trust). Staff recommend the City Council approv e the First Amendment to the Government Code Section 66462.5 Agreement (Agreement) to include the acquisition of a temporary construction easement necessary to complete these improvements.

DISCUSSION
On January 11, 2023, the Planning Commission of the City of Fairfield approved the entitlement for the Master Planned Unit Development – Planning Area 1 through Resolution No. PC 2023-01.

Subsequently, on March 27, 2024, the Planning Commission approved the Aviatrix development with the adoption of Resolution No. PC 2024-01.

On September 16, 2025, the council adopted Resolution No. 2025 -190, which approved the Agreement to facilitate acquisition of property interests required to construct Street A and

portions of Peabody Road adjacent to the Aviatrix Development frontage. Since execution of the original agreement, final engineering has identified the need for a Temporary Construction Easement (TCE) from the Ewing Trust parcel to allow grading, construction, and restoration activities associated with roadway improvements. Th is first amendment expands the scope of the Agreement to expressly include the TCE.

The TCE will be limited in duration and purpose, and the property will be restored upon completion of construction, consistent with City standards and the terms of the first amendment.

Pursuant to Government Code Section 66462.5, approval of the first amendment authorizes the City to assist in the acquisition of the TCE necessary to construct the public roadway improvements required by the approved project.

FINANCIAL IMPACT
All costs associated with the acquisition of TCE will be fully funded by the Developer. These costs include and are not limited to real estate consultant services, legal fees, appraisals, negotiations, city staff time, and related ancillary expenses.

This action may result in delays to the Developer’s ability to construct the require d public roadway improvements.
