RECOMMENDED ACTION
Waive full reading, provide second reading by title only, and adopt Ordinance 2025-13.
STATEMENT OF ISSUE
The proposed ordinance repeals and replaces Chapter 22 of the Fairfield Municipal Code (Municipal Code) in its entirety to update and modernize Chapter 22 of the Municipal Code.
DISCUSSION
The Municipal Code was first published in 1960. Specifically, chapter 22 of the Municipal Code has been updated and revised over the years through various ordinances to reflect changes in laws, regulations, and operational practices required for the effective management of water utility in a changing environment.
The proposed update to the Municipal Code seeks to modernize the c hapter in a cohesive and comprehensive manner. While much of the code remains intact, there are a number of changes which not only update the language of the chapter but also modify the organizat ion of the chapter itself. Given the scope of these changes, the City Attorney’s Office has recommended repealing and replacing the entire chapter 22. This creates a clean and updated version of the chapter and aligns with standard practices that other cities have enacted when significant modifications occur to a municipal code chapter.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
The public hearing and introduction of Ordinance 2025-13 was held on December 16, 2025. Staff published notices of public hearing in the Daily Republic newspaper on December 3, 2025, and December 7, 2025.
ALTERNATIVE ACTION
The City Council may choose to do any of the following: either approve the proposed and updated ordinance, as recommended; or deny the proposed a nd updated ordinance. Rejecting the proposed ordinance would maintain the current chapter 22 of the Municipal Code.
