RESOLUTION NO. 2026-04
AUTHORIZING EXECUTION OF THE FIRST AMENDMENT TO AGREEMENT PURSUANT TO GOVERNMENT CODE SECTION 66462.5 FOR ACQUISITION OF STREET A AND PEABODY ROAD RIGHTS-OF-WAY RELATED TO PORTIONS OF TRAIN STATION SPECIFIC PLAN PLANNING AREA 1
DEVELOPMENT (AVIATRIX PROJECT)
WHEREAS, the Planning Commission of the City of Fairfield reviewed and approved the entitlements for both the “Master Planned Unit Development – Planning Ar ea 1” and the “Aviatrix” development with adoption of Resolution s No. PC 2023-01 and No. PC2024-01, respectively; and
WHEREAS, the developer, Republic Urban Properties (Developer), is required to construct certain off-site public roadways commonly referred to as Street A and Peabody Road as a condition of the Aviatrix development; and
WHEREAS, on September 16, 2025, the City Council approved Resolution No. 2025-190 approving an agreement pursuant to Government Code Section 66462.5 with the developer to facilitate acquisition of property interests necessary to construct the required off-site public improvements (Agreement) and authorizing the mayor to execute the Agreement; and
WHEREAS, final engineering has identified the need to acquire a temporary construction easement from property owned by James A. Ewing, Trustee of the Velma J. Ewing Trust (Assessor’s Parcel Number 0166 -110-410) to facilitate the construction of the required off-site public roadway improvements; and
WHEREAS, pursuant to the Agreement, the developer is responsible for reimbursing the City for all costs incurred in connection with acquisition of the real property interests needed to construct the off-site public improvements; and
WHEREAS, the First Amendment to the Agreement exp ands the scope of the A greement to include the proposed acquisition of the temporary construction easement within the scope of the real property interests needed to construct the off-site improvements; and
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. The council hereby approves that certain First Amendment to Agreement entitled “First Amendment to Agreement Pursuant to Government Code Section 66462.5 Between Republic Fairfield LLC and City of Fairfield for Acquisition of Certain Real Property Interests (Aviatrix Development Public Street Infrastructure – Street A and Peabody Road)” and the mayor is hereby authorized to execute said First Amendment.

Section 2. The public works director is authorized and directed to do all things necessary and proper to implement the above-referenced First Amendment and the Agreement.
