RECOMMENDED ACTION
Adopt resolution.
STATEMENT OF ISSUE
The proposed Lee Bell Prefabricated Restroom Project (Project; CPW050118) has been allocated $701,173 in funding through the Community Development Block Grant (CDBG) to support the installation of a public restroom at Lee Bell Park (Lee Bell). The resolution awards a contract to Globe Engineering Development (GED) for the purchase and delivery of one prefabricated restroom building in the amount of $267,000. A separate bidding process is currently in progress to select a contractor for the required sitework and installation.
DISCUSSION
Many of the City’s public park restroom facilities are aging, outdated, and have been subject to vandalism, making maintenance increasingly challenging and costly. To address these issues and provide better facilities for the public, staff have worked with maintenance and Police personnel to develop standards for new restroom facilities. This effort resulted in a standardized performance specification for a modular restroom design that is compliant with the A mericans with Disabilities Act (ADA), vandal resistant, more cost-effective, easier to maintain, and provides greater security. The intent is to implement this new restroom design throughout the City , as new park restroom facilities are installed, or existing restrooms need to be upgraded. Lee Bell has been identified as a location for installation.
The bid specifications included the purchase of one restroom building under this contract, to be installed at Lee Bell. These restroom units are designed to b e portable and can be relocated as needed, making them a great asset to the City’s changing park needs.
Bids for this Project were opened on January 7, 2026. Four vendors submitted bids and ranged between $267,000 and $290,000. The Engineer’s Estimate fo r the Project was $250,000. The lowest bidder was GED of Fairfield, California. GED is appropriately licensed in the State of California to perform this type of work and demonstrates adequate experience. Staff have reviewed their bid documents and found them to be complete and compliant with no exceptions noted and properly acknowledging both Addendum No. 1 and Addendum No. 2.
On January 12, 2026, the Public Restroom Company (PRC) filed a bid protest challenging the City's proposed award of the Lee Bell Park Prefabricated Restroom Project to Global Engineering Development (GED). PRC contends that GED's bid is non-responsive because GED proposes panelized construction rather than modular construction.
PRC's primary contentions are:
1. The specifications require a factory-built modular unit delivered as a single piece, and panelized construction does not qualify as "prefabricated”
2. The specifications require a pre-cast foundation shipped physically attached to the building
3. The specifications require single lift relocatability without disassembly
4. The terminology "erection or placement" applies exclusively to modular construction
5. GED's proposal does not qualify as an "approved equal" to PRC's modular product
6. Addendum No. 2 requires all mechanical and electrical systems to be 100% factory- installed before shipment
Staff, in coordination with the City Attorney's office, have conducted a thorough review of the contract documents, including the original specifications, Addendum No. 1 that was published on December 15, 2025, Addendum No. 2 that was published on December 23, 2025, plan sheet L1.0, and both bidders' submittals. Staff find GED’s proposal is responsive. Therefore, staff rejects PRC’s bid protest Staff has completed a comprehensive review of the protest allegations and recommends denial of the protest.
Staff therefore recommends that the City Council award the contract to GED as the lowest responsive and responsible bidder. A separate bidding process to perform the necessary sitework and installation is underway.
FINANCIAL IMPACT
The construction for this Project was originally scheduled for fiscal year (FY) 2026-2027. However, due to CDBG funding require ments that all funds be fully expensed by early 2027 , the construction timeline has been pushed forward. The total amount for the prefabricated restroom is $293,700, which includes the bid amount of $267,000 plus a $26,700 contingency.
This will not fully utilize the available CDBG funding. Site work will be bid separately and will also utilize the remaining CDBG funding. A budget adjustment is ne cessary to reallocate the construction expenses to FY 2025 -2026 and update the funding sources, including $701,173 to CDBG and Bedroom Tax (Fund 165) for $48,827. The total cost of the Project as approved will not change. Funding for the Project is allocated under the Parks Capital Project Fund (Fund 251).
PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
A notice inviting bids for this Project was advertised in the Daily Republic newspaper. In addition, the staff mailed a notice of the Project and complete bid package to a total of nineteen builder’s exchanges covering the area from Redding to San Jose and Stockton to Santa Rosa. A total of 4 contractors purchased bid documents for this project.
ALTERNATIVE ACTION
The council may reject the bid and not award the Project. This is not recommended as this may place the City out of complianc e with the Department of Housing and Urban Development’s timelines requirement for delivering the Project. This will lead to the City losing grant funds for the Project and risking future funding from the CDBG program.
