RESOLUTION NO. 2026-21
APPROVING THE PLANS AND SPECIFICATIONS AWARDING THE LEE BELL PREFABRICATED
RESTROOM PROJECT TO GLOBE ENGINEERING DEVELOPMENT AND AUTHORIZING AN UPDATE TO THE 2025-2026 BUDGET
WHEREAS, many of the City’s public park restroom facilities are aging, outdated, and have been subject to vandalism, making maintenance increasingly challenging and costly; and
WHEREAS, staff have determined that a prefabricated restroom building will meet City standards and identified Lee Bell Park as a location for installation; and
WHEREAS, the bid opening for the Lee Bell Prefabricated Restroom Project (Project; CPW050118) took place on January 7, 2026; and
WHEREAS, the City determined that Globe Engineering Development (GED) to be the lowest - priced responsive and responsible bidder; and
WHEREAS, on January 1 2, 2026, the Public Restroom Company (PRC) filed a bid protest challenging the City's proposed award of the Lee Bell Park Prefabricated Restroom Project to GED as they contend that GED's bid is non-responsive as GED proposes panelized construction rather than modular construction.; and
WHEREAS, staff, in coordination with the City Attorney's office, have conducted a comprehensive and thorough review and recommend rejecting the protest; and
WHEREAS GED has agreed to enter into an agreement directly with the City to provide one prefabricated restroom building; and
WHEREAS, the construction for the Project was allocated for fiscal year (FY) 2026-2027 and will need to be brought forward to FY 2025-2026 due to CDBG funding requirements; and
WHEREAS, funding sources must be reallocated in FY 2025 -2026 Budget for the Project, thus requiring a $701,173 budget reallocation for the Community Development Block Grant (CDBG) and $48,827 for the Bedroom Tax Fund (Fund 165); and
WHEREAS, the revised appropriation constitutes an update to the FY 2025 -2026 budget approved pursuant to Resolution No. 2025-103.

NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. The plans and specifications for the Project are hereby approved.
Section 2. The city manager is authorized to enter into a contract with GED for the Project in the amount of $267,000.
Section 3. The director of public works is hereby authorized to execute and administer change orders for an amount not to exceed the 10% contingency of the agreement value in the amount of $26,700.
Section 4. The council hereby approves a budget adjustment to reallo cate funding to $701,173 of CDBG funds and $48,827 of Bedroom Tax Fund (Fund 165).
Section 5. The council hereby approves an update to the project (CPW050118) to move construction costs and funding from FY 2026-2027 to FY 2025-2026.
Section 2. The city m anager or designee is hereby authorized to implement the above- mentioned contract.
