RECOMMENDED ACTION
Adopt resolution.
STATEMENT OF ISSUE
The Fairfield-Suisun Sewer District (FSSD) has requested temporary usage of a portion of the City- owned stormwater basin property to support construction staging and laydown activities for the Lopes Road Lift Station Improvements (Project) due to the limited space available. The City owns the adjacent stormwater basin parcel , commonly known as Assessor Parce Number 0180-432- 020, located immediately south of the lift station site. The proposed right -of-entry and license agreement (Agreement) authorizes FSSD access to the City parcel for a two -year term for construction staging and laydown purposes.
DISCUSSION
FSSD is currently in the design phase for improvements of the Project, located on Lopes Road at Andante Way. The lift station parcel is constrained in size and does not provide sufficient area to accommodate construction activities, including contractor staging, material storage, and maintaining continuous sewer operations during construction.
The City requires execution of the Agreement for temporary use of City -owned property for construction activities. The proposed Agreement would allow FSSD and its future construction
contractor to utilize a designated portion of the stormwater basin parcel for staging and laydown purposes while ensuring that City access, operations, and maintenance of the stormwater facility are not impeded.
The Agreement would be for a duration of up to two years, consistent with the projected construction timeline for the Project. At this time, the Project has not yet been bid, and no construction contractor has been selected. An aerial exhibit illustrating the proposed staging and laydown area is attached to the proposed agreement.
FINANCIAL IMPACT
There is no financial impact to the city for executing this Agreement with FSSD.
PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION
On January 26, 2026, the Fairfield-Suisun Sewer District Board of Directors approved authorizing the general manager to execute the Right-of-Entry Agreement for the Project with the City .
Approval and execution of the Agreement by the City of Fairfield will allow the Fairfield -Suisun Sewer District to use the City-owned parcel for material staging in support of the Project.
