RESOLUTION NO. 2026-26
AUTHORIZING THE CITY MANAGER TO EXECUTE A RIGHT-OF-ENTRY AND LICENSE
AGREEMENT FOR ACCESSING PROPERTY OWNED BY THE CITY OF FAIRFIELD FOR THE
FAIRFIELD-SUISUN SEWER DISTRICT PUMP STATION IMPROVEMENT FOR THE LOPES ROAD
LIFT STATION PROJECT
WHEREAS, the Fairfield-Suisun Sewer District (Licensee) desires to enter into right -of-entry and license agreement with the City of Fairfield; and
WHEREAS, the Licensee is currently in the design phase for improvements for the Lopes Road Lift Station Improvements Project (Project); and
WHEREAS, the City owns the stormwater basin property, commonly known as Assessor’s Parcel Number 0180-432-020, located immediately south of the lift station site; and
WHEREAS, the lift station is constrained in size and does not provide sufficient area to accommodate construction activities including contractor staging, material storage; and
WHEREAS, the Licensee requires ac cess to this property to facilitate construction staging and laydown activities for the duration of the Project; and
WHEREAS, the City desires to allow Licensee to enter City property for the sole purpose of completing the improvements and abiding by the terms described in the right -of-entry and license agreement.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. The city manager, or the city manager’s designee, is hereby a uthorized and directed to execute that certain right-of-entry and license agreement/license agreement, along with any changes as the city manager, or the city manager’s designee, may deem necessary or advisable.
Section 2. The director of public works i s hereby authorized to implement the agreement pursuant to the terms of provided therein, including extensions for the duration of agreement.
Section 3. The city manager or designee is hereby authorized to do all things necessary to implement the above-mentioned agreement.
