Facts•On 2/26/25, Li Bin Dong submitted her application for a massage permit to Fairfield Police Department. CodeEnforcement Officers Darin Eltringham and Minerva Figueroa were assigned to review and process the application.•On 3/4/25, Officer Eltringham allowed Ms. Dong to open Mircale Massage with a probationary permit to establishthe Log-Book, while her application was being reviewed. Ms. Dong and her husband were informed that there willbe a drop-in inspection on a later date to make sure Ms. Dong was following the City’s Municipal Code Chapter 10A– Massage Therapy Regulations, and that failure to comply will result in a denial of the massage permit.•On 5/2/25, Officers Eltringham and Figueroa conducted the inspection and found various violations of Chapter 10A– Massage Therapy Regulations, including failure to maintain a proper Log-Book, failure to have clean linens, failureto provide adequate lighting, and sleeping on premises.•On 5/6/25, the City sent a denial of massage permit letter to Ms. Dong, and Ms. Dong appealed.•On 7/1/25, the appeal was heard and the Fairfield City Council provided a probationary permit to MiracleMassage. Staff was ordered to monitor Miracle Massage and issue a permanent permit if there were no newviolations.•On 9/5/25, City staff conducted an inspection at Miracle Massage and found violations including: 1) Failure tomaintain a proper Log-Book; and 2) Failure to display valid CAMTC certificates for all massage therapists on duty. The City then extended an additional opportunity for Miracle Massage to comply with Ch. 10A and notified Ms.Dong that a final inspection would be held at a later date. I also met with Ms. Dong’s husband, David to reviewviolations and conducted outreach to help reach compliance.

Facts•On 9/10/25, We sent the following emailGood afternoon, Mr. DavisThank you for taking the time to meet with Code Enforcement Officer Eltringham and myself to discuss your wife’s continuednoncompliance with the city’s logbook requirement and display of their CAMTC certificates over the past sixty days.In recognition of this ongoing issue, I extended an additional opportunity for your wife to bring the logbook into compliance. Duringour discussion, I emphasized that owning and operating a business comes with many responsibilities and suggested it may beworthwhile for you or your wife to consider investing in administrative or recordkeeping support to ensure requirements areconsistently met.We agreed to remove the requirement to record the customer’s home address; however, your logbook must still include thefollowing:“You shall maintain a record of the date and hours of each treatment, the name of the patron, the amount paid for the treatmentincluding gratuity, the name of the manager on duty, and the therapist administering the treatment. Records must be completed in alegible manner with supporting transaction receipts. For example, if the logbook shows four massages in a day, there must be fourcorresponding receipts to verify the entries.”In addition to the logbook requirement, we also discussed the proper display of massage licenses for all employees providingmassage services to the public. As I explained, much like when visiting a hair salon, those licensed to cut hair are required todisplay their original state license at all times while working. The same standard applies here.It is essential that these conditions are fully met during the next thirty days (and moving forward), from September 15, 2025,through October 15, 2025. At no point during an inspection should there be any deviation from what we have agreed upon. Pleasenote, if during any inspection we find violations as outlined in our municipal code, Miracle Massage will not be granted a businesslicense.Thank you for your time and cooperation as we work to bring your business into full compliance.Best regards, Facts•On 10/22/25, a final inspection was held at Miracle Massage and Officers Eltringham and Figueroa found the following violations:•The Log-Book entries did not match the corresponding receipts.•There was a male customer inside a massage room, and he admitted to the officers that he was “getting a massage twominutes before officers entered the room.” The customer said he could not recall who was gave him the massage becausehe was face down while receiving the massage. He then got dressed and left without paying. (NOTE: There is only oneentrance in and out of the establishment, and the officers did not see any staff arrive or leave the establishment during theinspection.)•No licensed massage therapist was on site at the time of the inspection. Ms. Dong and an unidentified female staff member(who claimed to be a “cleaning lady”) both denied giving the male customer a massage. Ms. Dong kept claiming the CAMTCmassage therapist, Yuena Zhang, would be there in “five minutes.”•The officers’ BWC videos captured the final inspection at Miracle Massage.•On 10/28/25, Officer Profitt spoke with Ms. Dong’s husband, Mr. Davis. During this conversation, Mr. Davis claimed the malecustomer did not receive a massage and that he was asked to wait for ten minutes until the CAMTC massage therapist arrived. Mr.Davis then asked for a copy of the BWC videos. The BWC videos were provided to Mr. Davis soon thereafter.•On 11/19/25, The City sent a letter denying Miracle Massage’s permit application.•On 11/21/25, Ms. Dong sent the appeal letter. In the letter, Ms. Dong claims the Log-Book was in compliance with the regulations, and that the male customer received a free massage and thus no CAMTC massage therapist was required for that massage.

What laws have been violated?•FMC 10A.6: Records of Treatment.•Log-Book contained entries with attached receipts. Each entry listed a tip amount, but the corresponding receipts did not showany gratuity.•This inconsistency suggests incomplete or inaccurate recordkeeping.•FMC 10A.4 CAMTC certification required.•Ms. Dong or the unidentified “cleaning lady” , both unlicensed by CAMTC, performed massage therapy on the malecustomer on 10/22/25.•FMC 10A.11 Conditions of massage establishment permit generally.•As the permit holder for Miracle Massage, Ms. Dong has the responsibility to ensure that each individual providingmassage at the establishment is a CAMTC certified massage professional.•On 10/22/25, an unlicensed individual performed massage therapy on the male customer .•FMC 10A.15 Required.•It is unlawful for Miracle Massage to employ any person to provide massage therapy for compensation, or allow thatperson to provide massage therapy for compensation at Miracle Massage, unless that person is listed on the massageestablishment permit.•The only CAMTC licensed massage therapist listed on the permit is Yuena Zhang, who was not present on 10/22/25 whenthe male customer received a massage.•FMC 27.401(r): Violation of any city code is a public nuisance.

Staff Recommendation•Pursuant to FMC Section 10B.33, this denial of Ms. Dong’s application for a permanent business license permit is based on the grounds that Ms. Dong violated several provisions of the City’s Municipal Code Chapter 10A – Massage Therapy Regulations. •At the 7/1/25 appeal, City Council issued a probationary permit to Miracle Massage and ordered City staff to monitor Miracle Massage and to issue a permanent permit if there were no new violations. •At the 9/5/25 inspection, City staff found violations including: 1) Failure to maintain a proper Log-Book; and 2) Failure to display valid CAMTC certificates for all massage therapists on duty. •Despite these violations, City staff decided to allow Ms. Dong another chance to bring Miracle Massage into compliance.•At the 10/22/25 final inspection, City staff found violations including: 1) Failure to maintain a proper Log-Book; and 2) An unlicensed person performed massage therapy on the male customer .•Ms. Dong and the unidentified “cleaning lady” (the only other occupants at the establishment besides the male customer) both denied performing the massage. The only CAMTC licensed massage therapist, Yuena Zhang, was not present at the establishment. •City staff is especially concerned with Miracle Massage because from Sept. 2021 – July 2025, there have been 4 different owners (the prior owners all also violated Ch. 10A). There is a sale of the business every time City staff either denies the massage permit or sends a preliminary notice to abate public nuisance. •In fact, on 11/25/25, after Ms. Dong filed this appeal, the City received ZuoWu Zheng’s massage permit application for Miracle Massage. If the application is approved, Mr. Zheng would appoint Ms. Dong as the manager of the establishment. The lease attached to the application shows that Mr. Zheng took over the lease for Miracle Massage on 11/1/25. •On information and belief, Mr. Zheng is related to or close friends with Ms. Dong. They co-own a house in Vallejo, and previously lived together for 15+ years in a jointly-owned house in Milpitas. •If City Council upholds the denial of Ms. Dong’s application, no other massage establishment shall be permitted to operate at that location for a period of one year (the “moratorium period”) per FMC 10A.24. •City staff believes that if Ms. Dong’s appeal is granted, then she and Miracle Massage will likely continue to violate the regulations of Chapter 10A.
