RESOLUTION NO. 2026-45
AUTHORIZING THE CITY MANAGER TO APPROVE AND EXECUTE AMENDMENT NO. 2 TO THE
COST SHARING AGREEMENT FOR THE GREEN VALLEY ROAD OVERCROSSING WITH THE
SOLANO TRANSPORTATION AUTHORITY
WHEREAS, on August 19, 2014, the City Council adopted Resolution No. 2014 -190 approving a Cost Sharing Agreement (Agreement) with the Solano Transportation Authority (STA) for the Green Valley Road Overcrossing (Project); and
WHEREAS, under the Agreement, the City is responsible for contributing a total of $10.4 million toward the Project, payable to STA in annual installments of $1,040,000 over a ten-year period; and
WHEREAS, the Agreement limits the City’s annual payment to no more than 25% of the AB1600 Traffic Impact Fee (TIF) Program collected during the preceding twelve-month period; and
WHEREAS, on August 18, 2020, the council adopted Amendment No. 1 to this Agreement by Resolution No. 2020 -169 establishing a minimum annual payment amount of $500,000 or 25% of the TIF revenue received in the preceding twelve months; and
WHEREAS, Amendment No. 2 seeks to adjust the minimum annual payment amount from $500,000 to $555,193 to ensure the City can complete repayment of the remaining balance by the end of the Agreement term on September 15, 2029.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. Amendment No. 2 to the Agreement with STA for the Project, substantially in the form attached to the staff report for this item, is hereby approved.
Section 2. The city manager is hereby authorized to execute Amendment No. 2 to the Agreement, and to take all necessary steps to implement the amended Agreement.
