STATEMENT OF ISSUE
The City Council is required to add new territory added to the council election district prior to the June 2026 primary. Since City Council district maps were set on March 21, 2022 , the City has added new territory, requiring the City and Solano County to add this land to an existing election district. The city clerk, as the city elections official, recommends the new territory be added to City Council District 5.
DISCUSSION
Under California Elections Code section 21603(a):
“If the boundaries of a city expand by the addition of new territory, including through annexation of unincorporated territory or consolidation with another city, the council shall add that new territory to the nearest existing council district without changing the boundaries of other council district boundaries.”
The council last updated the council election districts via Ordinance 2022 -04 on March 1, 2022 (Attachment 3).
On September 14, 2023, the Local Agency Formation Commission (LAFCO) of Solano County filed a “Certificate of Completion” annexing new property from the County into the City of Fairfield (Attachment 4). The new property (Property) is Assessor’s Parcel Number (APN) 0037-160-040
and is comprised of approximately 2.1360 acres of a triangular shape of land bordered by Sunset Ave, E. Travis Blvd., and Railroad Ave. See Attachment 5 for legal description of land.
The Property straddles both City Council Districts 2 and 5 (Attachment 6).
THERE ARE CURRENTLY NO REGISTERED VOTERS IN THE NEW PROPERTY . However, the council should add the Property to an election district prior to the June 2026 primary in case someone decides to register and vote in the upcoming election.
City Clerk Karen Rees, as the City Elections Official, consulted with the consultant who helped prepare the District Maps in 2022. The consult said that where a new territory was between two different election districts, the territory could go to either District.
In reviewing the Property, more of the land touches District 5 than touches District 2. Therefore, the city clerk recommends the council add the Property to District 5.
FINANCIAL IMPACT
There is no financial impact except for the de minimus resources by the city clerk to provide election materials to anyone who might register for an upcoming election.
PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION

ALTERNATIVE ACTION
By operation of law, the council must add this new Property to either District 2 or District 5.
