RECOMMENDED ACTION
Adopt resolution.
STATEMENT OF ISSUE
The play equipment at Cordelia Community Park (Park) was originally installed approximately 14 years ago and is nearing the end of its expected service life. Additionally, the original vendor that supplied the playground equipment has since been acquired by a nother company, which is no longer able to provide the replacement parts necessary to perform safe repairs.
Most commercial play equipment, including that manufactured by Miracle Playsystems (Miracle), is available exclusively through a single, factory -authorized regional distributor . As a result, obtaining competitive bids is not feasible. The proposed resolution would suspend competitive bidding requirements and authorize a contract with Miracle for the replacement of play equipment at Cordelia Community Park through Sourcewell.
DISCUSSION
On December 16, 2008, the City Council adopted Resolution No. 2008 -308, approving the adoption of the Cordelia Community Park Master Site Plan and authorizing a construction phasing plan for the Park. The construction of the Park included amenities such as play structures,
jogging trails, sports fields and more. On February 16, 20 10, the council adopted Resolution No. 2010-37, awarding a contract to Goodland Landscape Construction Inc, for the Cordelia Community Park Phase 1 Project.
On January 17, 2012, the council accepted the Cordelia Community Park Project – Phase 1 as complete with Resolution No. 2012-04. The construction included the installation of playground equipment manufactured by Miracle, specifically to accommodate the park’s size and layout. The play equipment has not been replaced since its initial installation and is now at the end of its estimated 15-year functional lifespan. While serious safety concerns have not been identified at this time, proactive replacement is recommended to reduce the risk of future safety issues associated with continued use of the play equipment by children.
The Cordelia Community Pa rk Play Equipment Replacement Project (Project) will remove and replace the existing play equipment with a new Xccent play structure manufactured by Miracle.
Miracle will also provide installation services to ensure the new play structure is installed properly and in accordance with manufacturer safety recommendations. In addition, they will provide a Certified Playground Safety Inspectors (CPSI) report that will identify any potential hazards to ensure compliance with national safety standards. The Xccent play structure, designed for safe play by children ages 5-12, features the following:
Horizontal Ladders
“S” Shaped Handring Bridges
Horizontal Try-Rings
Double “L” Rails
Various End Ladders
Crunch Stations
“Phyzics” Buttress Miralene Climbers
Gravity Diamond climbing structure
The City has obtained a quote to procure and install the replacement equipment through Sourcewell, a cooperative purchasing organization governed by a publicly elected Board of Directors. Sourcewell assists public agencies by faci litating the procurement of goods and services through competitively solicited and pre-negotiated contracts that comply with local and state procurement requirements. Through its competitive solicitation process, Sourcewell awarded Contract (101625-PLP) to Miracle for the procurement of commercial playground equipment and related structures.
According to Section 28.6 of the City Code, council approval is required to suspend the competitive bidding process and authorize a direct purchase from a specified vendor. This approach is recommended as most commercial playground equipment, including Miracle products, is only available through a single factory -authorized regional distributor. However, pricing for the proposed purchase has been competitively established through Sourcewell’s cooperative purchasing program.
The purchase agreement ensures the City receives a fixed price for the play equipment. The purchase and installation contract provides the City with a competitive rate, guarantee fixed price, streamlines the process by coordinating delivery and installation through a single provider, and minimizes the City's liability concerning warranties or othe r potential issues related to the play equipment.
FINANCIAL IMPACT
Total authorization will be $119,838.75. which is the total quoted price plus a 10% contingency ($108,944.32 total quote + $10,894.43 contingency). Funding for this work has been budgeted in the Parks Capital Fund (Fund 251; CPW050090).

ALTERNATIVE ACTION
The council may choose not to award the contract; however, this may lead to increased prices for the procurement and installation of the play equipment as the quoted price is only valid for a limited period of time.
