1 Amendment No. 2
To the Landscape Maintenance Services for
Landscaping and Lighting Maintenance District No. 2023-11 (Paradise Valley) Agreement Between
City of Fairfield and TerraCare Associates
This Amendment No. 2, made by and entered into as of the day of , 2026, by and between the City of Fairfield, a municipal corporation (hereinafter “CITY”), and TerraCare Associates (hereinafter “CONTRACTOR”), for the purpose of modifying Landscaping and Lighting Maintenance District No. 2023-11 (Paradise Valley) Agreement dated July 1, 2026, and Amendment No. 1 dated December 10, 2025, (together hereinafter “AGREEMENT”) between the parties. This Amendment does not take effect until signed by both parties.
The revisions to the AGREEMENT are limited to those specific below.
The AGREEMENT is amended as follows:
1. The AGREEMENT is extended for a third and final term of twenty-four months from July 1, 2026, to June 30, 2028.
2. Incorporate maintenance for landscape areas adjacent to Tassajara Court to the AGREEMENT.
Exhibit “A” Area Maps Index is amended to include incorporated areas.
3. The total contract amount is hereby increased by $732,519.42 for services to be performed by CONTRACTOR during the third term of the Agreement, from July 1, 2026, through June 30, 2028. The increase includes a 1.7% adjustment based on the February San Francisco-Oakland-Hayward Consumer Price Index for Urban Wage Earners and Clerical Workers (CPI-W), applied to the previous six-month Amendment No. 1 contract amount of $176,708.69, and an additional annual amount of $6,834.24 for the inclusion of Tassajara Court maintenance services.
Except as specifically set forth herein, all terms and conditions of the AGREEMENT between the CITY and CONTRACTOR, dated July 1, 2026, and Amendment No. 1 dated December 10, 2025, shall remain in full force and effect.
