P.3 Resolution 2026-119 CM Internet Service and Telephonic Service Disruption Policy - PULLED
City Attorney Lim gave a brief presentation and stated that this item should have been under "New Business." He thanked Councilmember Panduro for catching the error. The policy is mandated by Senate Bill 707, significant amendments to the Brown Act for public agencies. He stated that the City of Fairfield already uses telephonic services (i.e. Zoom) for council meetings and has been for several years.
But now, if a two-way telephonic or audiovisual connection drops during a council meeting, halting public access, the council cannot take action on any remaining items. It must immediately recess the meeting for at least 60 minutes while making good -faith efforts to restore service. This exact situation occurred recently during a council meeting due to a hardware failure. Since IT could not restore the connection that evening within an hour, the council meeting was adjourned and continued to a future date. However, there are two exceptions to the rule in this situation but the policy was not in place yet during that meeting.
Council can continue the meeting if these two findings are met: 1) If good -faith efforts are made to restore the connectivity within an hour, and 2) the public interest in continuing the meeting outweighs the temporary loss of connectivity.
Attorney Lim recommended council approve the resolution as the deadline for this policy is July 1 and they do not meet again until July 7, 2026.
Councilmember Panduro made a motion to approve Resolution 2026-119.
Councilmember Carr seconded the motion. The motion carried unanimously (6-0).
