RESOLUTION NO. 2026-166
AUTHORIZING THE CITY MANAGER TO EXECUTE A PUBLIC UTILITY EASEMENT TO THE CITY OF FAIRFIELD WITHIN ASSESSOR’S PARCEL NUMBER (APN) 0034-150-310 FOR THE 2030 NORTH
TEXAS RECREATION CENTER PROJECT (ROBBIEBURR BERGER PARK)
WHEREAS, the City of Fairfield is the fee title owner of a parcel known as Assessor’s Parcel Number (APN) 0034-150-310 (Property); and
WHEREAS, on December 17, 2024, the City Council awarded a contract for the Linear Park Node 4A-2030 North Texas Recreation Center (Project); and
WHEREAS, communication facilities must be installed across the Property to supply fiber as part of the Project; and
WHEREAS, the City of Fairfield wishes to convey an easement over the Property for the purpose of installing and maintaining access to these communication facilities.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRFIELD HEREBY RESOLVES:
Section 1. The council f inds and determines that the recitals contained herein are true and correct.
Section 2. The council hereby approves the easement deed, in the form attached hereto as Exhibit A , and authorizes the city manager to execute the easement deed and cause it to be recorded.
Section 3. The city manager or designee is authorized to do all things necessary to implement the execution of the easement.
