RECOMMENDED ACTION
Adopt resolution.
STATEMENT OF ISSUE
During the winter storms in 2023, the hillside along Lopes Road became saturated and caused a landslide that significantly damaged a section of Lopes Road, a City of Fairfield 30 -inch potable water pipeline, and a 36 -inch City of Benicia raw water pipeline. The City is working collaboratively with the Federal Emergency Management Agency (FEMA), Federal Highway Administration (FHWA), California Office of Emergency Services (Cal OES), and the City of Benicia to reconstruct th e damaged critical infrastructure. Adoption of the proposed resolution authorizes the city manager to execute a Professional Services Agreement (PSA) with Haley & Aldrich for construction management services during construction of the Lopes Road Emergency Storm Damage Repair Project (Project, CPW090069).
DISCUSSION
During the winter storms, the hillside along Lopes Road became saturated and caused a landslide that significantly damaged a section of Lopes Road, a City of Fairfield 30 -inch potable water pipeline, and a 36-inch City of Benicia raw water pipeline. Both Cities declared local emergencies to seek assistance from the State and Federal governments. In late March 2023, Governor Gavin
Newsom announced that the White House approved the State’s request for federal assistance to support local response and recovery efforts. On June 9, 2023, Solano County was added to the list of counties eligible for disaster-related assistance from Cal OES and FEMA. In August 2024, it was determined that the roadway portion of the Project is ineligible for FEMA reimbursement and may be reimbursable through FHWA. An application for the roadway portion was submitted to FHWA and has been awarded.
The Cities of Fairfield and Benicia experienced water pipeline and roadway damage and share the need to repair the infrastructure and stabilize the adjacent hillside slope. On February 6, 2024, the council adopted Resolution No. 2024-20, approving and authorizing the execution of a Memorandum of Understanding (MOU) between the Cities for efficient Project delivery with two additional amendments added in 2025 and 2026.
As part of this collaborative effort, Public Works staff from both Cities created a Project delivery team that meets weekly to discuss Project progress, coordinate activities, and address Project matters. Representatives from FEMA and Cal OES also regularly participate in these meetings to provide guidance and assistance. The MOU establishes the framework for the Cities' collaboration and memorializes their respective cost-sharing and Project delivery obligations.
The Project involves stabilization of the slope above Lopes Road through Deep Soil Mixing (DSM), removal and replacement of a damaged 30-inch City of Fairfield water line and 36-inch City of Benicia water line, reconstruction of Lopes Road, striping installation and guardrail replacement.
To ensure compliance with Federal grant requirements, construction of this Project requires extensive oversight, inspection, testing, and coordination beyond the City’s resource availability.
Additionally, these services will be provided for both the Cities of Fairfield and Benicia.
The proposed scope of work includes Request for Information (R FI) submittals and review, maintenance of as -built Project plans, coordination and leadership of progress meetings, monitoring of labor compliance, construction observation, material testing, and monitoring of environmental compliance, as detailed in Exhibit A of the proposed agreement.
FINANCIAL IMPACT
The total authorization for th is agreement PSA with Haley & Aldrich for the construction management services will be $1,289,863.52 which is the total amount plus a 10% contingency ($1,172,603.20 total amount + $ 117,260.32 contingency). This agreement will be funded with $967,397.64 from the FEMA grant, $241,849.41 from the Cal OES grant, $20,154.12 from the City of Benicia, and $60,462.35 from Senate Bill 1 (Fund 163).
The PSA costs for Haley & Aldrich of $1,289,863.52 were not included in the FY 2026-2027 Capital Improvement Plan for the Lopes Road Emergency Storm Damage Repair Project (CPW090069). A budget adjustment of $1,289,863.52 is required to authorize the funding for the additional construction costs to include FEMA grant funding of $967,397.64, Cal OES grant funding of $241,849.41, City of Benicia funding of $20,154.12, and Senate Bill 1 funding of $60,462.35 (Fund 163), and increase appropriations in the Water Capital Fund (Fund 462).

ALTERNATIVE ACTION
The council may choose not to award the PSA with Haley & Aldrich for construction management services; however, this alternative is not recommended as it would delay construction of the Project and may potentially risk Federal grant funding for the repairs.
