RECOMMENDED ACTION
Adopt resolution.

STATEMENT OF ISSUE
The construction of the Robbieburr Berger Recreation Center and Park (Project) is approximately 95% complete. Staff are coordinating closely with First 5 Solano in anticipation of opening the recreation center to the public in October, with the playground, fields, and sports courts scheduled to open November. To ensure successful completion of the Project, the design team, led by Callander Associates, has continued providing design services, including site observations, product submittal reviews, responses to requests for information, and design clarifications. The proposed resolution authorizes the city manager to execute Amendment No. 8 to the agreement with Callander Associates in the amount of $261,646, increasing the total contract amount to $2,577,152.

DISCUSSION
On August 30, 2018, the City Council adopted Resolution No. 2018 -210, authorizing a Design Services Agreement with Callander Associates for the Implementation Plan of the Project. The agreement has subsequently been amended, most recently through Amendment No. 7, which was approved by the council on June 17, 2025, which increased the agreement amount by $172,790 through Resolution No. 2025 -111. Amendment No. 7 increased the scope to provide

additional engineering and design services for the furniture, fixtures, and equipment procurement package, as well as complete construction administration services.

On December 17, 2024, the council adopted Resolution No. 2024-291, executing a contract with CWS Construction Group, Inc. (CWS) for the Project. Construction for the Project began in March 2025 with an original contract duration of 240 working days and an anticipated completion date of April 2026.

As construction progressed, the Project schedule was extended beyond April 2026 due to several factors. Inclement weather, procurement of long-lead-time materials and equipment, coordination w ith utility providers, and varying field conditions, contributed to ongoing construction continuing through fall 2026. The extended construction timeline, along with the volume and complexity of contractor product submittals, requests for information, design clarifications, and field coordination, required a greater level of involvement from Callander Associates, Group 4 Architecture, Research + Planning, Inc., and BKF Engineers than anticipated in the original scope. Internal City staff retirements and resignations further heightened this demand, requiring significant reliance on the consultant team to carry the project forward. Given the size and complexity of the Project , issues during the construction phase and the need for continued coordination are common; however, the extended duration and increased level of coordination required exceeded the budget allowance included in the original agreement.

Amendment No. 8 would compensate the consultant team for additional design services during construction services provided through July 2026 and establish an allowance for continued support through October 2026. This ongoing support will assist staff in completing the remaining work, resolving close-out items, and facilitating the transition of the recreation center and park into public use.

FINANCIAL IMPACT
The total authorization for Amendment No. 8 is $ 261,646, increasing the Callander Associates’ agreement from $2,315,506 to $2,577,152. Funding is allocated within Linear Park Node 4A Project (CPW050035), Parks Capital Fund (Fund 251) and funded through a combination of AB 1600 Parks (Fund 263), Bedroom Tax (Fund 165), and First 5 Solano grant funds. The total project budget approved by council for this project is $ 18,255,703 including $1,338,500 in construction contingency. The total project cost, including this request, i.e., design services cost (including all amendments) and construction costs (including all change orders) are expected to be within the council approved total budget for the project. There will be no impact on the General Fund.

ALTERNATIVE ACTION
The City Council may choose not to approve Amendment No. 8 or may direct staff to renegotiate the scope and compensation. This alternative could delay responses to remaining construction and closeout items, final record documents, warranty documentation, and completion of the Project. If council directs reneg otiation, staff will return with a revised amendment before authorizing additional services beyond those otherwise permitted under the existing agreement.
