City Council
Staff Report 8A
TO: Honorable Mayor and City Council
FROM: Greg Thompson, Assistant City Engineer
DATE: May 8, 2023
SUBJECT: Partial ADA Transition Plan
RECOMMENDED ACTION:

That the City Council review and adopt the Partial ADA Transition Plan, which surveyed and reported non-compliant features at City owned and operated facilities throughout Farmersville, and that Council direct staff to identify priority of items to ensure timely address of noncompliant features.

BACKGROUND:

The 1991 Federal Americans with Disabilities Act (ADA) mandated that all municipal agencies, including the City of Farmersville, conduct a self-evaluation of existing programs, services, and activities to develop an inventory of public features that are not compliant with accessible requirements of the Act and subsequent federal Guidelines, with the aim of remedying these features to provide full accessibility to the City for disabled persons.

In 2019, the City performed a partial self-evaluation addressing pedestrian features throughout City streets. This plan supplements the 2019 Plan and addresses buildings and parks to bring the overall evaluation further into compliance with Federal law.

DISCUSSION:

The 1991 Federal Americans with Disabilities Act (ADA) codified accessibility for disabled persons as a federal civil rights law. It is the only civil rights law addressed through building codes and ordinances. Title II mandated that State and Local governmental agencies must modify their programs, services, and activities to provide equal access to disabled persons. “Programs, services, and activities” (PSAs) is widely interpreted to include physical features to City owned and operated facilities such as buildings, parks, and transportation facilities. The law mandates that Title II entities perform a self-evaluation to transition from non-compliant PSAs to compliant PSAs.

This partial ADA Transition Plan identifies features in City operated and owned facilities (buildings and parks) that do not comply with the ADA, but must be modified to achieve compliance with accessibility, and the estimated costs to upgrade such features. The Plan leaves the prioritization and implementation to City staff to address the issues identified, in accordance with City improvement plans and funding availability.

COORDINATION & REVIEW:

The Partial ADA Transition Plan has been reviewed and coordinated with the City Manager, Public Works Director, and City Engineer.

FISCAL IMPACT:

The 2023 costs estimated for full compliance are expected to be $534,000 and need to be managed with other capital expenditures and maintenance activities to provide integrated upgrades to non-compliant features.

CONCLUSION:

It is recommended that the City Council review and adopt the Partial ADA Transition Plan and together with the 2019 partial ADA transition plan, direct staff to develop priorities for funding and upgrading the identified features to achieve full compliance with the ADA for non-compliant features.

Partial ADA Transition Plan April 2023
City of Farmersville Page 1

EXECUTIVE SUMMARY
Title II of the Americans with Disabilities Act of 1990 (ADA) prohibits public entities from excluding or denying persons with disabilities participation in and benefits of a public entity’s services, programs, or activities or being subjected to discrimination by any public entity. To ensure non-discriminatory access to all city services and programs, public entities must conduct a Self-Evaluation Assessment and provide written policies and procedures to access programs, services, and activities. A citywide assessment of the existing City of Farmersville public facilities and parks was conducted in December of 2022. The review identified barriers to accessibility to develop a plan to update and improve universal accessibility in Farmersville’s publicly operated parks, structures, and facilities. The goals and policies of this Partial ADA Transition Plan will be consistent with the regulations and premises set forth by the Americans with Disabilities Act.

The Partial ADA Transition Plan is a supplementary document to the previous and more comprehensive ATP Plan that the City has already adopted. This Plan includes an inventory of City-owned sites that include maps, images, and documentation that identify and locate individual infractions that need to be brought into compliance with current ADA standards.

The improvements identified are prioritized based on a combination of factors, including the condition of access pathways, the volume of use, the type of use, and the severity of the issue.

A Certified Access Specialist (CASp) conducted a thorough review of each of the 14 Cityowned sites and compiled a list of the physical barriers and non-ADA-compliant items for each location.

The assessment reviews were limited to areas only open to the public. Employee areas and facilities traditionally closed to the public were not assessed in the review. This Plan does not include or address any components regarding public information services, signage, or website design or development in relation to ADA programs.

Each of the following sites was evaluated to determine their current levels of ADA compliance. Items or situations found to be out of compliance at each site were photographed, georeferenced, and listed with a brief explanation of the non-compliance.

Recommendations were then given for resolution with an estimated cost to bring the infraction into compliance. The information has been organized into individual cut sheets that correspond to each of the Object Number items at each site and location. This format allows quick referencing, cataloging, and categorization of similar types of projects and makes it easier to assemble grant applications and document completed projects. A full register of the cut sheets can be found at the end of this document in Appendix A – City Owned Properties – ADA Compliance and Improvement Recommendations.

The following City owned and operated facilities were assessed:
• Armstrong Park - East Ash Street
• City Hall - 909 West Visalia Road
• Community Center – 623 North Avery Avenue
• Corporation Yard - 30595 South Farmersville Boulevard

City of Farmersville Page 2
• Freedom Sports Park - North Freedom Drive
• Jennings Park - West Ash Street
• Liberty Park - 397 West Teddy Street
• Old Church Museum and Event Center – 886 Farmersville Boulevard • Pocket Park – 1385 North Steven Avenue
• Riverbank Park - West Oakland Street
• Roy’s Park - 800 South Farmersville Boulevard
• Tulare County WIC Facility - 175 East Front Street
• Turning Point Facility – 147 East Front Street
• VDA Daycare Center – 455 Linnell Avenue
• Veterans Memorial Park – North Farmersville Boulevard The above locations all contained multiple barriers to access, which warranted their inclusion on the list. The Wastewater Treatment Plant Administration Building was also evaluated using the same process as the properties above but was found not to contain any barriers to access and was excluded from the list.

The following is an example of the typical layout and information provided on each of the cut sheet documentation pages located in Appendix A – City Owned Properties – ADA Compliance and Improvement Recommendations.

Public Outreach. The public outreach plan consisted of a publically noticed meeting notifying all City residents of an opportunity to review and discuss a draft of the proposed Partial ADA Transition Plan. Public announcement and notification for the outreach meeting was accomplished by including a dedicated flyer with the City’s February water bill mailed to all residents as well as being posted on the City’s website and associated social media sites.

Goals and Policies. Goals, policies, and priorities should be developed based on input from outreach to the disabled community and any resulting data, surveys, or interviews, as well as staff input. Priorities should be assessed based on the percentage of responses given for each of the infractions indicated in the breakout sessions. The goal of the prioritization strategy is to make improvements that will meet current ADA accessibility guidelines at locations that will benefit the most significant number of users. The recommended prioritization strategy is based on the following:
• Frequency of facility use and access by disabled users.

Partial ADA Transition Plan April 2023
City of Farmersville Page 4
• Availability of alternative amenities that can be accessed by disabled users. • Cost-effectiveness of immediate repairs.
• Viability of repairs and upgrades in relation to budget and other higher priority concerns.

Funding. Specific grant sources for ADA compliance purposes are difficult to find and rarely available as stand-alone funding sources. This is because ADA compliance has become a mandated component of all building, infrastructure, and design projects for the last several decades. Conversion of non-compliant access is now accomplished on a “pay as you go” basis and is mandated as a component of nearly every funding source dedicated to construction or infrastructure funding. Essentially, ADA access, as a mandated condition of all projects, has not been given dedicated funding as the demand would outstrip any attempt at public funding resources. The City will need to address immediate improvements to City-owned properties through other sources besides State and federal funding or defer projects until they can be included in the future redevelopment.

Generally accepted funding sources include:
• Municipal general fund sources.
• Municipal tax increases for dedicated programs or services. • Federal or State grant funding for other renovation purposes (e.g., park renovation, community centers).
• Private donations through service groups, organizations, business sponsors, individual sponsors, or community fundraising efforts.

SECTION 1 - INTRODUCTION

1.1 - Purpose of Report
The purpose of the Partial ADA Transition Plan is to catalog, evaluate, and recommend procedures for transitioning City properties with ADA barriers to access toward eventual compliance. The Plan is intended to serve as a guide for City staff who will utilize the information to evaluate each of the component items and develop a prioritized list of repairs and a long-term schedule of improvements based on current capital improvement budget availability, maintenance schedules, public comments, and other staff input.

The Plan includes an inventory of City-owned or operated facilities containing barrier-toaccess issues and identifies improvements needed to comply with current ADA standards.

The improvements identified are to be prioritized based on a series of recommendations and criteria.

1.2 - Americans with Disabilities Act
The Americans with Disabilities Act (ADA) is a comprehensive civil rights law for persons with disabilities. The ADA states that its purpose is to provide a “clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities.” Congress emphasized that the ADA seeks to dispel stereotypes and assumptions about disabilities and to assure equality of opportunity, full participation, independent living, and economic self-sufficiency for people with disabilities. The ADA states that a public entity must reasonably modify its programs, services and activites to avoid discrimination against people with disabilities.

Title II of the 1990 Americans with Disabilities Act prohibits any public entities from excluding or denying persons with disabilities from participating in any of the public entity’s services, benefits, programs, or activities. To ensure non-discriminatory access to all City services and programs, public entities must conduct a Self-Evaluation Assessment and provide written policies and procedures that establish and enforce an equal provision of access for disabled participants to programs, services, and activities. Public entities with 50 or more employees are also required to develop a Transition Plan detailing any changes or modifications needed to achieve equal access for all citizens, including the development of a schedule for their completion and provision for future maintenance.

Proposed accessibility guidelines for pedestrian and other public facilities are identified in the United States Access Board’s Proposed Guidelines for Public Facilities. Standards are also identified in Part 2 of Title 24 of the California Code of Regulations (i.e., California Building Standards Code). These include accessibility standards to safeguard life or limb, health, property, and public welfare by regulating and controlling the design, construction, quality of materials, use and occupancy, location, and maintenance of all buildings and structures and certain equipment. There are also accommodations for constructing and maintaining facilities and equipment at the City’s parks and other named public spaces.

1.2.1 - ESTIMATING DISABLED POPULATION
U.S. Census data for the City of Farmersville and national data trends indicate that 9.4 percent of the City’s 10,382 population qualifies as disabled. That is an estimated total of 978 people, of which 78 percent, or 756, are estimated to be under age 65. A significant portion of the population might be underserved if City services have not been properly identified, repaired, and maintained. There is no clear indicator that these individuals are concentrated in any particular location within the City or that they each access similar types of services, except, maybe, in the case of the Senior Center. Therefore, one strategy for the prioritization of projects should address facilities that have the highest number of overall users and, specifically, the highest number of disabled users.

1.3 - Goals of Report
This Partial ADA Transition Plan aims to identify, evaluate, prioritize, and develop resources that aid in resolving existing ADA compliance issues at City-owned and operated sites throughout Farmersville. The desire is for the City to be able to provide the highest levels of safety and service to its disabled community by addressing State and federal ADA compliance issues. This is best accomplished by developing procedures for the elimination of all existing barriers to access and putting into place new protocols that prevent the creation of any new barriers in the future.

The following goals and policies support that vision:
• Solicit professional assistance in identifying existing barriers to mobility on Cityowned and operated facilities. • Develop a list that allows for the prioritization of repairs based on severity and level of use metrics.
• Adopt a program of reasonable repair solutions and timelines based on professional recommendations and cost estimates per each infraction. • Adopt annual budgets and implement schedules for current and long-term maintenance and repair programs until all barrier items have been resolved. • Establish a network or public forum of residents, users, and staff that can directly report deficiencies to the Public Works Department as they arise.

Partial ADA Transition Plan April 2023
City of Farmersville Page 1-3
Additional goals may then be developed with ongoing input from the community, stakeholders, and City staff. Further analysis and on-the-ground review of existing conditions and findings and the results of prioritization measures should be included.

1.4 - Document Organization
The City of Farmersville Partial ADA Transition Plan is organized into the following sections:

Executive Summary. The Executive Summary provides a condensed version of the document’s main themes and sections.

Section 1: Introduction. The Introduction summarizes the Plan’s purpose, definitions, goals, and organization. This section also provides an overview of Farmersville’s situation within the State, historical settings, and land development patterns.

Section 2: Existing Conditions and Findings. This section describes how the public outreach component of this Plan was developed and executed with the tenets of Environmental Justice and Inclusion being observed and incorporated and how participation was ultimately solicited and advertised to the public and stakeholders. There is also a brief segment describing the qualifications and procedures for the performance of the Walking Audits, where each of the sites was reviewed and documented.

Section 3: Partial ADA Transition Plan. This portion provides a listing of the City’s goals and policies that were used in guiding the process for gathering information used in the development of the Plan. Following is an inventory of the City properties analyzed in the report with a breakdown of some of the criteria and detail of their selection. Next is the explanation of how identified sites and specific items would be prioritized for repair or replacement and then how to develop procedures for preventing, identifying, and performing ongoing maintenance on existing and future facilities. Finally, there is some general information on how cities secure funding sources for these kinds of projects.

Section 4: ADA Compliance Policy and Procedures Guidelines. This section provides a listing of current methods and processes that the City has adopted to make itself accountable and responsive to residents concerned with ADA issues and the requirements and recommendations for developing and populating an ADA coordinator position. This person would be an employee of the City, preferably the Public Works Department, and would act as a liaison agent between the City and the disabled community. The Process Guide lays out how the City notifies and interacts with the disabled community as well as how to develop standards and procedures for addressing, funding, and monitoring progress on resolving issues.

Section 5: Conclusions and Recommendations. This section includes a summary of the analysis and evaluation of the issues facing the City in regard to the stated goals of the Partial ADA Transition Plan, followed by specific plans and goals to help attain compliant status on all identified issues at each of the City locations.

Appendices. The appendix includes detailed information in the form of cut sheets that are related to the identified barrier sites at each of the City-owned properties. These are identified with Object I.D. numbers in the red circles on a map of each location.

1.5 - Setting
Farmersville is a small city centrally located within Tulare County, which is located near the center of California’s San Joaquin Valley (see Figure 1-1, Regional Location Map.) The City is located approximately 15 miles east of California State Route 99 and immediately south of State Route (SR) 198. The City currently covers about 2.2 square miles and, according to the 2021 U.S. Census Bureau statistics, has a registered population of 10,382. Farmersville is a family-friendly community in a predominantly rural area that has managed to retain its small-town character and charm. The city limits stretch a little over two miles to the south, along Farmersville Boulevard from SR 198 to just past its intersection with the historically significant Visalia Road. The historic downtown district is still the community’s main commercial, cultural, historical, and civic center. The City’s central location and proximity to SR 198 and 65, as well as Visalia Road, provide for easy access to and from all parts of Farmersville into the surrounding districts and the other nearby communities of Tulare County.

1.6 - Current and Historic Land Uses
The history of Farmersville began in the 1850s when a small community established along Deep Creek, near the present-day cemetery, began to prosper after building a small school for the local farm children. Bolstered by readily available water and soils well suited for farming, the community quickly grew into an agricultural powerhouse, supplying a wide variety of agricultural products to U.S. markets. Incorporated as a city in 1960, Farmersville’s modern-day development patterns still reflect its historical background despite having expanded its boundaries.

SECTION 2 - PUBLIC OUTREACH

2.1 - Public Outreach Plan
The public outreach plan consisted of a publically noticed meeting notifying residents of an opportunity to review and discuss a final draft of the proposed ADA Partial Transition Plan.

Comments and suggestions from the meeting were documented and added to the report as suggestions or references. Outreach meeting notification flyers were included with the City’s monthly water bill mailing just prior to the meeting date. Meeting information was also posted on the City’s website and associated social media sites for several weeks prior to the meeting date.

The State of California defines Environmental Justice as the “Fair treatment of people of all races, cultures, and incomes with respect to the development, adoption, implementation, and enforcement of environmental laws, regulations, and policies” (California Government Code

Partial ADA Transition Plan April 2023
City of Farmersville Page 2-2
Section 65040.12(c)). In other words, Environmental Justice ensures that people of all races, cultures, and incomes are equally and equitably valued, protected, and served by laws, regulations, and policies that impact the environment around us, including those about buildings and uses of land, transportation, parks, and natural spaces, the urban landscape, and city services.

2.2 - Recommendations from Community Input
On Wednesday, February 22, 2023, an outreach meeting was held at the Community Center in Farmersville from 6:00 p.m. to 8:00 p.m. The Community Center is accessible to those with disabilities and serviced by public transit. Welcome and informational signage was prominently displayed at the facility entrances. A questionnaire in both English and Spanish was prepared to gather more specific information from attendees (see Appendix C). There was general acceptance of the Partial ADA Transition Plan and the procedures used to acquire and develop the document. No specific comments came out of the outreach event.

The City shall publicize efforts to increase participation in City projects and functions by members of the disabled community, including simply distributing printed materials and brochures to members in special mailers or by actively contacting members through social media accounts or websites.
• Ensure future development of Public Accommodations (commercial facilities) meet all ADA requirements for public access.

3.2 - City-Owned Property Inventory
In October 2022, a Certified Access Specialist (CASp) supervising trained personnel identified barriers to access at each of the City-owned and operated facilities and locations.

With survey forms and a camera, the team identified potential areas of concern, especially those related to wheelchair users. A summary of existing conditions at each of the targeted facilities is identified in the individual cut sheets for each of the project areas. These are assembled for easy reference in Appendix A, City-Owned Properties – ADA Compliance and Improvement Recommendations at the end of the Plan.

Each of the identified locations contains multiple sites, each with multiple access issues. Each access issue at a site was identified and given a specific number called an Object I.D. Each Object I.D. number corresponds to the cut sheet of information containing georeferenced

photographs, an identification of the issue, a suggested resolution, and an estimated cost to bring each project up into ADA compliance standards.

Assessments were limited to a review of facilities only accessible to the public. No employee areas, restricted areas, or municipal areas otherwise closed to the public were evaluated for this report.

For purposes of the Self-Evaluation and Partial ADA Transition Plan, the QK assessment team inspected the following properties:
• Administrative buildings (totaling two sites)
o City Hall (containing fire and police)
o City Corporation Yard
• Service and event facilities (totaling four sites)
o Community Center
o Old Church Museum and Event Center
o Turning Point Facility
o Tulare County WIC Facility

3.3 - Prioritization of Projects
The list of barrier projects is extensive and, most likely, will not be resolved simultaneously.

It will then be necessary to develop a method for prioritizing the issues deemed most critical.

Recommendations can be made, procedures suggested, and criteria delineated; but in the end, the determinations will best be made by City staff appointed to administer the program.

They will be able to most accurately apply their internal knowledge of what is most socially,

Partial ADA Transition Plan April 2023
City of Farmersville Page 3-9
They will be able to most accurately apply their internal knowledge of what is most socially, budgetarily, and politically expedient for each of the projects at the time. Priorities can and do, change with time and situational criteria, resulting in a fluidity of project completion dates, budgets, and times. To allow some flexibility and adaptability for staff to adapt to these fluid situations, they are encouraged to apply their best judgment and discernment in developing and maintaining a list of project priorities with timelines and budget components for each of the existing and new barrier projects. Following the evaluation and feasibility assessments, these projects should be ranked by priority and programmed into the following capital improvement cycle when funding is available.

The goal of the prioritization strategy is to make a series of timely improvements that will ultimately bring all the existing ‘barrier to access’ deficiencies into compliance with current ADA accessibility guidelines at locations and facilities.

3.3.1 - PRIORITY DETERMINATION RECOMMENDATIONS
Priority will be determined by a number of both tangible and intangible factors and criteria that will be evaluated for feasibility by the City staff. The following list of recommendations and Levels of Concern offers a few criteria to look for when setting priorities.

Frequency of Use: Does an identified barrier directly impact the accessibility frequency of facility use by disabled residents? Even though the barrier may be determined a lower priority due to its severity level, it becomes more important because it is restricting a larger number of users from accessing the facility.

Alternate Amenities: Are there available alternate amenities that can be utilized while repairs are being made? Again, priority may be increased if there is no other satisfactory or accessible alternative facility or program.

Cost Effectiveness: Is a particular product or item cost-effective with available funding? Is it possible to perform immediate repairs, or can it be postponed for later funding or coordinated with other projects that may be installed as part of another scheduled project?
Viability: Is it realistic or necessary to perform this repair or upgrade at this time? Is it easily or conveniently done? Can it be grouped with other similar items and be accomplished as a group?

3.3.2 - LEVELS OF CONCERN
Certain physical items or situations should be prioritized into high-, medium-, and lowpriority projects.

Partial ADA Transition Plan April 2023
City of Farmersville Page 3-10
High-priority barrier accessibility issues are items that inhibit disabled users from accessing or safely approaching all or part of a public facility. They are represented by locations that do not meet ADA compliance guidelines and are non‐functional for persons with mobility or visual impairments. These areas may be difficult or impossible to traverse, even for able‐ bodied persons. Items or situations that affect or disrupt the path of travel from a parking lot or approach to the entrance of any of the public facilities. If a person can not approach a building or facility due to a lack of ADA-compliant parking, pavement, or walkways, then all other repairs or replacements are irrelevant. High-priority attributes include:
• Lack of ADA-compliant parking spaces.
• Marked travel lanes.
• Missing or broken pavement or sidewalks.
• Barriers or impediments.
• Non-compliant steps.
• Non-compliant curbs.
• Excessive slopes and grades.

Medium-priority barrier issues are represented by items that inhibit disabled users from entering or utilizing all or part of a public facility. Medium-priority attributes include:
• Non-compliant doors or doorways.
• Lack of automatic opening devices.
• Non-compliant ramps and railings.
• Non-compliant interior-level changes.
• Grade separations.
• Non-compliant counters.
• Non-compliant cabinets.
• Non-compliant tables.
• Non-compliant restrooms.

Lower priority deficiencies are items that are non‐compliant with ADA guidelines that do not impede progress or inhibit access but provide direction, instruction, or autonomy to users.

Still traversable by persons in mobility devices and can remain operational if not ideal. Lowpriority attributes include:
• Non-compliant signage.
• Height or width placement.
• Minor grade or slope issues.
• Non-compliant door and gate push bars.
• Non-compliant door hardware.
• Non-compliant kickplates.
• Minor protrusions.
• Non-compliant lighting.

City of Farmersville Page 3-11
Priority Locations. The priority locations are those that are likely to attract the highest number of persons with disabilities as well as having generally high overall pedestrian activity, therefore identifying where improvements will have the greatest impact. The specific land uses and attributes included in the prioritization strategy include all government office buildings, facilities, municipal parks, and associated access areas open to the public.

3.4 - Maintenance
Deficient maintenance practices can negatively affect overall safety and security. Without adequate maintenance practices in place, the safety and security of users of public spaces and facilities are at higher risk of injury or harm. Poor maintenance practices that allow general disrepair send a signal that ‘nobody cares’ or is watching. The most common ADA complaints are related to broken, cracked, lifted, and missing segments of the sidewalk that can lead to inconvenient or even dangerous barriers to access situations. Quality maintenance practices can reduce potentially dangerous incidents for residents and have been shown to even reduce litter, graffiti, and vandalism.

Consider the following approach to routine maintenance:
• Conduct regular inspections to identify infractions or hazards before they become problems.
• Identify causes and develop appropriate mitigation strategies for potentially recurring issues.
• Use the City’s Geographic Information System to efficiently inventory and organize annual inspections, repairs, and upgrades.

Special Note about Estimated Costs
The estimated costs in this document are based on estimated unit costs in the year 2023.

When these estimates are used in future years, they should be increased based on the California Construction Cost Index.

3.5 - Funding Sources

Partial ADA Transition Plan April 2023
City of Farmersville Page 3-12
Generally accepted funding sources include:
• Municipal general fund sources.
• Municipal tax increases for dedicated programs or services. • Federal or State grant funding for other renovation purposes (e.g., park renovation, community centers).
• Private donations through service groups, organizations, business sponsors, individual sponsors, or community fundraising efforts.

SECTION 4 - ADA COMPLIANCE POLICY AND PROCEDURES GUIDE
The Americans with Disabilities Act of 1990 is an all-inclusive law that requires each municipality to review and evaluate all aspects of its public access, programs, services, and activities for compliance with the ADA standards. These are referred to as Self-Evaluation and Transition Plans. The Self-Evaluation process (see Appendix B) requires understanding the ADA Title II regulations, specifically the access to existing facilities. While all public agencies in the State are required to perform a Self-Evaluation process, a Transition Plan is mandated for public agencies with 50 or more employees.

4.1 - Point Person/ADA Coordinator and Independent ADA Compliance Contract
The City is required to designate at least one person to serve as the ADA Coordinator. The person selected will need to be committed to being present at all public meetings. They should have the education, experience, and local knowledge to bring effective coordination of Farmersville’s efforts to achieve ADA compliance.

The ADA Coordinator is responsible for coordinating the efforts of the government entity to comply with Title II and investigating any complaints alleging that the entity has violated Title II. The name, office address, and telephone number of the ADA Coordinator must be provided to all interested persons upon request.

The qualifications that help an ADA Coordinator to be effective include the following:
• Familiarity with the City’s government’s structure, activities, and employees. • Knowledge of the ADA and other laws addressing the rights of people with disabilities.
• Experience with people with a broad range of disabilities. • Knowledge of various alternative formats and alternative technologies that enable people with disabilities to communicate, participate, and perform tasks. • Ability to work cooperatively with the local government and people with disabilities. • Familiarity with any local disability advocacy groups or other disability groups. • Skills and training in negotiation and mediation.
• Organizational and analytical skills.

4.2 - Process Guide
The City can use the information developed in the Partial ADA Transition Plan and the Previous ATP Action Plan to inform the ADA Coordinator and City staff on the most effective direction for prioritizing target locations for repair and continuing maintenance.

Partial ADA Transition Plan April 2023
City of Farmersville Page 4-2

4.2.1 - PUBLIC NOTICING
Municipalities are required to make sure the public is aware of the rights afforded to them under the Americans with Disabilities Act and are adequately informed of changes or updates to City policy, procedures, or facility access. Municipalities must establish a dialogue with residents and solicit feedback from the disabled community during the development of the Partial ADA Transition Plan. If you use the radio, newspaper, television, or mailings, republish and re-broadcast the notice periodically. Publish the notice on the City’s website.

Post the notices on bus shelters, parks, senior centers, and other public buildings and facilities. Announce notices at public program meetings, coordination meetings, service locations, council meetings, and other City-sponsored activities. Notices should include the following information:
• What the ADA requires of the City of Farmersville.
• Name and contact information of the ADA Coordinator.
• Employment (U.S. Equal Employment Opportunity Commission). • Effective communication (aids and services to persons with disabilities). • Modifications to policies and procedures (to make sure persons with disabilities can equally participate).

Preferred feedback from people with disabilities should include the following:
• Regular (annual) public forums to supplement requests by local citizens as part of the City’s ongoing responsibilities to improve accessibility for pedestrians. • Formally assigning a Public Works or Administration staff person to coordinate citizen requests and installations and oversee policies associated with this Transition Plan Update.
• Providing information on the City’s programs to local and regional transit providers upon request in order to help coordinate the delivery of accessible transit services. • Reasonable accommodation will be available to permit field staff to interact with people with disabilities.

4.2.2 - GRIEVANCE PROCEDURE
The City of Farmersville has already adopted an ADA grievance procedure that includes an outline of the policy and procedures as well as a fillable form for filing official grievances or complaints with the City. Descriptions of the procedures and forms are all available for review on the City of Farmersville website at https://www.cityoffarmersvilleca.gov/Document Center/View/1010/ADA-Grievance-Procedure?bidId or for access to the official filing form at https://www.city of Farmersville-ca.gov/Document Center/View/1001/ADA-Grievance-Form-English. Complaints or grievances from the community can be filed with the City of Farmersville in a formally established process as listed in the links above. The procedure does include a timeframe in which the City is required to respond as well as a formal (written) appeal process for the complainant. The grievance procedure includes, but is not limited to, the following items:

Partial ADA Transition Plan April 2023
City of Farmersville Page 4-3
• A description of how and where a complaint under Title II may be filed with the City.

If a written complaint is required, a statement notifying potential complainants that alternative means of filing can be made available for people with disabilities who require or request it.
• A description of the timeframes and processes to be followed by the complainant and the City.
• Information on how to appeal an adverse decision.
• A statement of how long complaint files will be retained.

The City-established grievance procedure should be distributed to all department heads, posted in public spaces of public buildings and on the City’s website, and updated when the complaint procedure and/or the contact information for the ADA Coordinator is changed. In addition, the procedure must be available in alternative formats so that it is accessible to all people with disabilities.

4.2.3 - COMPLIANCE DOCUMENTATION
The City should develop a program to document accessibility improvements made to any City infrastructure or facilities, including those that have been previously completed. Include the documentation of the complaints, grievances, assessments, evaluations, and completed improvements. Utilize photographs, standardized reports, budgets, expenses, and detailed descriptions to track progress and develop a catalog of successfully completed projects.

Establish and periodically review the City’s guidance and standards documents for consistency with current applicable ADA and accessibility standards. Develop sets of guidance documents and development standards to assist in avoiding common design and construction-related issues. Consult the most recent updates of City Design and Building Standards.

4.2.4 - MAINTAIN SELF-EVALUATION AND TRANSITION PLAN
The City of Farmersville shall evaluate all programs, facilities, services, and activities for compliance with the Americans with Disabilities Act. City-owned properties and facilities should be evaluated for barriers to accessibility compliance. Once barriers are identified, develop the Transition Plan to improve them, including costs, schedule, and who or which department will be responsible for repairing and maintaining them.

All public entities, regardless of size, must conduct a Self-Evaluation [28 C.F.R. §35.105(a)].

The Self-Evaluation is a comprehensive review of the public entity’s policies and practices.

The Self-Evaluation should include the following:
• Identify all programs, activities, and services and their locations. • Determine whether employees and officials are familiar with the City’s ADA obligations, including the requirement to make reasonable modifications to policies, practices, and procedures.

Partial ADA Transition Plan April 2023
City of Farmersville Page 4-4
• Review service, activity, and program policies and procedures to determine whether they ensure an equal opportunity for people with disabilities to participate and benefit.
• Survey facilities and determine whether there are physical barriers to accessing programs. If non-structural changes, such as moving programs, should be made, include them in the Action Plan. If structural changes are needed, include them in the Transition Plan.
• Under Title II, public entities that employ 50 or more people [subsequently amended to 15] are required to develop a Transition Plan when structural changes to existing facilities are necessary to make programs, services, or activities accessible to people with disabilities [28 C.F.R.§35.150(d)(1)]. The Transition Plan must include the following:
o Survey and document a list of the physical barriers that limit the accessibility of programs, activities, or services.
o Maintain a citywide inventory to determine the items that need to be repaired, upgraded, or constructed to meet standards.
o Methods to remove the barriers and make the facilities/programs accessible. o A timeline and budget for achieving compliance.
o The Public Works Director is currently operating as the ADA Coordinator and Compliance Officer for the City and is responsible for implementing each of the Plan’s components.

The City should develop and implement proactive guidelines and policies for the ongoing Self-Evaluation and maintenance of existing locations as well as the establishment of new baseline standards for future development and construction.

4.2.5 - APPROVE SCHEDULE AND BUDGET
A protracted schedule of barrier removal, replacement, improvement projects, and continuing maintenance should be included in the City’s annual budget as a regularly occurring line item. This should continue until all barriers are eliminated.

In each budget, the City should identify proposed improvements and maintenance and then identify the time in which they are anticipated to be completed.

4.2.6 - MONITOR PROGRESS
Once the City begins work on the Transition Plan, keep track of barrier removal projects, and update the City’s progress regularly to inform both staff and the disabled community so that they can all remain informed. Steps that should be considered include:
• Use the Transition Plan in annual planning cycles.
• Establish a baseline from the initial inventory.
• Make the Transition Plan a “Living Document.”
• Update annually.
• Develop a tracking system to monitor progress.

Partial ADA Transition Plan April 2023
City of Farmersville Page 5-1
SECTION 5 - CONCLUSIONS AND RECOMMENDATIONS

5.1 - Conclusions
• Based on the results of the Self-Evaluation Test and Partial ADA Transition Plan, the City is behind in meeting national ADA compliance goals at their public facilities.

However, the City is making strides toward compliance by having issues at each of the locations identified and then developing plans, procedures, and budgets to rectify all barrier access issues in a timely manner.
• The City is involved in actively developing and seeking connection and feedback from the local disabled and mobility-challenged members of the community in order to pre-emptively identify and resolve issues before they reach a critical stage. • The City will need to be aggressive in seeking out public and private sources for funding in order to assemble enough resources to ultimately eliminate all the listed barrier items before they present even greater liability concerns for the City.

5.2 - Recommendations
• Develop and maintain policies and procedures to continue actively Self-Evaluating, identifying, and resolving current or future barriers or non-compliance issues. • Develop strategies for scheduling and budgeting current and future non-compliance issues.
• Develop public outreach programs or feedback systems to help identify and resolve issues in a safe and timely manner.
• Develop staff outreach programs or feedback systems that help identify and resolve issues in a safe and timely manner. (e-mail, ‘see it - say it’ program, suggestion box, social media, and website contact point.)

APPENDIX B

SELF-EVALUATION REGULATIONS AND COMPLIANCE

Partial ADA Transition Plan April 2023
City of Farmersville Page B-1

SECTION 6 - SECTION 504 REGULATIONS
HUD requires jurisdictions to have documented their compliance with Section 504 federal regulations. To certify compliance, applicants must complete the Section 504 form in the Application Summary of the application package. It is important to note that the form itself does not constitute the jurisdiction’s efforts to meet Section 504.

The jurisdiction should have performed an analysis and evaluation of each factor and prepared a Section 504 Plan. The self-certification form is used to certify that the jurisdiction has performed this analysis and evaluation and to record areas of compliance or problems.

SECTION 7 - SECTION 504 COMPLIANCE
Section 504 of the Rehabilitation Act of 1973, as amended, was implemented by the Department of Housing and Urban Development in a final rule published in the Federal Register on June 2, 1988. This rule applies to direct and indirect applicants and recipients of funding under Title I of the Housing and Community Development Block Grant Act of 1974. The rule requires that no otherwise qualified individual with handicaps shall, solely by reason of his or her handicap, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance from HUD.

In addition to the non-discriminatory and affirmative action activities discussed in the CDBG Grants Management Manual, grant recipients must undertake several activities to be in minimal compliance with Section 504:

1. Communications
A. The recipient shall take appropriate steps to ensure effective communication with applicants, beneficiaries and members of the public.

In determining what auxiliary aids are necessary (e.g.
telecommunication devices for deaf persons (TDD’s)) the recipient will give primary consideration to the requests of the individual with handicaps. Where a recipient communicates with applicants by telephone, TDD’s or equally effective communications systems shall be used.

B. The recipient shall adopt and implement procedures to ensure that SECTION 504 SELF-EVALUATION

Partial ADA Transition Plan April 2023
City of Farmersville Page B-2
interested persons (including persons with impaired vision or hearing) can obtain information concerning the existence and location of accessible services, activities and facilities. This section does not require a recipient to take any action that the recipient can demonstrate would result in a fundamental alteration in the nature of a program or activity or in undue financial and administrative burdens. The recipient must nonetheless ensure that, to the maximum extent possible, individuals with handicaps receive the benefits and services of the program or activity receiving HUD assistance.

2. Employment In addition to the general prohibitions against discrimination discussed elsewhere in the Grant Management Manual, grantees must ensure the following:

A. A recipient shall make reasonable accommodation to the known physical or mental limitations of an otherwise qualified applicant with handicaps or employee with handicaps, unless the recipient can demonstrate that the accommodation would impose an undue hardship on the operation of its program.

B. A recipient may not use any employment test or other selection criterion that screens out or tends to screen out individuals with handicaps or any class of individuals with handicaps. Preemployment inquiries may not be made to determine whether the applicant is an individual with handicaps or the nature or severity of a handicap except as directly related to an applicant’s ability to perform job-related functions.

3. Program Accessibility Except as otherwise provided, no qualified individual with handicaps shall, because a recipient’s facilities are inaccessible to or unusable by individuals with handicaps, be denied the benefits of, be excluded from participation in, or otherwise be subjected to discrimination under any program or activity that receives Federal financial assistance.

Recipients using State CDBG funds for the construction or alteration of community facilities should contact the Department’s Equal Opportunity/Fair Housing Specialist for guidance on HUD accessibility requirements. Accessibility requirements must also be met by multi-family housing constructed in whole or in part by HUD funds.

4. Enforcement
A. Assurances: All applicant jurisdictions to the State CDBG program are required to submit with each application a signed Statement of

Partial ADA Transition Plan April 2023
City of Farmersville Page B-3
Assurances that state, in part, that the applicant will comply with Section 504 of the Rehabilitation Act of 1973, as amended, and implementingregulations.

B. Covenants: Where property is purchased or improved with federal financial assistance or where federal financial assistance is provided in the form of real property or interest in the property, the instrument effecting or recording this transfer shall contain a covenant running with the land to assure nondiscrimination for the period in which the real property is used for a purpose that the federal financial assistance is extended or for another purpose involving the provision of similar services or benefits.

C. Self-Evaluation: Each grantee shall, in consultation with interested persons, including individuals with handicaps or organizations representing persons with handicaps:
1) Evaluate its current policies and practices to determine whether, in whole or in part, they do or do not meet the requirements of Section 504;
2) Modify any policies or procedures that do not meet the requirements of Section 504; and,
3) Take appropriate corrective steps to remedy the
discrimination revealed by the self-evaluation.

A grantee that employs 15 or more persons shall, for at least three years following the completion of the evaluation, maintain on file, make available for public inspection, and provide to the responsible civil rights official, upon request:
1) A list of interested persons consulted;
2) A description of the areas examined and any problems identified; and,
3) A description of any modifications made and of any remedial steps taken.

D. Designation of Responsible Employee and Adoption of Grievance Procedures: A grantee that employs 15 or more persons shall designate at least one person to coordinate its efforts to comply with Section 504 implementing regulations. Grantees that employ 15 or more persons must also adopt grievance procedures that incorporate appropriate due process standards and that provide for the prompt and equitable resolution of complaints alleging any

Partial ADA Transition Plan April 2023
City of Farmersville Page B-4
action prohibited by Section 504 and related implementing regulations.

E. Notice: A grantee that employs 15 or morepersons shall:
1) Take appropriate initial and continuing steps to notify participants, beneficiaries, applicants and employees, including those with impaired vision or hearing, and unions or professional organizations holding collective bargaining or professional agreements with the grantee that it does not discriminate on the basis of handicap in violation of Section 504. The notification shall state, where appropriate, that the grantee does not discriminate in admission to, access to, or treatment or employment in its federally-assisted programs and activities. The notification shall also include an identification of the designated responsible employee. City Council
Staff Report 8B
TO: Honorable Mayor and City Council
FROM: Kevin Gross, City Engineer
DATE: May 8, 2023
SUBJECT: Freedom Drive No Parking Zone
RECOMMENDED ACTION:

That the City Council discuss and provide direction on the proposed “No Parking” zone along Freedom Drive to improve traffic flow for NB travel onto Walnut Street during school hours.

BACKGROUND:

Freedom Drive is a primary outlet for school traffic serving both Farmersville High School as well as Freedom Elementary. As in most school zones, traffic builds up during the morning and afternoon rush. When vehicles park on the east side of Freedom Drive near the intersection of Walnut Avenue, it restricts the ability for traffic to make right turn movements and backs up the traffic severely. The city has requested that staff review and recommend traffic improvements in the area to alleviate this problem.

DISCUSSION:

The City municipal code identifies the conditions in which curb markings, no parking areas and additional signage can be placed. The sections and statements within the code that pertain to this recommendation are as followed:

Chapter 10.32 – Stopping, Standing and Parking
• 10.32.020 -Traffic engineer to maintain no stopping zones and no parking areas. o The city traffic engineer is authorized to maintain, by appropriate signs or by paint upon the curb surface, all no stopping zones, no parking areas, and restricted parking areas, as defined and described in this title.
• 10.32.060 – Parking adjacent to schools.
o The city traffic engineer is authorized to erect signs indicating no parking upon that side of any street adjacent to any school property when such parking would, in his opinion, interfere with traffic or create a hazardous situation. • 10.32.180 – No Stopping Zones
o The city traffic engineer shall designate established no-stopping zones by placing and maintaining appropriate signs indicating that stopping of vehicles is prohibited and indicating the hours and day when stopping is prohibited. o During the hours and days designated on the signs, it is unlawful for the operator of any vehicle to stop said vehicle on any of the streets or parts of streets established by resolution of the council as no stopping zones.

Recommendation:

After considering all factors and guidelines established by the city municipal code, the following diagram depicts the City Engineer’s recommendations for signage and curb markings on Freedom Drive near Walnut Ave.

Visual 1 – Freedom Drive “No Parking”
The first recommendation of parking regulations is 150 feet of “red curb” on the east side of Freedom Drive, beginning at the intersection of Walnut Ave. This will permanently remove parking near the intersection, where right turn movements are most common. No further permanent “red curb” is proposed due to the potential parking that the Sports Park may require once completed.

During school hours where traffic is mostly congested, further implementation of “no parking” signage is recommended for a minimum distance of 500’ (3 light poles). This will ensure an adequate clear zone of 20+ vehicles during rush hour traffic. The proposed time at which the sign regulates parking is from 7:30AM – 4:30PM. This may be modified at the request of the city and school district if needed.

The process and installation can be coordinated and executed by the City of Farmersville Public Work Department.

COORDINATION & REVIEW:

The Freedom Drive - No Parking Zone has been reviewed and coordinated with the City Manager, Public Works Director, and City Engineer.

FISCAL IMPACT:

There are minor costs for (3) signs and red paint.

CONCLUSION:

That the City Council review the staff report and provide direction to staff on implementing no parking on Freedom Drive near Walnut St.

SUBJECT: Review of Draft Total Budget for Fiscal Year 2023-24 RECOMMENDED ACTION:

It is recommended that the City Council accept, and review materials presented regarding the draft total budgets of the City for Fiscal Year 2023-2024.

BACKGROUND and DISCUSSION:

On February 27, 2023, the City Council reviewed the draft Capital Improvement Budget for Fiscal Year 2023-24 and gave approval to move forward with the draft pending any updated information through the budgeting process.

Additionally, on April 10, 2023, the City Council reviewed the draft Enterprise Fund Budgets (Water, Sewer, and Refuse) for Fiscal Year 2023-24 and gave approval to move forward with the draft pending updates as well.

Most recently, on April 24, 2023, the City Council reviewed the draft General Fund Budget for Fiscal Year 2023-24 and gave approval to move forward.

Now, staff will present the next portion of the draft budget for Fiscal Year 2023-24, which pulls all parts of the budget together for a comprehensive review. The Council will have the opportunity to ask questions and give direction as appropriate and needed to proceed to the next steps of the budget process.

No voting or resolution is needed at this time because this item exists to only discuss the draft budget as it is now, with final presentation and ultimate adoption of the spending plan for Fiscal Year 2023-24 in June 2023.

inflated by large dollar amount grants,
spending large amounts on street
repairs, and spending large allocations
of cash like Measure Q or ARPA.

The total spending plan includes all
parts of the budget already reviewed at
previous meetings.

OTHER FUND BUDGETS
Other Operations Related to the General Fund
What are “other funds”?
These are funds that typically
hold restricted funds, grants, or
designated cash held for
specific purposes.

Expenses are typically paid
from cash on hand or through
grant reimbursements toward
the capital budget.

Some expense exceptions
apply, but they are usually
accounted for through the
capital budget.
• Examples of “other funds” in
the budget are:
• Measure Q Fund
• Street Repair Funds
• Development Impact Fees
• Maintenance Districts & Rental
Facilities
• Police SLESF
• Program Income for CDBG,
HOME, and CalHOME.

Other Fund
Budgets
Funds other than the main operations
of the City are typically accounted for
in the Capital Budget and/or are
restricted funds that spend down cash
allocations already on hand.

Many of these funds are not
programmed to spend any funds for FY
2023-24, and this is normal as they
may store up cash over years in order
to have enough to contribute toward a
project.

Some funds house a portion of salary
and benefit cost, but it is not usually a
large share. Gas Tax and SLESF funds
are good examples of this.

TOTAL BUDGET
The Big Picture for FY 2023-24
Total Budget • Summary:
• Expenses far outweigh
revenues because the City is
spending down cash
allocations already received
(ARPA, Street Funds, etc).
• Operations are operating
effectively, or if not, the
issues are known and being
resolved (utility rate study).
• Revenue listed in Other Funds
typically offset expenses in
the Capital Budget. Any
amount of expense exceeding
revenue is paid out of cash on
hand.

Budget Category Expense Revenue
Capital Budget 19,802,511.00 -
Water Budget 1,267,912.00 1,199,035.00

• Utility Rates will need to be
evaluated for future stability.
• Measure Q Revenue continues
to decline for 2 years straight.
• The General Fund has a
narrow operating margin, but
sufficient for now.
• Major purchases for the Sewer
Plant needed.
• Potential recessionary
economic changes.
• Potential changes to the tax
base through development.
• Should I be concerned?
• No, volatility in economic
activity that impacts revenues
and expenses are a natural
process that budgeting must
work around.
• The City takes precautions to
be conservative in the budget
approach but also vigilant to
revise as needed throughout
the year to keep long-term
stability.

Summary &
Next Steps
• Total Budget is similar to past
years.
• Budget is appropriate and is
planned to be adopted on time.
• The City continues to expand to
meet the demand for service
levels.
