CITY OF

FARMERSVILE
City Council
Staff Report 7E
TO: Honorable Mayor and City Council
FROM: Kevin Gross, City Engineer
DATE: May 22, 2023
SUBJECT: 2023/2024 Landscape and Lighting Assessment Districts RECOMMENDED ACTION:

That the City Council adopt Resolution 2023-021 directing the City Engineer to prepare the Engineer's Report for Farmersville's Landscape and Lighting Assessment Districts and that the City Council set the Public Hearing for July 24, 2023.

BACKGROUND:

The City currently has 13 landscape and lighting districts formed as a part of the approval process of various subdivisions for maintaining the surrounding landscaping in each of the subdivisions. The City maintains the turf, shrubs, trees, irrigation systems, lighting (in some districts), and walls on the exterior of the parcels of land which are all located in the public right of way.

Each parcel within each subdivision is assessed an amount equal to their share of the costs for said maintenance. Each fiscal year, the City is required, by the rules for the assessment districts (in accordance with the 1972 Landscape and Lighting District Act), to do a cost accounting of the assessments for the upcoming year.

There are several steps in the process to recover the cost of maintenance for these districts. The following is a summary of the steps that take place in this process:

1. The City Council adopts a resolution at its May 22, 2023, Council meeting directing the City Engineer to prepare the Engineer's Report and sets the Public Hearing on July 24, 2023
There are currently 13 separate districts in the city consisting of 822 individual lots.

2. The City Engineer prepares the Engineer's Report and incorporates applicable charges for the individual districts.
1 -

3. On June 12, 2023; the City Council adopts. a resolution approving the Engineer's Report and adopts a resolution of intent to levy and collect assessments on the Landscape and Lighting Assessment Districts. -

4. Advertise a notice in the newspaper on June 13, 2023, for the Public Hearing on July 24, 2023 announcing the annual updates.
-

5. Conduct a Public Hearing on July 24, 2023 and adopt a resolution levying the assessments for each district.

6. After the Public Hearing and Council action, the City Clerk will deliver a master list with the assessment to be applied to each applicable parcel to the County Assessor's office.

1. The adjusted assessments will be added to the County's assessment rolls in August and the City would receive from the County the monies from the two normal, semiannual property tax collections (one in December and one in April) to pay the expense of providing the above maintenance activities.

DISCUSSION:

During the July 24, 2023 Public Hearing, property owners/residents will be allowed to offer any testimony in person or in writing regarding the assessments that are proposed.

FISCAL IMPACT:

The assessment districts are self-funded, and costs recovered for the County Assessor cover the actual costs of maintaining the districts. The applicable charges will be included in the 2023/2024 fiscal budget.

CONCLUSION:

It is respectfully recommended that the City Council:
a) Set the Public Hearing for July 24, 2023
b) Adopt Resolution 2023-021 directing the City Engineer to prepare the Engineer's Report for Farmersville's Landscape and Lighting Assessment Districts.
