FARMERSVILLE TO: Farmersville City Council
MEETING DATE: July 14, 2025
DEPARTMENT: City Manager
FROM: Daymon Qualls, City Manager
AGENDA TITLE: Study Session: Review and Discussion of Special Event Permitting Policies, Administrative Fees, and Fee Waivers for Non-Profit Events
ACTION & RECOMMENDATION
Staff recommends that the City Council provide direction on the following:
1. Whether to proceed with development of a formal Fee Waiver Policy for nonprofit special events;
2. Whether to implement an application deadline and/or deposit requirement;
3. Any additional elements Council would like included in future updates to the Special Event Permit process;
4. Whether Council prefers a standalone resolution or a broader amendment to the City's Comprehensive Fee Schedule.
BACKGROUND | ANALYSIS
On May 27, 2025, the City Council considered a request from Farmersville Youth Baseball to waive the administrative fee associated with a Special Event Permit. During Council deliberation, members expressed support for waiving fees for community-serving non-profit events, but raised several key concerns:
• Consistency and Transparency: Current process lacks clear criteria or procedures for evaluating fee waiver requests.
• Fiscal Impact: While many waivers involve modest amounts, cumulative impacts may affect the General Fund or staff workload.
• Administrative Burden: Last-minute requests can strain staff resources and reduce time for proper review and coordination.
• Event Clean-Up and Accountability: There is no deposit or enforcement mechanism to ensure sites are properly restored after events.
Following these discussions, the Council approved the request and directed staff to schedule a study session to review current practices and identify opportunities for greater fairness and consistency.
Previous Council Action
The current fee schedule was adopted via Resolution 2021-045 on September 13, 2021, following a comprehensive Cost of Services Study conducted by Revenue & Cost Specialists, LLC. The updated schedule became effective January 1, 2022.
The study was undertaken to align service fees with the actual cost of delivery and reduce reliance on General Fund subsidies. The City's permit and event-related fees are part of this schedule.
Current Requirements
Under Farmersville Municipal Code:
• §10.68 regulates event and parade permits, requiring application at least two working days in advance and subject to conditions related to safety, traffic, and public peace. • §17.56.040 governs temporary outdoor uses, including nonprofit fundraising activities and parades, and requires a Temporary Use Permit signed by both the Planning Director and Chief of Police.
These sections do not currently define criteria or processes for fee waivers or deposit requirements.
To promote consistency and transparency, the Council may consider the following policy areas:
1. Fee Waiver Eligibility
• Should fee waivers be allowed only for 501(c)(3) or similar non-profit organizations? • Should waivers be limited to events that are free to attend or open to the public? • Should an organization be limited to one fee waiver per year?
2. Application Deadline
• Is the current two-working-day minimum sufficient?
• Would a 30-day advance deadline for fee waiver requests allow for better planning?
3. Clean-Up Deposit
• Should a refundable deposit be required to ensure post-event clean-up? • Should the deposit be scaled based on event size or type?
4. Written Policy or Resolution
• Should staff develop a formal Council-adopted policy or resolution outlining the criteria and process for fee waiver consideration?
5. Vendor Fees and Oversight
• Should vendor participation in nonprofit events be subject to separate review or reduced fees? • Should staff explore tiered fee structures based on event complexity or City resource usage?
FISCAL IMPACT
Without consistent guidelines, event fee waivers, though individually small, may result in cumulative loss of cost recovery revenue. The adoption of a formal policy could help ensure that any waivers granted reflect Council priorities while preserving City resources.

Pg. 19 CHAPTER III - REVENUES MATCHED AGAINST COSTS
CHAPTER III - REVENUES MATCHED AGAINST
COSTS
In the last chapter the method of calculating the costs for all City services was identified. This chapter begins with a Summary that itemizes the revenues and costs by service center: Then, an overview is presented of what will be presented in the following chapter, which shows that there is no one solution to the City's financial challenge.
Accounting for All Revenues - Fees and Taxes
Local government funding comes from a multitude of revenue sources such as taxes, fines, grants, use of property, user fees, utility rates, etc. Our Study accounts for all revenues, and focuses on the relationship between fees and taxes. As an example, [S-001] Conditional Use Permit in the following schedule estimates the full costs at $8,911. These expenses are offset by current fee revenues of $7,500, and $1,411 of the City's limited tax revenues must be used to pay for the remaining. This subsidy can be eliminated by raising the relevant fees. To the extent that the fees are NOT increased, general City taxes paid by all taxpayers are the only alternative revenue source.

AGENDA TITLE: Review and Approval of Community Survey Questions Regarding Potential Cannabis Café Ordinance Amendment
ACTION & RECOMMENDATION
Staff recommends that the City Council review and approve the proposed community survey questions intended to gauge public opinion on allowing cannabis consumption lounges ("Cannabis Cafés") in the City of Farmersville.
BACKGROUND | ANALYSIS
On May 12, 2025, the City Council reviewed the implications of Assembly Bill 1775 (AB 1775), which authorizes local jurisdictions to permit on-site cannabis consumption at licensed retail premises, including the preparation and sale of non-cannabis food and beverages, and the hosting of live entertainment.
During that meeting, Council directed staff to return with a list of potential survey questions to gather community feedback regarding the possibility of amending the City's municipal code to allow cannabis cafés in Farmersville.
In response to that direction, staff has developed a draft set of community survey questions intended to:
• Assess general community support or opposition.
• Understand residents' concerns and priorities (e.g., safety, location, economic impact). • Identify preferred restrictions or operating conditions, if cannabis cafés were to be allowed.
The proposed survey would be administered through SurveyMonkey and promoted via the City's website and Facebook page, with the goal of reaching a broad and representative cross-section of the community.
Staff feels that public input is an essential component in evaluating potential changes to local cannabis policy.
The survey is intended to:
• Inform Council's future decision-making.
• Ensure transparency and responsiveness to community standards. • Support further policy development, if directed.
A draft of the proposed survey questions is included as an attachment for Council review.
Upon approval, staff will finalize the distribution plan and begin outreach to encourage participation. Survey results will be compiled and presented at a future City Council meeting for discussion and potential next steps.
FISCAL IMPACT
Unknown at this time, but potential revenue may include permitting fees, local cannabis business taxes, and increased sales tax generation.

In accordance with Article XIIIB of the California State Constitution and Senate Bill 1352, the City of Farmersville is required to set an annual Appropriations Limit. For Fiscal Year 2025-26, the limit has been determined using data provided by the California Department of Finance, as detailed in Schedule A. Staff recommends adopting the resolution establishing the FY 2025-26 Appropriations Limit.
A notice was posted at least 15 days in advance to alert the public to the City's presentation of this appropriation limit. The City is within the appropriation limit as required by law as indicated on Schedule A.
The appropriation limit for Fiscal Year 2025-26 is $6,550,938.64. This number represents the maximum amount the city can spend of tax dollars. This does not represent the maximum amount the City can spend. It is estimated that the spending for FY 2025-26 that is subject to this limit will be well under the threshold once again at $5,715,671.
BUDGET & CAPITAL IMPROVEMENT PLAN
On June 24# the City of Farmersville City Council received and reviewed a draft budget for the 2025-2026 fiscal year. Council directed staff to review a few line items, ask budget managers for final input and return to Council with a proposed budget to be considered for adoption at a public hearing. Included in the budget is the continuation of projects outlined in the 5 year Capital Improvement Plan adopted last year (Resolution 2024- 023).
The General Fund is primarily supported by unrestricted revenue sources, such as property taxes, sales taxes, and other general-purpose revenues. Unlike special revenue funds, which are earmarked for specific uses, the General Fund may be allocated across a broad range of municipal functions. This includes funding for essential and legally mandated services such as public safety, administration, parks, and general government operations.
2025-26 General Fund Budget 2024-25 General Fund Budget $7,903,673 $6,558,902
The remainder of the proposed budget is comprised of the City's other funds, including Special Revenue and Enterprise Funds.
Special Revenue Funds are used to account for revenues that are legally restricted for specific purposes, such as street maintenance, affordable housing, and grant-funded programs. These funds ensure transparency and accountability by directing resources to clearly defined uses.
Enterprise Funds operate more like self-supporting businesses, where the costs of providing essential services-such as water, sewer, and refuse collection-are covered primarily through user fees. These funds help ensure that utility operations remain financially sustainable without relying on General Fund support. 2025-26 Other Funds Budget 2024-25 Other Funds Budget
$14,373,202 $18,104,671
The City's total budget encompasses both the Capital Budget and the Operating Budget, detailing all anticipated revenues and planned expenditures for the fiscal year. 2025-26 Total Budget 2024-25 Total Budget
$22,276,875 $24,663,573
SALARY SCHEDULE
The City's Master Salary Table is adopted annually in compliance with California Government Code Section 36506, which mandates that the City Council establish compensation for all appointed officers and employees through a formal Resolution or Ordinance. Additionally, Title 2, Sections 570.5 and 571 of the California Code of Regulations require that the approved pay schedule be publicly accessible. A copy of the updated Salary Schedule recommended for adoption is included with proposed resolution 2025-0xx.
FISCAL IMPACT
The budget is the main financial mechanism available to the Council and staff to manage the finances of the City. The proposed budget is balanced and within the statutory appropriation limits.
