CITY OF Item #: 2
STAFF REPORT Consent
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: August 25, 2025
DEPARTMENT: Public Works
FROM: Steven Thompson, Director of Public Works
AGENDA TITLE: Adopt Resolution 2025-042 approving the 2025 City of Farmersville Speed Zone Survey conducted by 4Creeks, the City's contract engineering firm, confirming enforceable speed limits on various roadways within the City and authorizing installation of new speed limit signs at the locations identified in the survey.

ACTION & RECOMMENDATION
Staff recommends that the City Council adopt Resolution 2025-042 approving the 2025 City of Farmersville Speed Zone Survey, conducted by the City's contract engineering firm, 4Creeks, confirming enforceable speed limits on various roadways within the city, and authorizing the installation of new speed limit signs in (5) locations as recommended by the survey.

BACKGROUND | ANALYSIS
The California Vehicle Code (CVC) mandates that all speed limits in excess of 25 miles per hour must be based on an engineering and traffic survey if they are to be enforceable by radar. The CVC further requires that these speed zone surveys be updated at least once every seven (7) years to maintain radar enforcement capabilities.

The 2025 Speed Zone Survey was conducted between April 2, 2025, and April 4, 2025, by 4Creeks, the City's contract city engineer. The survey collected traffic data from seventeen (17) locations throughout Farmersville using a radar traffic speed meter. Based on the data collected, recommended changes to the speed limits were proposed for several locations in the city to enhance safety and maintain enforceability of the speed limits.

The proposed changes are as follows:

Location Current Speed Limit Recommended Speed Limit
Farmersville Blvd (Visalia Rd - South City Limits) 45 mph 40 mph Walnut Ave (West City Limits - Farmersville Blvd) 50 mph 45 mph Petunia Street (Ventura Ave - Farmersville Blvd) 35 mph 30 mph Front St (Ventura Ave - Farmersville Blvd) 35 mph 25 mph Visalia Road (West City Limit - Shasta Ave) 45 mph 40 mph The survey confirms that the existing speed limits for the other locations remain appropriate. These adjustments ensure enforceable and safe speed limits throughout the City.

FISCAL IMPACT
Staff will utilize existing funds allocated for traffic and road safety improvements to cover these expenses. The total cost is expected to be minimal, and no additional appropriation is required at this time.

City of Farmersville
Engineering and Traffic Survey
Introduction
Setting or adjusting speed limits require rational and defensible determination to maintain public confidence in the local agency. Adherence to speed limits helps keep speed-related traffic collisions low and improve public safety.

Chapter 7 of Division 11 of the California Vehicle Code (CVC) outlines regulatory speed laws.

Specific sections of the CVC regarding definitions, guidelines and regulations can be found in Appendix A. Prima facie speed limits, outlined in the CVC, are default speed limits that drivers must follow unless specific conditions necessitate driving at a higher or lower speed. A prima facie 25 miles per hour (MPH) speed limit is used on local roadways in residential and business districts, in a school zone when children are present, or when passing a senior center. The maximum speed limit on any two-lane, undivided highway is 55 MPH. Local agencies may also establish intermediate speed limits. CVC Section 22357 indicates that, "whenever a local authority determines upon the basis of an engineering and traffic survey that a speed greater than 25 miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon any street other than a state highway otherwise subject to a prima facie limit of 25 miles per hour, the local authority may by ordinance determine and declare a prima facie speed limit of 30, 35, 40, 45, 50, 55, or 60 miles per hour or a maximum speed limit of 65 miles per hour, whichever is found most appropriate to facilitate the orderly movement of traffic and is reasonable and safe." The CVC defines an engineering and traffic survey as a survey of highway and traffic conditions in accordance with methods determined by the Department of Transportation for use by state and local authorities (CVC Section 627). This survey shall include the following:

1. Prevailing speeds as determined by traffic engineering measurements.

2. Collision records.

3. Highway, traffic, and roadside conditions that are not readily apparent to the driver.

The City of Farmersville retained 4Creeks to perform an engineering and traffic survey, utilizing the information noted above, for 17 roadway segments within city limits. Figure 1 shows the existing roadway segments surveyed in April 2024 and their corresponding existing posted speed limits.

Objective and Scope
Fundamentals of Realistic Speed Zoning
As with most laws, speed laws depend on the compliance of most of the community's motorists. The best way to maintain public confidence in and compliance with established speed limits is to maintain a uniform procedure and realistic requirements. Asking the public to conform to a speed that parallels their actual behavior produces the best results. When a speed limit is set too low, many drivers will continue to drive at a speed that seems comfortable to them and requires constant enforcement to maintain compliance.

Posting speed limit signs is imperative once a realistic speed is determined. Doing so provides feedback for the driver, letting them know they are driving at a safe and reasonable speed, or it allows fair enforcement of speeding citations. Posted speeds are also used to design other traffic related items such as clear recovery zones, traffic signal timing, striping taper lengths, and placement of advance warning signs and pavement markings.

Locations for Realistic Speed Zones
Speed zones are created to maintain the orderly movement of traffic by increasing driver awareness of a reasonable speed. This may be done within areas of differing traffic volumes, lane configurations, and level of pedestrian and bicycle use. Speed zones may also vary within areas that have on-street parking, numerous driveways, or significant traffic volumes.

The most common speed zone transition is from rural to suburban areas where speeds lessen as you enter business or residential districts.

Speed limit signs should be placed in specific situations to inform drivers and law enforcement of appropriate and reasonable speeds. However, in well-defined areas like business or residential districts, these signs may not always be required. The goal is to encourage most drivers to travel at similar speeds, minimizing conflicts caused by significant differences in speed.

City of Farmersville
Engineering and Traffic Survey 3
Requirements
Basic Speed Law
For all 50 states, speed regulations are based on the principles outlined in the Basic Speed Law (CVC Section 22350):
"No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property."
It is a broad concept that recognizes conditions change and emphasizes each situation requires a unique evaluation. It also places responsibility on the drivers to observe their current conditions and adjust their behavior accordingly.

Maximum Speed Limits
CVC Section 22349 indicates that no person may drive a vehicle upon a highway at a speed greater than 65 MPH. That speed changes to 55 MPH for two-lane, undivided highways. These maximum speeds cannot be exceeded unless signs have been posted for a higher speed.

Prima Facie Speed Limits
When no other speed limits are set, a driver should conform or default to a "prima facie" ("at first appearance") speed limit. The CVC establishes two blanket prima facie speed limits: 1) 15 MPH speed limit in alleyways; at blind, uncontrolled intersections; and at uncontrolled railroad crossings; and 2) 25 MPH speed limit within a business or residential district, where no other speed limits are posted; school zones when children are present; and streets contiguous to senior centers when posted with a standard "SENIOR" warning sign. The conditions for these specific speed zones are depicted in CVC Section 22352.

Intermediate Speed Zones
Local agencies are permitted to establish intermediate speed zones between 25 MPH (or as low as 15 MPH in special circumstances) and 55 MPH based on an engineering and traffic survey. These speed zones must be clearly posted so they are readily apparent to the driver.

City of Farmersville
Engineering and Traffic Survey 4
Study Area and Procedure
Location Selection
The requirement of this engineering and traffic survey was to analyze existing roadway segments within the City of Farmersville to reestablish speed zones or recommend appropriate speeds based on an engineering and traffic survey. Eight different roads were evaluated which were broken into 17 individual segments. The roadways were divided into individual segments to ensure sections with unique characteristics were separately surveyed.

During data collection, it is protocol to choose a location along each segment that will provide a true free-flow speed. Avoided areas included intersections with signals or stop signs, intermediately narrowing segments, segments with frequently used driveways, or any that were affected by emergency or city personnel or law enforcement.

Data Collection
Metro Traffic Data, Inc. collected field data on April 2-4 and then finished the last segment on April 17, 2025. Data for each segment was collected using a radar traffic speed meter. Each of the radar speed surveys was conducted by consultant personnel in accordance with standard traffic engineering practices. Metro Traffic Data collected data of free-flowing traffic from an unmarked and inconspicuously parked vehicle, to ensure that their presence did not sway the results of the data being collected. 4Creeks was then presented with the computer analyzed data forms for all 17 roadway segments.

Data Analysis
The data collection sheets for each roadway segment are in Appendix B. Each form provides information on the location or roadway segment surveyed, the limits of the specific segment, direction of traffic observed, time and day of data collection, latitude and longitude of where the survey was taken, the existing posted speed, and the prevailing speeds (85'h-percentile, 10 MPH pace, and average speed). Each data sheet includes a speed curve shown graphically where the speed percentile is the y-axis and the vehicle speed is the X-axis.

A description of prevailing speeds follows:
85th-percentile speed or critical speed: Speed at or below which 85 percent of the vehicles are observed to travel under free-flowing conditions. The 85th-percentile speed is the primary speed used to establish recommended speed limits subject to additional factors such as collision history, roadway conditions not readily apparent to the driver, City of Farmersville

10 MPH pace speed: 10 MPH increment of observed speeds which contains the greatest number of vehicles. The 85"-percentile speed will typically fall within the upper range of the 10 MPH pace speed
Average speed: Total of the vehicle speeds divided by the number of vehicles surveyed.

Speed limits shall be set as outlined in the CVC, as well as the California Manual on Uniform Traffic Control Devices (CA MUTCD). The CA MUTCD indicates that "When a speed limit is to be posted, it shall be established at the nearest 5 MPH increment of the 85t-percentile speed of free-flowing traffic." A local agency may apply a 5 MPH reduction per the following conditions:
• Option 1: When the nearest 5 MPH increment of the 85th-percentile speed requires rounding down, the posted speed may be reduced by an additional 5 MPH. • Option 2: When the nearest 5 MPH increment of the 85th-percentile speed requires rounding up, then the speed limit may be rounded down to the nearest 5 MPH increment below the 85t-percentile speed.

The CA MUTCD specifies that since an 85th-percentile speed is considered reasonable and prudent in most situations, an engineering and traffic survey shall document the justification for applying the 5 MPH reduction factor.

Per the CA MUTCD and CVC Section 22358.7, a local agency may, by ordinance, declare a prima facie speed limit that is reduced an additional 5 MPH if, after conducting an engineering and traffic survey, they find the determined speed limit is still more than reasonable or safe for either of the following reasons:

The portion of the highway has been designated as a safety corridor. The CA MUTCD defines a safety corridor as a roadway segment within an overall roadway network where the highest number of serious injuries and fatality crashes occur. A local authority shall not deem more than one-fifth of their streets as safety corridors.

2. The portion of the highway is adjacent to any land or facility that generates high concentrations of bicyclists or pedestrians, especially those from vulnerable groups such as children, seniors, people with disabilities, and the unhoused.

Collision Review
The CA MUTCD also indicates an engineering and traffic survey shall include a review of recent collision records. Collision records were obtained from the California Crash Reporting System (CCRS) for the years 2020 - 2024 and are included in Appendix C. Those where speed was determined to be the primary collision factor are highlighted. Figure 2 shows the number of speed-related collisions for each roadway segment, as well as how many of the collisions occur at intersections.

Data Evaluation and Recommendations
To effectively recommend a posted speed limit for each roadway segment, the following data was evaluated: the existing posted speed limit, the observed and measured prevailing vehicle speeds, an inventory of special physical characteristics of the roadway and adjacent development, and a review of the five-year traffic collision history.

The information below is listed in Table 1 as follows:

1. The roadway name.

2. The limits of the speed zone study.

3. Acknowledgement of any special highway, roadside, or traffic conditions not readily apparent to the driver that might justify a reduction in the normally applicable speed zone. (e.g., a safety corridor, an area generating high concentrations of bicyclists and pedestrians, a residential or business district, and a city demographic).

4. The average speed of the observed and measured vehicle speeds.

5. The pace speed of the observed and measured vehicle speeds.

6. The existed posted speed limit.

7. The critical (85t-percentile) speed of the observed and measured vehicle speeds.

8. The nearest 5 MPH increment of the critical speed only.

9. The recommended speed limits, based on assessment of the study findings.

10. The justification used for the recommended speed limit.

Il. The resulting change from the existing posted speed limit.

Of the 17 roadway segments evaluated, there are three segments where a new speed limit will be established. Nine, after their 85t-percentile speed was adjusted, had no change from their existing posted speed limit, and the remaining five are recommended to decrease from their existing posted speed limit. All recommended speed limits for the analyzed roadway segments are shown in Figure 3.

The three roadway segments that did not have an existing posted speed limit were segments 8, 16, and 17.

Five roadway segments were recommended to have the speed limit reduced by 5 MPH from the nearest 5 MPH increment of the 85th- percentile speed per Options 1 or 2 described previously. This adjustment brought the posted speed limits of segments 6, 7, 10, and 12 down by 5 MPH and 10 MPH for segment 11.

Segments: 1, 3, 13, and 15 were recommended to have the speed limit reduced by 5 MPH from the nearest 5 MPH increment of the 85'h-percentile speed per Options 1 or 2, which resulted in no change to the existing posted speed limit.

Segments 2, 4, and 14 had their speed limits reduced by 5 MPH from the nearest 5 MPH increment of the 85th-percentile speed and were recommended for the additional 5 MPH reduction based on a special condition: land use of surrounding areas, presence of bike and pedestrian facilities, and/or the city's demographics, which resulted in no change to the existing posted speed limit.

Segment 9, Ventura Avenue from Walnut Avenue to Petunia Street, shall remain at its existing posted speed limit of 25 MPH based on the prima facie guidelines for a residential district.

DIVISION 11. RULES OF THE ROAD [21000 - 23336]
(Division Il enacted by Stats. 1959, Ch. 3.)
CHAPTER 7. Speed Laws [22348 - 22431]
(Chapter 7 enacted by Stats. 1959, Ch. 3.)
ARTICLE 1. Generally [22348 - 22366]
(Heading of Article 1 amended by Stats. 1959, Ch. 11)
22348.
(a) Notwithstanding subdivision (b) of Section 22351, a person shall not drive a vehicle upon a highway with a speed limit established pursuant to Section 22349 or 22356 at a speed greater than that speed limit.
(b) A person who drives a vehicle upon a highway at a speed greater than 100 miles per hour is guilty of an infraction punishable, as follows:
(1) Upon a first conviction of a violation of this subdivision, by a fine of not to exceed five hundred dollars ($500). The court may also suspend the privilege of the person to operate a motor vehicle for a period not to exceed 30 days pursuant to Section 13200.5:
(2) Upon a conviction under this subdivision of an offense that occurred within three years of a prior offense resulting in a conviction of an offense under this subdivision, by a fine of not to exceed seven hundred fifty dollars ($750). The person's privilege to operate a motor vehicle shall be suspended by the Department of Motor Vehicles pursuant to subdivision (a) of Section 13355.
(3) Upon a conviction under this subdivision of an offense that occurred within five years of two or more prior offenses resulting in convictions of offenses under this subdivision, by a fine of not to exceed one thousand dollars ($1,000). The person's privilege to operate a motor vehicle shall be suspended by the Department of Motor Vehicles pursuant to subdivision (b) of Section 13355.
(c) A vehicle subject to Section 22406 shall be driven in a lane designated pursuant to Section 21655, or if a lane has not been so designated, in the right-hand lane for traffic or as close as practicable to the right-hand edge or curb. When overtaking and passing another vehicle proceeding in the same direction, the driver shall use either the designated lane, the lane to the immediate left of the right-hand lane, or the right-hand lane for traffic as permitted under this code. If, however, specific lane or lanes have not been designated on a divided highway having four or more clearly marked lanes for traffic in one direction, a vehicle may also be driven in the lane to the immediate left of the right-hand lane, unless otherwise prohibited under this code.

This subdivision does not apply to a driver who is preparing for a left- or right-hand turn or who is in the process of entering into or exiting from a highway or to a driver who is required necessarily to drive in a lane other than the right-hand lane to continue on his or her intended route.
(Amended by Stats. 2004, Ch. 300, Sec. 1. Effective January 1, 2005.) 22349.
(a) Except as provided in Section 22356, no person may drive a vehicle upon a highway at a speed greater than 65 miles per hour.
(b) Notwithstanding any other provision of law, no person may drive a vehicle upon a two-lane, undivided highway at a speed greater than 55 miles per hour unless that highway, or portion thereof, has been posted for a higher speed by the Department of Transportation or appropriate local agency upon the basis of an engineering and traffic survey. For purposes of this subdivision, the following apply:
(1) A two-lane, undivided highway is a highway with not more than one through lane of travel in each direction.
(2) Passing lanes may not be considered when determining the number of through lanes. (c) It is the intent of the Legislature that there be reasonable signing on affected two-lane, undivided highways described in subdivision (b) in continuing the 55 miles-per-hour speed limit, including placing signs at county boundaries to the extent possible, and at other appropriate locations.
(Amended by Stats. 1999, Ch. 724, Sec. 41. Effective January 1, 2000.) 22350.

No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property. (Amended by Stats. 1963, Ch. 252.)
22351.
(a) The speed of any vehicle upon a highway not in excess of the limits specified in Section 22352 or established as authorized in this code is lawful unless clearly proved to be in violation of the basic speed law.
(b) The speed of any vehicle upon a highway in excess of the prima facie speed limits in Section 22352 or established as authorized in this code is prima facie unlawful unless the defendant establishes by competent evidence that the speed in excess of said limits did not constitute a violation of the basic speed law at the time, place and under the conditions then existing. (Enacted by Stats. 1959, Ch. 3.)
22352.

The prima facie limits are as follows and shall be applicable unless changed as authorized in this code and, if so changed, only when signs have been erected giving notice thereof:
(a) Fifteen miles per hour:
(1) When traversing a railway grade crossing, if during the last 100 feet of the approach to the crossing the driver does not have a clear and unobstructed view of the crossing and of any traffic on the railway for a distance of 400 feet in both directions along the railway. This subdivision does not apply in the case of any railway grade crossing where a human flagperson is on duty or a clearly visible electrical or mechanical railway crossing signal device is installed but does not then indicate the immediate approach of a railway train or car.
(2) When traversing any intersection of highways if during the last 100 feet of the driver's approach to the intersection the driver does not have a clear and unobstructed view of the intersection and of any traffic upon all of the highways entering the intersection for a distance of 100 feet along all those highways, except at an intersection protected by stop signs or yield right-of-way signs or controlled by official traffic control signals. (3) On any alley.
(b) Twenty-five miles per hour:
(1) On any highway, in any business or residence district unless a different speed is determined by local authority or the Department of Transportation under procedures set forth in this code.
(2) When approaching or passing a school building or the grounds thereof, contiguous to a highway and posted with a standard "SCHOOL" warning sign, while children are going to or leaving the school either during school hours or during the noon recess period. The prima facie limit shall also apply when approaching or passing any school grounds which are not separated from the highway by a fence, gate, or other physical barrier while the grounds are in use by children and the highway is posted with a standard "SCHOOL" warning sign.

For purposes of this subparagraph, standard "SCHOOL" warning signs may be placed at any distance up to 500 feet away from school grounds,
(3) When passing a senior center or other facility primarily used by senior citizens, contiguous to a street other than a state highway and posted with a standard "SENIOR" warning sign. A local authority may erect a sign pursuant to this paragraph when the local agency makes a determination that the proposed signing should be implemented. A local authority may request grant funding from the Active Transportation Program pursuant to Chapter 8 (commencing with Section 2380) of Division 3 of the Streets and Highways Code, or any other grant funding available to it, and use that grant funding to pay for the erection of those signs, or may utilize any other funds available to it to pay for the erection of those signs, including, but not limited to, donations from private sources. (Amended by Stats. 2021, Ch. 690, Sec. 3. (AB 43) Effective January 1, 2022.) 22357.
(a) Whenever a local authority determines upon the basis of an engineering and traffic survey that a speed greater than 25 miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon any street other than a state highway otherwise subject to a prima facie limit of 25 miles per hour, the local authority may by ordinance determine and declare a prima facie speed limit of 30, 35, 40, 45, 50, 55, or 60 miles per hour or a maximum speed limit of 65 miles per hour, whichever is found most appropriate to facilitate the orderly movement of traffic and is reasonable and safe. The declared prima facie or maximum speed limit shall be effective when appropriate signs giving notice thereof are erected upon the street and shall not thereafter be revised except upon the basis of an engineering and traffic survey. This section does not apply to any 25-mile-per-hour prima facie limit which is applicable when passing a school building or the grounds thereof or when passing a senior center or other facility primarily used by senior citizens. (b) This section shall become operative on the date specified in subdivision (c) of Section 22366. (Repealed (in Sec. 28) and added by Stats. 1995, Ch. 766, Sec. 29. Effective January 1, 1996. This section became operative, by its own provisions, on the date described in Section 22366.) 22358.
(a) Whenever a local authority determines upon the basis of an engineering and traffic survey that the limit of 65 miles per hour is more than is reasonable or safe upon any portion of any street other than a state highway where the limit of 65 miles per hour is applicable, the local authority may by ordinance determine and declare a prima facie speed limit of 60, 55, 50, 45, 40, 35, 30, 25,20, or 15 miles per hour, whichever is found most appropriate to facilitate the orderly movement of traffic and is reasonable and safe, which declared prima facie limit shall be effective when appropriate signs giving notice thereof are erected upon the street. (b) This section shall become operative on the date specified in subdivision (c) of Section 22366. (Amended by Stats. 2021, Ch. 690, Sec. 5. (AB 43) Effective January 1, 2022.) 22358.5.

It is the intent of the Legislature that physical conditions such as width, curvature, grade and surface conditions, or any other condition readily apparent to a driver, in the absence of other factors, would not require special downward speed zoning, as the basic rule of section 22350 is sufficient regulation as to such conditions.
(Added by Stats. 1959, Ch. 11)
22358.6.
(a) The Department of Transportation shall, in the next scheduled revision, revise and thereafter maintain the California Manual on Uniform Traffic Control Devices to require the Department of Transportation or a local authority to round speed limits to the nearest five miles per hour of the 85th percentile of the free-flowing traffic.
(b) In cases in which the speed limit needs to be rounded down to the nearest five miles per hour increment of the 85th-percentile speed, the Department of Transportation or a local authority may lower the speed limit by five miles per hour from the nearest five mile per hour increment of the 85th-percentile speed, in compliance with Sections 627 and 22358.5 and the California Manual on Uniform Traffic Control Devices, as it read on March 30, 2021, if the reasons for the lower speed limit are documented in an engineering and traffic survey. The Department of Transportation or a local authority may also take into consideration Sections 22353, 22353.2, 22353.3, 22353.4, and 22353.5, if applicable.
(c) In cases in which the speed limit needs to be rounded up to the nearest five miles per hour increment of the 85th-percentile speed, the Department of Transportation or a local authority may decide to instead round down the speed limit to the lower five miles per hour increment. If the speed limit is rounded down pursuant to this subdivision, the speed limit shall not be reduced any further pursuant to subdivision (b).
(d) In addition to subdivisions (b) and (c), a local authority may additionally lower the speed limit as provided in Section 22358.7.
(e) The total reduction in the speed limit pursuant to subdivisions (a) to (d), inclusive, shall not exceed 12.4 miles per hour from the 85th percentile speed. (f) Notwithstanding subdivisions (a) to (e), inclusive, a local authority may retain the currently adopted speed limit as provided in Section 22358.8 without further reduction, or restore the immediately prior adopted speed limit as provided in Section 22358.8 without further reduction. (Amended by Stats. 2022, Ch. 406, Sec. 2. (AB 1938) Effective January 1, 2023.) 22358.7.
(a) If a local authority, after completing an engineering and traffic survey, finds that the speed limit is still more than is reasonable or safe, the local authority may, by ordinance, determine and declare a prima facie speed limit that has been reduced an additional five miles per hour for either of the following reasons:
(1) The portion of highway has been designated as a safety corridor. A local authority shall not deem more than one-fifth of their streets as safety corridors. (2) The portion of highway is adjacent to any land or facility that generates high concentrations of bicyclists or pedestrians, especially those from vulnerable groups such as children, seniors, persons with disabilities, and the unhoused.
(b)
(1) As used in this section, "safety corridor" shall be defined by the Department of Transportation in the next revision of the California Manual on Uniform Traffic Control Devices. In making this determination, the department shall consider highways that have the highest number of serious injuries and fatalities based on collision data that may be derived from, but not limited to, the Statewide Integrated Traffic Records System. (2) The Department of Transportation shall, in the next revision of the California Manual on Uniform Traffic Control Devices, determine what constitutes land or facilities that generate high concentrations of bicyclists and pedestrians, as used in paragraph (2) of subdivision (a). In making this determination, the department shall consider density, road use type, and bicycle and pedestrian infrastructure present on a section of highway. (c) A local authority may not lower a speed limit as authorized by this section until June 30, 2024, or until the Judicial Council has developed an online tool for adjudicating infraction violations statewide as specified in Article 7 (commencing with Section 68645) of Chapter 2 of Title 8 of the Government Code, whichever is sooner.
(d) A local authority shall issue only warning citations for violations of exceeding the speed limit by 10 miles per hour or less for the first 30 days that a lower speed limit is in effect as authorized by this section.
(Added by Stats. 2021, Ch. 690, Sec. 7. (AB 43) Effective January 1, 2022.) 22358.8.
(a) If a local authority, after completing an engineering and traffic survey, finds that the speed limit is still more than is reasonable or safe, the local authority may, by ordinance, retain the currently adopted speed limit or restore the immediately prior adopted speed limit if that speed limit was established with an engineering and traffic survey and if a registered engineer has evaluated the section of highway and determined that no additional general purpose lanes have been added to the roadway since completion of the traffic survey that established that speed limit.
(b) This section does not authorize a speed limit to be reduced by any more than five miles per hour from the currently adopted speed limit nor below the immediately prior speed limit. (c) A local authority shall issue only warning citations for violations of exceeding the speed limit by 10 miles per hour or less for the first 30 days that a lower speed limit is in effect as authorized by this section.
(Amended by Stats. 2022, Ch. 406, Sec. 3. (AB 1938) Effective January 1, 2023.) 22358.9.
(a)
(1) Notwithstanding any other law; a local authority may; by ordinance, determine and declare a 25 or 20 miles per hour prima facie speed limit on a highway contiguous to a business activity district when posted with a sign that indicates a speed limit of 25 or 20 miles per hour.
(2) The prima facie limits established under paragraph (1) apply only to highways that meet all of the following conditions:
(A) A maximum of four traffic lanes.
(B) A maximum posted 30 miles per hour prima facie speed limit immediately prior to and after the business activity district, if establishing a 25 miles per hour speed limit. (C) A maximum posted 25 miles per hour prima facie speed limit immediately prior to and after the business activity district, if establishing a 20 miles per hour speed limit. (b) As used in this section, a "business activity district" is that portion of a highway and the property contiguous thereto that includes central or neighborhood downtowns, urban villages, or zoning designations that prioritize commercial land uses at the downtown or neighborhood scale and meets at least three of the following requirements in paragraphs (1) to (4), inclusive:
(1) No less than 50 percent of the contiguous property fronting the highway consists of retail or dining commercial uses, including outdoor dining, that open directly onto sidewalks adjacent to the highway.
(2) Parking, including parallel, diagonal, or perpendicular spaces located alongside the highway.
(3) Traffic control signals or stop signs regulating traffic flow on the highway, located at intervals of no more than 600 feet.
(4) Marked crosswalks not controlled by a traffic control device. (c) A local authority shall not declare a prima facie speed limit under this section on a portion of a highway where the local authority has already lowered the speed limit as permitted under Section 22358.7, has retained the currently adopted speed limit under Section 22358.8, or has restored the immediately prior adopted speed limit under Section 22358.8. (d) A local authority shall issue only warning citations for violations of exceeding the speed limit by 10 miles per hour or less for the first 30 days that a lower speed limit is in effect as authorized by this section.
(Amended by Stats. 2022, Ch. 406, Sec. 4. (AB 1938) Effective January 1, 2023.) 22360.
(a) Whenever a local authority determines upon the basis of an engineering and traffic survey that the limit of 65 miles per hour is more than is reasonable or safe upon any portion of a highway other than a state highway for a distance of not exceeding 2,000 feet in length between districts, either business or residence, the local authority may determine and declare a reasonable and safe prima facie limit thereon lower than 65 miles per hour, but not less than 25 miles per hour, which declared prima facie speed limit shall be effective when appropriate signs giving notice thereof are erected upon the street or highway. (b) This section shall become operative on the date specified in subdivision (c) of Section 22366. (Repealed (in Sec. 32) and added by Stats. 1995, Ch. 766, Sec. 33. Effective January 1, 1996. This section became operative, by its own provisions, on the date described in Section 22366.) DIVISION 17. OFFENSES AND PROSECUTION [40000.1 - 41610] (Division 17 enacted by Stats. 1959, Ch. 3.)
CHAPTER 3. Illegal Evidence [40800 - 40834]
(Chapter 3 enacted by Stats. 1959, Ch. 3.)
ARTICLE 1. Prosecutions Under Code [40800 - 40808]
(Article I enacted by Stats. 1959, Ch. 3.)
40801.

No peace officer or other person shall use a speed trap in arresting, or participating or assisting in the arrest of, any person for any alleged violation of this code nor shall any speed trap be used in securing evidence as to the speed of any vehicle for the purpose of an arrest or prosecution under this code.
(Enacted by Stats. 1959, Ch. 3.)
40802.
(a) A "speed trap" is either of the following:
(1) A particular section of a highway measured as to distance and with boundaries marked, designated, or otherwise determined in order that the speed of a vehicle may be calculated by securing the time it takes the vehicle to travel the known distance. 2) A particular section of a highway with a prima facie speed limit that is provided by this code or by local ordinance under paragraph (1) of subdivision (b) of Section 22352, or established under Section 22354, 22357, 22358, or 22358.3, if that prima facie speed limit is not justified by an engineering and traffic survey conducted within five years prior to the date of the alleged violation, and enforcement of the speed limit involves the use of radar or any other electronic device that measures the speed of moving objects. This paragraph does not apply to a local street, road, school zone, senior zone, business activity district, or speed limit adopted under Section 22358.7 or 22358.8.
(b)
(1) For purposes of this section, a local street or road is one that is functionally classified as "local" on the "California Road System Maps," that are approved by the Federal Highway Administration and maintained by the Department of Transportation. It may also be defined as a "local street or road" if it primarily provides access to abutting residential property and meets the following three conditions:
(A) Roadway width of not more than 40 feet.
(B) Not more than one-half of a mile of uninterrupted length. Interruptions shall include official traffic control signals as defined in Section 445. (C) Not more than one traffic lane in each direction.
(2) For purposes of this section, "school zone" means that area approaching or passing a school building or the grounds thereof that is contiguous to a highway and on which is posted a standard "SCHOOL" warning sign, while children are going to or leaving the school either during school hours or during the noon recess period. "School zone" also includes the area approaching or passing any school grounds that are not separated from the highway by a fence, gate, or other physical barrier while the grounds are in use by children if that highway is posted with a standard "SCHOOL" warning sign. (3) For purposes of this section, "senior zone" means that area approaching or passing a senior center building or other facility primarily used by senior citizens, or the grounds thereof that is contiguous to a highway and on which is posted a standard "SENIOR" warning sign, pursuant to Section 22352.
(4) For purposes of this section, "business activity district" means a section of highway described in subdivision (b) of Section 22358.9 in which a standard 25 miles per hour or 20 miles per hour speed limit sign has been posted pursuant to paragraph (1) of subdivision (a) of that section.
(1) When all of the following criteria are met, paragraph (2) of this subdivision shall be applicable and subdivision (a) shall not be applicable:
(A) When radar is used, the arresting officer has successfully completed a radar operator course of not less than 24 hours on the use of police traffic radar, and the course was approved and certified by the Commission on Peace Officer Standards and Training. (B) When laser or any other electronic device is used to measure the speed of moving objects, the arresting officer has successfully completed the training required in subparagraph (A) and an additional training course of not less than two hours approved and certified by the Commission on Peace Officer Standards and Training. (c)
(i) The prosecution proved that the arresting officer complied with subparagraphs (A) and (B) and that an engineering and traffic survey has been conducted in accordance with subparagraph (B) of paragraph (2). The prosecution proved that, prior to the officer issuing the notice to appear, the arresting officer established that the radar, laser, or other electronic device conformed to the requirements of subparagraph (D).
(ii) The prosecution proved the speed of the accused was unsafe for the conditions present at the time of alleged violation unless the citation was for a violation of Section 22349,22356, or 22406.
(D) The radar, laser, or other electronic device used to measure the speed of the accused meets or exceeds the minimal operational standards of the National Highway Traffic Safety Administration, and has been calibrated within the three years prior to the date of the alleged violation by an independent certified laser or radar repair and testing or calibration facility.
(2) A "speed trap" is either of the following
(A) A particular section of a highway measured as to distance and with boundaries marked, designated, or otherwise determined in order that the speed of a vehicle may be calculated by securing the time it takes the vehicle to travel the known distance. (в)
(i) A particular section of a highway or state highway with a prima facie speed limit that is provided by this code or by local ordinance under paragraph (1) of subdivision (b) of Section 22352, or established under Section 22354, 22357, 22358, or 22358.3, if that prima facie speed limit is not justified by an engineering and traffic survey conducted within one of the following time periods, prior to the date of the alleged violation, and enforcement of the speed limit involves the use of radar or any other electronic device that measures the speed of moving objects:
(1) Except as specified in subclause (I), seven years.
(II) If an engineering and traffic survey was conducted more than seven years prior to the date of the alleged violation, and a registered engineer evaluates the section of the highway and determines that no significant changes in roadway or traffic conditions have occurred, including, but not limited to, changes in adjoining property or land use, roadway width, or traffic volume, 14 years.:
(ii) This subparagraph does not apply to a local street, road, or school zone, senior zone, business activity district, or speed limit adopted under Section 22358.7 or 22358.8. (Amended by Stats. 2022, Ch. 406, Sec. 5. (AB 1938) Effective January 1, 2023.) 40803.
(a) No evidence as to the speed of a vehicle upon a highway shall be admitted in any court upon the trial of any person in any prosecution under this code upon a charge involving the speed of a vehicle when the evidence is based upon or obtained from or by the maintenance or use of a speedtrap.
(b) In any prosecution under this code of a charge involving the speed of a vehicle, where enforcement involves the use of radar or other electronic devices which measure the speed of moving objects, the prosecution shall establish, as part of its prima facie case, that the evidence or testimony presented is not based upon a speedtrap as defined in paragraph (2) of subdivision (a) of Section 40802.
(c) When a traffic and engineering survey is required pursuant to paragraph (2) of subdivision (a) of Section 40802, evidence that a traffic and engineering survey has been conducted within five years of the date of the alleged violation or evidence that the offense was committed on a local street or road as defined in paragraph (2) of subdivision (a) of Section 40802 shall constitute a prima facie case that the evidence or testimony is not based upon a speedtrap as defined in paragraph (2) of subdivision (a) of Section 40802.

STAFF REPORT Consent
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: August 25, 2025
DEPARTMENT: Fire Dept.

FROM: Fire Chief Jim Thomas
AGENDA TITLE: Adoption of Resolution No. 2025-043, Declaring Two Fire Department Vehicles as Surplus and Authorizing Their Disposition

ACTION & RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 2025-043, declaring two Fire Department vehicles as surplus and authorizing their disposition in accordance with standard City procedures for surplus property.

BACKGROUND | ANALYSIS
The Farmersville Fire Department has two fire apparatus that have reached the end of their usable life cycle and are no longer being utilized and are ready for disposition.

Property information is as follows:

Squad 83 2008 GMC 5500 VIN: 1GDE5C1998F415232 Miles: 66,859 Truck 83 1991 Ottawa/Beck VIN: 11VVB8642LA000031 Miles: 52,965 The above-mentioned vehicles would require significant electrical components and major upgrades to be suitable for suppression purposes. Squad 83 needs electrical components that are now obsolete in the fire industry, with needed upgrades exceeding $10,000. Truck 83 requires a pump overhaul (over $25,000) and pump panel upgrades, including all new electronics (over $8,000). Based on NFPA standards, staff has concluded that retaining these two apparatuses for frontline suppression is not economically feasible.

Staff recommends that the City Council adopt Resolution 2025-043, declaring the above-referenced vehicles as surplus. Following this designation, the vehicles will be disposed of in accordance with the City's standard surplus property procedures.

FISCAL IMPACT
No negative fiscal impact and potential revenue may be realized from the proceeds of the sale of the surplus vehicles.

Reviewed/Approved: {
RESOLUTION NO. 2025-043

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FARMERSVILLE

DECLARING CERTAIN FIRE DEPARTMENT VEHICLES AS SURPLUS PROPERTY AND

AUTHORIZING THEIR DISPOSITION
WHEREAS, in accordance with the provisions of Government Code Section 37350, the City is permitted to dispose of personal property for the common benefit; and WHEREAS, the City has adopted a system for disposing of surplus personal property that is for the common benefit of the City, and that ensures the City recoups the highest revenues for the property; and
WHEREAS, the City of Farmersville Fire Department has identified two (2) vehicles that have reached the end of their useful service life; and
WHEREAS, these vehicles have been evaluated by staff and found to be no longer useful in front line service due to age and parts replacement factors; and WHEREAS, the vehicles have limited remaining value for continued municipal use and are no longer suitable for fire suppression operations; and WHEREAS, it is in the best interest of the City to declare said vehicles as surplus and proceed with their disposition in accordance with standard City procedures; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Farmersville, California, as follows:

1. The above recitals are true and correct and are incorporated herein by reference.

2. Given the costs associated with maintenance and age of the vehicles set forth below, the following vehicles are hereby declared surplus property:
• Squad 83: 2008 GMC 5500, VIN: 1GDE5C1998F415232, 66,859 miles • Truck 83: 1991 Ottawa/Beck, VIN: 11VVB8642LA000031, 52,965 miles

3. The City Council authorizes City staff to proceed with the disposition of the above-listed surplus vehicles in accordance with applicable City policies and procedures, including sale through a qualified auction service that specializes in municipal surplus equipment.

4. Any proceeds generated from the sale of these surplus vehicles shall be deposited into the appropriate City fund, in accordance with City financial procedures.

PASSED AND ADOPTED by the City Council of the City of Farmersville this 25th day of August, 2025, by the following vote:

The project was originally scheduled for completion in July 2024. However, construction activities extended beyond that date, requiring additional management and inspection services. • Review of submittals, requests for information (RFls), and contractor progress payments • Coordination of unforeseen field issues with City staff • Review of materials testing and compliance with City requirements • Participation in project progress meetings and preparation of meeting documentation • Use of the City's CMIS system to manage project documentation and maintain required records These additional services were necessary to ensure compliance with City standards, contract requirements, and Clean California Grant funding provisions.

FISCAL IMPACT

Consultant Contract Amendment #1 - Extension of RE, Inspection & Survey Services
Dear Steven,
Enclosed is change order breakdown for the additional time spent on the project for the additional RE, Inspection, Labor Compliance & Survey services. As you are aware, during the construction of this project there were many unforeseen issues that arose that added time to the project causing additional time on our end to continue to keep the project moving forward and provide the necessary construction oversight per the funding requirements. The project was originally expected to be completed at the beginning of July 2024. This original completion date was pushed due to errors and omissions on the final plans, scheduling delays associated with SCE and Caltrans coordination for unforeseen repairs that needed to be completed. 4Creeks has completed a final internal audit of the project and compiled a change order that covers the additional time spent on each task of this project. We know the City had a tight budget for this project and did everything we could to keep the additional costs to a minimum while still being able to keep the project moving forward.

Thank you for the opportunity to propose our services to assist you with this project.

Sincerely,
4Creeks, Inc.

AGENDA TITLE: Accept a Notice of Completion for the 198 Gateway Project, with Romanazzi General Engineering of Exeter, CA, and authorize the City Engineer to sign the Notice of Completion, and the City Clerk to file the notice with the County Clerk's Office.

ACTION & RECOMMENDATION
Staff recommends that the City Council accept the Notice of Completion for the Highway 198 Gateway Project, as completed by Romanazzi General Engineering, direct the City Engineer to sign the Notice of Completion, and the City Clerk to file the Notice with the Tulare County Clerk's Office.

BACKGROUND | ANALYSIS
At the City Council meeting of December 11, 2023, the Council awarded a contract for the Farmersville 198 Gateway Project to Romanazzi General Engineering in the amount of $2,600, 101.50, and approved a construction contingency of $260,000 (10%) to be administered by the City Manager for changes during construction. The project, funded through the Clean California Grant, involved extensive improvements to the onand off-ramps at Highway 198. Key features included a landmark welcome sign at the Farmersville Boulevard eastbound exit, designed to enhance the interchange with retaining walls, low-maintenance drought- tolerant landscaping, storm drainage, decorative art panels, and City identification signage.

The work was completed within the project's timeline, with minor adjustments to the schedule and budget due to unforeseen issues such as landscaping availability, power panel delivery, and access points, as well as erosion control in the basin and hillside during periods of rain.

The Highway 198 Gateway Project has reached substantial completion, with all major work components. finished and inspected. Staff recommends filing the Notice of Completion to officially close out the project and release any remaining retention funds due to the contractor.

Base Contract Amount: $2,600,101.50
Change Order Amounts: $266,281.36
Final Contract Amount: $2,874,087.57
Remaining $18,124.29

FISCAL IMPACT
There is no direct fiscal impact associated with the filing of the Notice of Completion. However, filing the notice will allow the City to release retained payments to the contractor, which is consistent with the project's budget and contract terms. The contracted amount is covered by the Clean California Grant.

STAFF REPORT
Action Items
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: August 25, 2025
DEPARTMENT: Fire Dept.

FROM: Jim Thomas, Fire Chief
AGENDA TITLE: Authorization to Donate Surplus Fire Apparatus (Squad 83) to College of the Sequoias Fire Technology Program

ACTION & RECOMMENDATION
Staff recommends that the City Council consider and authorize the fire department to donate fire apparatus known as Squad 83 to the College of the Sequoias (COS) Fire Technology Program for the purposes of firefighter training and education.

BACKGROUND | ANALYSIS
Squad 83 is a 2008 GMC 5500 model cab & chassis (serial #1GDE5C1998F415232) with a Ferrera Fire Apparatus build up for the remainder of the vehicle. This unit has served the City of Farmersville for 16 years in the capacity of a light rescue/pumper. With the department's recent acquisition of upgraded equipment, Squad 83 has been deemed surplus to operational needs. The unit no longer meets the frontline service requirements of the fire dept. but remains mechanically sound and suitable for training purposes.

The COS Fire Technology Program provides essential education and hands-on training for future firefighters throughout the region. COS has formally requested the donation of Squad 83 to enhance their training and provide real-world apparatus experience to students enrolled in the program. Donating Squad 83 to the College of Sequoias will support workforce development, provide fire tech students with practical hands-on training on an actual working fire apparatus, and strengthen the partnership between the City of Farmersville and College of the Sequoias.

The donation will eliminate ongoing costs to the City associated with storage & insurance. In addition, donating Squad 83 to the College of the Sequoias Fire Technology Program provides a beneficial use of a surplus apparatus, supports regional firefighter training, and strengthens educational partnerships without cost to the City. This action will be carried out in accordance with City policies governing the disposition of surplus equipment.

FISCAL IMPACT
There is no direct fiscal impact associated with the donation of Squad 83. However, if the unit were sold on the open market, it is estimated that it could generate between $8,000 and $10,000 in revenue for the City. By donating the apparatus to the College of the Sequoias, the City foregoes this potential revenue in exchange for the public benefit of supporting firefighter training and education, as well as reducing ongoing storage and insurance costs.

FIRE TECHNOLOGY
To: Chief Jim Thomas
From: Nick Branch- Director of Fire & EMS Programs
Subject: In Kind Donation of Fire Apparatus
Dear Chief Thomas and City of Farmerville Administration, On behalf of the College of the Sequoias Fire Technology Program, I am are reaching out to explore an opportunity that could significantly benefit both the College of the Sequoias Fire Academy and the broader community with the donation of a surplus fire apparatus to our training program.

Our program's success is built upon strong partnerships with local agencies like yours. A donation of this nature would not only enhance our training but would also serve as a lasting example of collaboration between fire service agencies and higher education. Our fire academy has funding to provide appropriate staffing and materials for the academy however large purchases like fire apparatus are dependent on local support from our outside partnerships.

Benefits of Donation
Enhanced Training Realism - A donated apparatus would allow our cadets to train with the same tools and equipment they will encounter in the field. This hands-on experience is essential in preparing them for operational readiness upon graduation.

Expanded Training Capacity - An additional engine would increase our ability to run concurrent training evolutions, improve scheduling flexibility, and accommodate the growing number of cadets in our year-round academies.

Community Impact - The Farmersville Fire Department's contribution would directly strengthen the capabilities of the next generation of firefighters who will serve across Tulare County and beyond, many of whom may one day serve alongside your personnel.

Recognition and Legacy - The apparatus will remain clearly marked as a donation to honor your department, ensuring that every training evolution reflects your commitment to advancing the fire service.

I would be happy to discuss logistics, recognition, and any considerations to ensure a smooth and mutually beneficial process. Thank you for considering this opportunity to support firefighter training in our region.

Respectfully,
Nal Bunch

STAFF REPORT
Discussion Items
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: August 25, 2025
DEPARTMENT: City Manager
FROM: Daymon Qualls, City Manager
AGENDA TITLE: Discussion and Consideration of Providing Health Insurance Coverage to Members of the City of Farmersville, City Council

ACTION & RECOMMENDATION
It is recommended that the City Council discuss potential options for providing health insurance coverage to members of the City Council and provide direction to staff on how to proceed BACKGROUND | ANALYSIS
At the request of the Mayor, this item has been placed on the agenda to initiate a policy discussion regarding whether City Council members should be offered access to health insurance coverage similar to those available to full-time City employees.

The Mayor has expressed interest in this discussion as a way to potentially attract and retain qualified candidates for future City Council elections. Serving as a Council member requires a significant time commitment and responsibility, and the Mayor has suggested that offering health insurance coverage could help remove barriers for community members who might otherwise be unable to serve due to personal or family healthcare needs.

Currently, City Council members receive a $300 per month stipend, with no other benefits. The provision of health insurance coverage to elected officials varies by jurisdiction, with some cities extending participation in employee medical plans (at either the City's expense, the member's expense, or a cost-sharing arrangement), while others provide no such benefit.

The City Council may wish to consider the following options for medical benefit coverage:

1. No Change - Status Quo
• Council members would not receive health insurance coverage beyond what is currently provided.

2. Full Coverage by the City
• Council members would be eligible to enroll in the City's medical plan, with premiums fully paid by the City

3. Partial City Contribution
• Council members would be eligible to participate in the City's medical plan, with the City covering a portion of the premium and the member responsible for the remainder.

4. Member-Paid Coverage
• Council members could be offered access to the City's medical plan, but all costs would be paid by the individual member.

5. Alternative Benefits / Stipend
• Instead of direct enrollment in the City's medical plan, the Council could consider providing a fixed monthly stipend or reimbursement allowance to offset health care costs.

Considerations:
• Recruitment & Retention: Providing health insurance coverage may encourage broader participation in local government and help attract qualified candidates for upcoming council elections. • Fiscal Impact: Each option carries varying levels of cost to the City's General Fund, depending on the number of members electing coverage and the level of contribution by the City. • Equity and Precedent: Providing benefits to Council members may set a precedent for future policy discussions.
• Public Perception: Offering benefits may be viewed as recognition of the time and commitment of Council service, while others may question the appropriateness of providing benefits to elected officials.

Based on Council's discussion and direction, staff will prepare a follow-up report with detailed cost analyses and, if desired, a resolution or ordinance for formal action.

FISCAL IMPACT
The fiscal impact will vary depending on the option selected by the Council. Based on current premiums under the City's health insurance program, the following general cost ranges may apply:

Employee Only Coverage: approximately $7,500 - $9,500 per year per member • Employee + One Dependent: approximately $14,000 - $17,000 per year per member • Family Coverage: approximately $20,000 - $24,000 per year per member If the City were to cover the full cost of benefits for all five Council members at the family coverage level, the maximum potential annual cost would be in the range of $100,000 - $120,000.

Costs could be reduced if:
• Members opt for lower coverage tiers (employee only vs. family), • The City contributes only a portion of the premium, or • Members are responsible for the full cost but are allowed access to the City's plan.

Staff can return with more precise cost estimates if Council provides direction on preferred options.
