STAFF REPORT
Consent
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: October 13, 2025
DEPARTMENT: City Manager
FROM: Daymon Qualls, City Manager
AGENDA TITLE: Authorization to Establish a 501(c)(3) Nonprofit - "Farmersville Community Cares"

ACTION & RECOMMENDATION
Staff recommends that the City Council authorize the City Manager to take all necessary steps to establish a 501(c)(3) nonprofit organization, tentatively named "Farmersville Community Cares," to accept tax-deductible donations in support of the City's Senior Program and other community initiatives, and authorize the City Manager, or designee to execute any related documents.

BACKGROUND | ANALYSIS
Following SET's notice terminating its contract to operate the City's Senior Center, the City is transitioning to internal operations using staff and volunteers. Community members and local businesses have expressed interest in contributing financially to support the Senior Program.

The City Attorney has reviewed this proposal and confirmed that establishing a 501(c)(3) nonprofit is a viable option. The City Attorney's office has assisted other cities in creating similar nonprofit entities and has outlined the proposed structure and formation process described below.

Proposed Structure & Process:

Leadership: City Manager as CEO, City Clerk as Secretary, Finance Director as CFO • Board: Five members; may include City Council members but not required Meetings: Monthly, optionally concurrent with a regular Council meeting • Formation Steps:

1. File Articles of Incorporation

2. Submit initial Statement of Information to Secretary of State within 90 days of incorporation

3. Obtain EIN from IRS (CEO provides SSN)

4. Apply for federal tax-exempt status via IRS Form 1023 or Form 1023-EZ

5. Apply for state tax-exempt status upon federal approval

FISCAL IMPACT
The estimated costs to establish the 501(c)(3) nonprofit are as follows:
• Filing fees:

Articles of Incorporation with the Secretary of State: $30 Initial Statement of Information: $20
EIN application with the IRS: Free
IRS Form 1023-EZ: $275 (for organizations with gross receipts under $50,000 and total assets under $250,000); if a full Form 1023 is required, the fee is $600 Total estimated filing fees: $325 (or $650 if Form 1023 is required) • Legal fees:

Based on similar projects for other cities, legal support (attorney and paralegal time) is estimated at approximately $2,000 and is outside the scope of the monthly retainer fee paid for City Attorney services.

Staff time and administrative support will also be required for formation and ongoing compliance. Donations received through the nonprofit could offset program costs and support additional City initiatives.

STAFF REPORT

FARMERSVILLE TO: Farmersville City Council
MEETING DATE: October 13, 2025
DEPARTMENT: City Manager
FROM: Daymon Qualls, City Manager
AGENDA TITLE: Introduction of Ordinance No. 529 Amending Special Event Permit Requirements (Chapter 10.68) to Align with Central San Joaquin Valley Risk Management Authority (CSJVRMA) Risk Policies

ACTION & RECOMMENDATION
Staff recommends that the City Council:

1. Introduce for first reading and waive full reading of the ordinance by title only to amend Sections

10.68.020 and 10.68.030 of the Municipal Code to align with CSJVRMA transfer of risk policies and current industry standards; and

2. Schedule the second reading and adoption of the ordinance at the next regular Council meeting.

BACKGROUND | ANALYSIS
The City of Farmersville participates in the Central San Joaquin Valley Risk Management Authority (CSJVRMA), which provides guidance on risk management, insurance coverage, and retained limits for member agencies.

Recent review by staff and risk management consultants identified areas in the Special Event code where updates would better reflect CSJVRMA policies:
• Minimum Insurance Limits: Section 10.68.030 currently lists minimum insurance limits that are lower than CSJVRMA recommendations. Updated limits are recommended to align with industry standards. A broader update is expected in 2026.
• Indemnification Requirement: CSJVRMA now explicitly requires an indemnification, defense, and hold harmless agreement as part of the event application. • Risk Evaluation: CSJVRMA's Risk Matrix and Sedgwick's list of special event activities provide guidance on appropriate insurance limits based on event scope. • These updates are consistent with existing Municipal Code standards for permits under Section

12.04.030, and will ensure that Special Event permits align with these broader City insurance standards while reducing potential liability exposure.

Key recommended updates include:

1. Insurance Limits (10.68.030): Provide minimum limits for special events to match CSJVRMA guidance and industry standards

2. Indemnification (10.68.020, item #13): Require applicants to submit an indemnification, defense, and hold harmless agreement with the event application, ensuring proper risk transfer.

3. Risk Assessment: Use CSJVRMA's Risk Matrix and Sedgwick's Special Event Activity List to guide insurance requirements for different types of events, including those not currently enumerated in the Municipal Code.

First Reading / Introduction:

The proposed ordinance amendments are being presented for first reading and introduction. If introduced by Council, the ordinance will be scheduled for second reading and adoption at a the next regular Council meeting, where Council will have an opportunity to take public comment and formally adopt the updated language into the Municipal Code.

These revisions are administrative updates that:
• Standardize risk management practices across all special events; • Align City policy with CSJVRMA guidelines;
• Maintain the City's legal protections without creating new fiscal obligations.

FISCAL IMPACT
There is no anticipated cost to the City for implementing these updates. Aligning the Special Event permit requirements with CSJVRMA and existing City insurance standards may reduce the City's potential liability exposure and associated costs in the future.

Builders Risk insurance is a form of property insurance to protect against risks such as fire or theft, is needed for new construction, or major renovation projects with multiple trades performing construction work. This coverage may be purchased and provided by a general contractor, construction manager, or the City.
** Installation Floater is a type of property insurance for smaller scopes of work, often performed by a single trade contractor. *** Technology manufacturers and service providers may carry specialized Technology Errors and Omissions coverage in lieu of Cyber Liability. For example, Tech E&O coverage is designed to cover vendors that provide technology services and products such as manufacturers and custom products. Cyber Liability covers users of general technology services and out of the box types of products, with a broader range of coverage.

Risk Analysis - What Coverage is Needed?
Establishing insurance requirements for contract agreements is part of risk control that can save a municipality money and employee hours. It is recommended that clear and precise insurance language is included in the RFP process, to ensure vendors understand the expectations prior to bidding. Some municipalities have bidders sign an acknowledgement to confirm that the bidder can and will comply with the insurance requirements.

Determining adequate insurance coverages and limits is a mechanism of risk management. This guide is intended to assist in establishing requirements that comply with industry, provides reasonable protections to the city, and not impose an undue burden on the vendors. No requirement is absolute, where developing a foundation for various categories should assist in managing the risk control process by transferring the risk to the entity with the most knowledge and in control of the services/work/activities.

Commercial General Liability, Business Automobile Liability and Workers Compensation/Employer's Liability coverages are generally always required. However, based on the scope of work/services, additional (or ancillary) coverages may be required. Below is a risk analysis tool to assist in determining if any ancillary coverages are appropriate for the scope of work/services:

If the answer is yes to any of the questions below, then coverage may be necessary:

Professional Liability:
• Is the vendor a Doctor, Medical Practitioner, Counselor, Therapist, Educator, Attorney, Engineer/Designer or Architect?
• Does the scope of services include Zoning or City Planning? • Is the IT service turnkey in nature?
• Is vendor providing accounting work of a turnkey nature? • Is vendor Consulting (i.e. Giving advice), Training, Educating, and/or Translating? • Is vendor providing Brokerage services?
• Is vendor providing Scientific/Technical, Research/Testing or Inspection services? • Is vendor providing Surveying or Soil Engineering services? • Is vendor a Construction Management service?
Page | 13
Cyber Liability:
• Will vendor be providing or installing out of the box technology software or hardware? • Is the vendor providing services or work that connects to the internet or is operated through the City's network?
• Will the program or application (app) have access, use, process, or store personally identifiable information (PII)?
Technology Errors and Omissions:
• Will vendor be installing technology such as customized or customizable software or hardware?
• Will vendor be providing proprietary software or hardware? • Could the product or service be infiltrated or fail and harm the city? • Can the technology product and services cause financial harm to others? Pollution Liability:
• Is a building or structure being demolished?
• Will vendor be removing lead paint?
• Will vendor be disrupting asbestos?
• Will vendor be hauling or using chemicals or fuel? :
• Is vendor remediating?
• Is vendor using fungicides, herbicides, or pesticides? • Is vendor working underground, drilling, or working near tanks or pipelines? • Is vendor using or hauling caustic or toxic materials? • Is vendor using or working on sewer?
• Is vendor working on storm drains or laterals?
• Is vendor working in or near a body of water?
Builder's Risk or Course of Construction Coverage or Installation Floater:
• Is vendor building, re-building, or renovating property? Page | 14
Property Insurance:
• Is tenant leasing city property or lands?
:
• Is tenant responsible for maintenance, improvements or betterments? • Is tenant responsible for ADA compliance of building? Crime Insurance:
• Will vendor or vendor employees have access to city money? • Will vendor or vendor's employees be investing city funds? • Does vendor generate revenue for the city?

GITY OF Item #: 2

STAFF REPORT
Action Items
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: October 13, 2025
DEPARTMENT: City Manager
FROM: Daymon Qualls, City Manager
AGENDA TITLE: Introduction of Ordinance Amending Special Event Permit Requirements (Chapter

12.22) to Align with Central San Joaquin Valley Risk Management Authority (CSJVRMA) Risk Policies

ACTION & RECOMMENDATION
Staff recommends that the City Council:

1. Introduce for first reading and waive full reading of the ordinance by title only to amend Sections

12.20.030 and 12.22.160 of the Municipal Code to align with CSJVRMA transfer of risk policies and current industry standards; and

• Minimum Insurance Limits: Section 12.22.160 currently lists minimum insurance limits that are lower than CSJVRMA recommendations.
• These updates are consistent with existing Municipal Code standards, and will ensure that Special Event permits align with these broader City insurance standards while reducing potential liability exposure.

Key recommended updates include:

1. Liability Insurance (12.22.160): Update minimum limits for special events to match CSJVRMA guidance and industry standards.

2. Indemnification (12.22.030, item K): Require applicants to submit an indemnification, defense, and hold harmless agreement with the event application, ensuring proper risk transfer.

• Standardize risk management practices across all special events; • Align City policy with CSJVRMA guidelines;

STAFF REPORT Action Items
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: October 13, 2025
DEPARTMENT: City Manager
FROM: Daymon Qualls, City Manager
AGENDA TITLE: Adoption of Resolution 2025-051 Detaching the Fagundes Annexation Territory from Tulare County Service Area (CSA) No. 1

ACTION & RECOMMENDATION
Staff recommends that the City Council adopt Resolution 2025-051 to detach two parcels containing approximately 22 acres from Tulare County Service Area (CSA) No. 1 in order to allow the recently annexed Fagundes Residential Development territory to acquire municipal services from the City of Farmersville.

BACKGROUND | ANALYSIS
The approximately 22-acre Fagundes Residential Development is located on the south side of Walnut Avenue west of Ventura Avenue and east of Road 156 (Mariposa Avenue) and is comprised of a 19.55-acre parcel identified as Assessor Parcel Number (APN) 128-030-036 and a 3.06-acre portion of an abutting parcel identified as APN 128-030-056.

On January 22, 2025, the Farmersville Planning Commission recommended that the City Council approve the Fagundes Residential Development project, which included Mitigated Negative Declaration for environmental review State Clearinghouse (SCH) No. 2024100007], General Plan Amendment 2024-01 to redesignate the subject parcels from Agricultural/Urban Reserve to Medium Density Residential, Zone Change No. 2024-01 to rezone the subject parcels from A-1 (Agricultural) to R-1 (Single Family Residential), and Tentative Subdivision Map No. 2024-01 to create 99 single-family residential lots with one ponding basin and two parks totaling 1.35 acres.

On April 28, 2025, the City Council held the first reading of Ordinance No. 528 for Zone Change No. 2024-01, considered the Fagundes Residential Development project, and continued the Item expressing concern that the project site may be located within a Federal Emergency Management Agency (FEMA) designated Flood Zone and directed staff to explore alternative options for pedestrian crossings and road alignments.

On May 12, 2025, the City Council held the second reading of Ordinance No. 528 for Zone Change No. 2024- 01, adopted the Mitigated Negative Declaration prepared to satisfy California Environmental Quality Act (CEQA) requirements (SCH No. 2024100007), re-considered Tentative Subdivision Map No. 2024-01 in light of staff informing that the project site is not located within a FEMA designated Flood Zone and staff providing options for revised pedestrian crossings and road alignments, and approved Tentative Subdivision Map No. 2024-01 as it was presented to the City Council on April 28, 2025.

On May 21, 2025, the City Council considered a revised Tentative Subdivision Map for the Fagundes Residential Development project with proposed access to Walnut Avenue being aligned with June Avenue to the north of the project site. Staff informed that the revised Tentative Subdivision Map can be found to be in substantial conformance with the Tentative Subdivision Map approved on May 12, 2025, and the City Council found the revised Tentative Subdivision Map to be acceptable.

On September 10, 2025, the Tulare County Local Agency Formation Commission (LAFCo) approved annexation of the Fagundes Residential Development territory into the incorporated City of Farmersville in accordance with regulations contained in Government Code Section 56000 (the Knox-Cortese-Hertzberg Local Government Reorganization Act of 2000).

When the Fagundes Residential Development project was approved on May 12, 2025, the Resolution adopted to memorialize the approval did not address detachment of the project site from Tulare County Service Area (CSA) No. 1. Detachment of the project site from Tulare CSA No. 1 is necessary to allow the Fagundes Residential Development to receive municipal services from the City of Farmersville.

FISCAL IMPACT
There is no fiscal impact associated with this action.

STAFF REPORT
Discussion Items
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: October 13, 2025
DEPARTMENT: City Manager
FROM: Daymon Qualls, City Manager
AGENDA TITLE: Discussion Regarding Councilmember Vacancy and Appointment Process

ACTION & RECOMMENDATION
Staff recommends that the City Council discuss the process for filling the current Councilmember vacancy resulting from the resignation of Councilmember Armando Hinojosa, effective October 7, 2025, and provide direction to staff on the preferred method for appointment or election to fill the unexpired term.

BACKGROUND | ANALYSIS
On October 7, 2025, Councilmember Armando Hinojosa submitted his resignation from the Farmersville City Council, creating a vacancy on the Council. Under California Government Code Section 36512, when a vacancy occurs in an elected city office, the City Council must, within 60 days from the commencement of the vacancy, either:

1. Appoint a qualified individual to fill the vacancy; or

2. Call a special election to fill the vacancy.
armersville Municipal Code section 2.12.020 provides the Council the authority to fill any vacancy on the Council by appointment.

If the Council chooses to appoint, the appointed individual will serve for the remainder of Councilmember Armando Hinojosa's unexpired term. The term expires December 2026. The City Council should discuss and determine the preferred process for filling the vacant seat.

Should the Council decide to appoint a new Councilmember rather than go through a special election, the Council may choose any selection process at their disposal. Options may include:
• Appointing the individual who received the next highest number of votes in the most recent Council election. This approach is commonly used to reflect the will of the voters and is consistent with practices in other California cities; or
• Appointing a qualified resident who meets the eligibility requirements to serve on the Council through an application process.

If the Council votes to appoint a new Councilmember through an application process, the City Clerk shall post a Notice of Vacancy and invite qualified residents who meet the eligibility requirements to apply for the vacant Council seat, and set a deadline for applications to be received. Once applications are received, the City Clerk shall notify applicants as to whether their application is complete. Applicants who submit incomplete applications, or who, when the application is submitted, do not meet the qualifications to hold office in the City of Farmersville will not be eligible to be considered by the Council.

Application:

Applicants must be registered voters of the City of Farmersville, residing within the City limits.

Applicants will be asked to submit a candidate statement with their application consisting of no more than 400 words for the City Council to review.

Applications will be accepted online through the City of Farmersville website. A call for applications will be posted on all of the City's social media platforms and website.

Recommended Applicant Selection Process:

The Council will consider those applicants who have submitted qualifying applications, and interview those qualified individuals.

The Council may accept this process in its entirety, modify the process as it chooses or elect to choose a different process altogether.

If the Council does not make an appointment within 60 days of the vacancy, a special election must be called in accordance with state law.

Next Steps

1. Council provides direction to staff regarding the preferred process for filling the vacancy.

Staff will coordinate with the City Attorney to ensure compliance with all legal requirements.

3. Staff will bring a formal recommendation and supporting documentation back to the Council at the next meeting for consideration and final action.

GITY OR STAFF REPORT Item #: 2
Discussion Items
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: October 13, 2025
DEPARTMENT: Planning
FROM: Josh McDonnell, Contract City Planner
AGENDA TITLE: Presentation of Potential Request to Re-Designate Industrial Property to Residential Property

ACTION & RECOMMENDATION
Staff recommends that the City Council receive a presentation from staff regarding a potential proposal by Smee Homes to re-designate land in north Farmersville from Industrial to Residential and provide feedback.

No specific Council action is requested. Staff requests a discussion and direction from the Council.

BACKGROUND
A potential applicant, Smee Homes is considering submitting potential planning applications for amendments to Farmersville's General Plan, Industrial Specific Plan and Zoning Ordinance. The subject properties are generally located on the south side of Noble Avenue and west of Farmersville Boulevard in Farmersville and are not currently located within the city's boundaries, although they are located immediately adjacent to the City limits and within the Urban Development Boundary. The subject site occupies 67.16 acres contained in three parcels, APNs 128-260-00-4, 128-260-006 and 128-260-010

PROPERTY OVERVIEW
The subject properties are currently designated for Highway Commercial (pink), Industrial (grey), and Agricultural/Urban Reserve (light green) uses, as identified in the exhibit below:

The properties are also located within the boundaries of the Farmersville Industrial Park Specific Plan, which envisions a similar use mix and identifies the circulation network that would be necessary to provide access to the area.

If the applicant were to move forward with applications to pursue the development of a residential project on the subject properties, the following actions would be necessary:

1. Amendment to the Farmersville General Plan, a redesignation of 67 acres from industrial to residential.

2. Amendment to the Farmersville Industrial Specific Plan, a redesignation of 67 acres from industrial to residential.

3. Amendment to the Farmersville Zoning Ordinance, reclassifying 67 acres from the industrial district to the R-1-6 (single family residential, one unit per 6,000 square feet) district.

4. Annexation into the City of Farmersville

5. Tentative subdivision map for single-family residential lots.

ANALYSIS
Given that this City Council agenda item is provided purely as a discussion opportunity for Smee Homes to listen to Council's questions and thoughts regarding the potential project, staff is not making any recommendations, offering support or opposition, or providing in-depth analysis at this time. The following items are offered for Council consideration during their discussion.

General Plan/Zoning Consistency
Currently residential development is not permitted by Farmersville's general plan and zoning ordinance in this area and therefore is the reason for the proposed amendments detailed above. The 67 acres comprising this potential project represents approximately 25 percent of the land designated for industrial development by Farmersville's Industrial Specific Plan. Thus a re-designation of these properties without a corresponding move to designate a similar amount of land for industrial development could potentially hamper the city's ability to attract future employment opportunities.

Circulation/Access
A single access point from a public road exists to the properties, from Noble Avenue, north of the subject site.

The access point is currently unimproved and does not exist as public right of way. Any project proposing greater than 30 units would require at least two access points, the likeliest secondary access point would come from Farmersville Boulevard, which lies approximately a little over ¼ mile to the east of the subject site. Thus, development of the site would require the extension of city standard streets from both the east and north for a considerable distance.

Provision of Services
Sewer, water and other utility lines exist in both Noble Avenue and Farmersville Boulevard. These services would also need to be extended to the subject property, most likely along the to-be-constructed streets stemming from Noble Avenue and Farmerville Boulevard. Further studies would be required to determine whether the City's existing sewer and water infrastructure could accommodate the demand generated by residential development in this specific area. No regional stormwater basins exist or are planned in the area.

COUNCIL OPTIONS
No staff recommendation is provided for this project. Formal applications have not been submitted, nor has any environmental documentation been completed. Staff requests that Council receive the staff presentation and consider whether they would like to ask any questions or provide feedback regarding potential costs or benefits to the City regarding the proposed project.

FISCAL IMPACT
No direct fiscal impact at this stage.
