APPROVAL OF AGENDA
Councilmember Gomez inquired about the Closed Session agenda item titled "Public Employee Performance Evaluation," noting that the positions being evaluated were not identified by title on the agenda. Councilmember Gomez expressed concern that, pursuant to the Brown Act safe harbor provisions, the evaluations may not be considered unless the specific position titles are listed on the agenda.
City Attorney Mike Farley explained that there are different types of public employee performance evaluations that may be discussed in closed session. If the evaluation concerns a specific employee, the employee's position must generally be identified, and in certain cases involving complaints against an employee, the employee is entitled to notice and an opportunity to be present. However, when the discussion relates to the performance of a department or function as a whole, rather than a specific employee, the item may be agendized as a general Public Employee Performance Evaluation. The City Attorney stated that the item on the agenda was intended to be a departmental evaluation rather than an evaluation of a particular employee.
Councilmember Gomez requested that the conversation be reflected in the minutes.
Council Action: It was motioned by Mayor Pro Tem Ochoa, seconded by Mayor Hernandez and approved with a 3-1-1 vote.
