STAFF REPORT
Consent
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: July 27, 2026
DEPARTMENT: City Manager
FROM: Jay Brock, Interim City Manager
AGENDA TITLE: Approval of Independent Contractor Agreement for Phlebotomy Services

ACTION & RECOMMENDATION
Approve the Independent Contractor Agreement between the City of Farmersville and Hanna Souza to provide professional phlebotomy services for the Farmersville Police Department.

BACKGROUND | ANALYSIS
The Farmersville Police Department periodically requires the services of a qualified and licensed phlebotomist to obtain evidentiary blood samples in connection with criminal investigations, including driving under the influence (DUI) cases and other situations authorized by law.

To ensure these services are available when needed, staff has negotiated an Independent Contractor Agreement with Hanna Souza, a licensed phlebotomist, to provide on-call blood draw services. Utilizing an independent contractor allows the City to obtain specialized services on an as-needed basis without creating a permanent staff position.

DISCUSSION
The proposed Independent Contractor Agreement establishes the terms and conditions under which Hanna Souza will provide professional phlebotomy services to the City. The agreement includes provisions related to:
• Scope of services and compensation as identified in Exhibit A. • Independent contractor status.
• Compliance with all applicable federal, state, and local laws. • Required insurance and indemnification.
• Record retention and audit requirements.
• Conflict of interest provisions.

Termination rights and other standard contractual protections for the City.

The proposed agreement is consistent with the City's standard Independent Contractor Agreement and includes provisions that protect the City's interests while ensuring the Police Department has access to qualified phlebotomy services on an as-needed basis. The agreement has also been reviewed and approved by the City Attorney.

FISCAL IMPACT
The City will compensate the contractor in accordance with the rates established in Exhibit A of the agreement.

Services will be utilized on an as-needed basis, and expenditures will be paid from the Police Department's approved budget.

A violation can occur if the public officer, employee or consultant/contractor participates in or influences any CITY decision which has the potential to confer any pecuniary benefit on CONTRACTOR or any business firm in which CONTRACTOR has an interest, with certain narrow exceptions. (b) CONTRACTOR agrees that if any facts come to its attention which raise any questions as to the applicability of conflicts of interest laws, it will immediately inform the CITY designated representative and provide all information needed for resolution of this question.

9. INSURANCE: Prior to approval of this Agreement by CITY, CONTRACTOR shall file with the City Clerk of the City of Farmersville evidence of the required insurance setting forth the following: (a) Certificate of General Liability Insurance with minimum coverage of $1 million/$2 million; and (b) CITY shall be named as an additional insured.

10. INDEMNIFICATION: CONTRACTOR shall hold harmless, defend and indemnify CITY, its agents, officers and employees from and against any liability, claims, actions, costs, damages or losses of any kind, including death or injury to any person and/or damage to property, including CITY property, arising from, or in connection with, the performance by CONTRACTOR or its agents, officers and employees under this Agreement. This indemnification specifically includes any claims which may be made against CITY by any 3 of 8
taxing authority asserting that an employer-employee relationship exists by reason of this Agreement, and any claims made against CITY alleging civil rights violations by CONTRACTOR under Government Code sections 12920 et seq. (California Fair Employment and Housing Act), and any fines or penalties imposed on CITY for CONTRACTOR's failure to provide form DE-542, when applicable. This indemnification obligation shall continue beyond the term of this Agreement as to any acts or omissions occurring under this Agreement or any extension of this Agreement.

11. TERMINATION:
(a) Without Cause: CITY will have the right to terminate this Agreement without cause by giving thirty (30) days prior written notice of intention to terminate pursuant to this provision, specifying the date of termination. CITY will pay to the CONTRACTOR the compensation earned for work performed and not previously paid for to the date of termination. CITY will not pay lost anticipated profits or other economic loss. The payment of such compensation is subject to the restrictions on payment of compensation otherwise provided in this Agreement, and is conditioned upon receipt from CONTRACTOR of any and all plans, specifications and estimates, and other documents prepared by CONTRACTOR in accordance with this Agreement. No sanctions will be imposed.

With Cause: This Agreement may be terminated by either party should the other party:
(1) be adjudged a bankrupt, or
(2) become insolvent or have a receiver appointed, or
(3) make a general assignment for the benefit of creditors, or (4) suffer any judgment which remains unsatisfied for 30 days, and which would substantively impair the ability of the judgment debtor to perform under this Agreement, or
(5) materially breach this Agreement, or
(6) material misrepresentation, either by CONTRACTOR or anyone acting on CONTRACTOR's behalf, as to any matter related in any way to CITY's retention of CONTRACTOR, or
(7) other misconduct or circumstances which, in the sole discretion of the CITY, either impair the ability of CONTRACTOR to competently provide the services under this Agreement, or expose the CITY to an unreasonable risk of liability.

CITY will pay to the CONTRACTOR the compensation earned for work performed and not previously paid for to the effective date of termination. The payment of such compensation is subject to the restrictions on payment of compensation otherwise provided in this Agreement, and is conditioned upon receipt from CONTRACTOR of any and all plans, specifications and estimates, and other documents prepared by CONTRACTOR by the date of termination in accordance with this Agreement. CITY will not pay lost anticipated profits or other economic loss, nor will the CITY pay compensation or make reimbursement to cure a breach arising out of or resulting from such termination. If this Agreement is 4 of 8
terminated and the expense of finishing the CONTRACTOR's scope of work exceeds the unpaid balance of the agreement, the CONTRACTOR must pay the difference to CITY.

Sanctions taken will be possible rejection of future proposals based on specific causes of non performance.
(c) Effects of Termination: Expiration or termination of this Agreement shall not terminate any obligations to indemnify, to maintain and make available any records pertaining to the Agreement, to cooperate with any audit, to be subject to offset, or to make any reports of pre-termination contract activities. Where CONTRACTOR's services have been terminated by the CITY, said termination will not affect any rights of the CITY to recover damages against the CONTRACTOR.
(d) Suspension of Performance: Independent of any right to terminate this Agreement, the authorized representative of CITY for which CONTRACTOR's services are to be performed, may immediately suspend performance by CONTRACTOR, in whole or in part, in response to health, safety or financial emergency, or a failure or refusal by CONTRACTOR to comply with the provisions of this Agreement, until such time as the cause for suspension is resolved, or a notice of termination becomes effective.

12. SUBJECT TO FUNDING: If funding for this Agreement is dependent on any state or federal grant or funds, CITY reserves the right to reduce the level of services to match reduced levels of funding, or at CITY's option, CITY may terminate this Agreement, should the funding source no longer be available or the amount be reduced.

13. SOFTWARE WARRANTY: Ifapplicable, CONSULTANT warrants that any software furnished hereunder, or any software used by it to perform the services to be provided under this Agreement, will be properly licensed and will continue processing accurately for the term of this Agreement and any extension thereof and that the use of said software will not cause incorrect scheduling or reporting or other improper operations or results.

14. FORM DE-542: CONTRACTOR acknowledges that this Agreement is subject to filing obligations pursuant to Unemployment Insurance Code section 1088.8. Accordingly, CITY has an obligation to file a report with the Employment Development Department, which report will include the CONTRACTOR's full name, social security number, address, the date this contract was executed, the total amount of the contract, the contract's expiration date or whether it is ongoing. CONTRACTOR agrees to cooperate with CITY to make such information available and to complete Form DE-542. Failure to provide the required information may, at CITY's option, prevent approval of this Agreement, or be grounds for termination by CITY.

AGENDA TITLE: Consideration of Supporting a Letter to Congressman Jim Costa Regarding Timely Processing of DACA Work Authorization Renewals.

ACTION & RECOMMENDATION
It is recommended that the City Council discuss the matter and, if appropriate, authorize the Mayor to sign a letter expressing the City Council's support for timely processing of Deferred Action for Childhood Arrivals (DACA) work authorization renewals and transmit the letter to Congressman Jim Costa.

BACKGROUND | ANALYSIS
On June 18, 2026, Councilmember Gregorio Gomez prepared and submitted a letter to Congressman Jim Costa expressing concern regarding delays in the processing of Deferred Action for Childhood Arrivals (DACA) work authorization renewals. The letter explains that administrative delays have resulted in some eligible individuals temporarily losing their ability to work despite employers' willingness to retain them. The letter further states that these delays affect employees, their families, local employers, and the community as a whole.

The purpose of this agenda item is to allow the City Council to formally ratify the letter and affirm its support for the concerns expressed therein. Ratification confirms the Council's support for the correspondence and authorizes the letter as an official expression of the City Council's position.

DISCUSSION
The letter requests that Congressman Jim Costa continue advocating for timely processing of DACA work authorization renewals for individuals who remain eligible under the program. It emphasizes that delays in processing can create workforce shortages for employers, financial hardship for families, and negative impacts on the local economy.

By ratifying the letter, the City Council acknowledges and supports the communication that was sent and confirms that it reflects the Council's position regarding the importance of timely processing of employment authorization renewals and the impacts those delays have on the Farmersville community.

FISCAL IMPACT
There is no fiscal impact associated with this action.

ATTACHMENTS

CITY Of

FARMERSVILLE
07/27/2026
The Honorable Jim Costa
U.S. House of Representatives
Dear Congressman Costa,
I am writing to bring to your attention a growing concern affecting families and employers in our community. I have recently learned that some DACA recipients in our area are losing their employment because their work authorization renewals have not been processed in a timely manner, leaving employers unable to continue their employment despite their desire to do so.

These individuals are valued members of our workforce, contributing to local businesses, supporting their families, and strengthening our community. Many have lived in the United States for most of their lives and have built careers, purchased homes, and become deeply invested in the success of our region.

When delays in the renewal process occur, the consequences extend beyond the individual employee. Employers lose trained and experienced workers, families face financial uncertainty, and local economies are negatively impacted. In many cases, these workers have done everything required of them, yet administrative delays place their livelihoods at risk.

I respectfully ask that you continue advocating for policies and administrative solutions that provide timely processing of DACA renewals and prevent unnecessary interruptions in employment for those who remain eligible under the program. Ensuring that qualified individuals can maintain their work authorization without disruption benefits not only the recipients themselves but also the employers and communities that rely on their contributions.

CITY OF

FARMERSVILLE
6/18/2026

Thank you for your service and for your attention to this important issue. I appreciate your efforts on behalf of the residents of the Central Valley and look forward to seeing continued leadership in addressing the challenges facing DACA recipients and their families.

Sincerely,
Councilmember Gregorio Gomez

FARMERSVILLE TO: Farmersville City Council
MEETING DATE: July 27, 2026
DEPARTMENT: City Manager
FROM: Jay Brock, Interim City Manager
AGENDA TITLE: Parent/Caregiver Leadership Program - Meeting Location and Use of City Facilities

ACTION & RECOMMENDATION
It is recommended that the City Council discuss the request from the Child Abuse Prevention Council regarding the use of a City facility for the Parent/Caregiver Leadership Program and provide direction regarding the meeting location, facility use agreement, fees, and insurance requirements.

BACKGROUND | ANALYSIS
The Child Abuse Prevention Council has requested the use of a Senior Center facility to conduct its Parent/Caregiver Leadership Program on Mondays from 4:00 p.m. to 6:00 p.m. The request is for the City Council to consider allowing the organization to use a City-owned facility for these meetings and provide direction regarding the appropriate location and any applicable facility use requirements.

The City Council may direct the City Attorney to prepare a Facility Use Agreement between the City of Farmersville and the Child Abuse Prevention Council, similar to agreements used for other City facilities.

Under this option, the City Council may determine whether rental fees should be waived or reduced.

Regardless of the fee structure, the organization would be required to provide proof of insurance to protect the City against potential liability, including property damage, theft, or personal injury occurring during use of the facility. Since City staff would not be present to open, close, or monitor the facility during meetings, appropriate insurance coverage and agreement terms are recommended.

FISCAL IMPACT
Depending on the direction provided by the City Council, the City may collect rental fees and deposits pursuant to the existing facility rental policy or waive or modify those fees through a Facility Use Agreement. Staff time associated with preparing agreements and coordinating facility use will be minimal.

CITY OF
STAFF REPORT Item #: 1

FARMERSVILLE
Public Hearing
TO: Farmersville City Council
MEETING DATE: July 27, 2026
DEPARTMENT: Public Works
FROM: Jason Watts, City Engineer
AGENDA TITLE: 2026/2027 Landscape and Lighting Assessment Districts RECOMMENDED ACTION:

That the City Council conducts the Public Hearing and adopts Resolution 2026-026 through 2026-038 that accepts the engineer's report and levies the assessments for Farmersville's 2026/2027 Landscape and Lighting Assessment Districts.

BACKGROUND AND DISCUSSION:

The City currently has 13 landscape and lighting districts consisting of 822 individual lots formed as a part of the approval process of various subdivisions for maintaining the surrounding landscaping in each of the subdivisions. The City maintains the turf, shrubs, trees, irrigation systems, lighting (in some districts), and walls (in some districts) on the exterior of the parcels of land which are all located in the public right of way.

Each parcel within each subdivision is assessed an amount equal to their share of the costs for said maintenance. Each fiscal year, the City is required, by the rules for the assessment districts (in accordance with the Landscape and Lighting Act of 1972), to do a cost accounting of the assessments for the upcoming year.

There are several steps in the process to recover the cost of maintenance for these districts. The following is a summary of the steps that have taken or will take place in this process:

1. On May 11, 2026, the City Council adopted Resolution 2026-017 directing the City Engineer to prepare the Engineer's Report and set the Public Hearing for July 27, 2026.

There are currently 13 separate districts in the City consisting of 822 individual lots.

2. The City Engineer prepared the Engineer's Report and incorporated applicable charges for the individual districts.

3. On June 22, 2026, the City Council reviewed the Engineer's Report and adopted Resolution 2026-21 of intent to levy and collect assessments on the Landscape and Lighting Assessment Districts.

4. Advertised a notice in the newspaper on June 25, 2026, for the Public Hearing on July 27, 2026, announcing the annual updates.

5. On July 27, 2026, conduct a Public Hearing and adopt resolutions levying the assessments for each district.
1 6. After the Public Hearing and Council action, the City Clerk will deliver a master list with the assessment to be applied to each applicable parcel to the County Assessor's office.

7. The adjusted assessments will be added to the County's assessment rolls in August and the City would receive from the County the monies from the two normal, semiannual property tax collections (one in December and one in April) to pay the expense of providing the above maintenance activities.

Of the 13 districts, there are five districts for which the recommendation is up to a 3% increase in assessment per the allowable district formation limits (post-Proposition 218). Assessments for eight districts are to remain the same based on the district formation (pre-Proposition 218).

The Engineer's Report was made available for public review after the notice for the Public Hearing was published. It should be noted that no residents posted any comments or offered any testimony in writing regarding the assessments that are proposed.

FISCAL IMPACT:

The assessment districts are self-funded, and costs recovered for the County Assessor cover the actual costs of maintaining the districts. The applicable charges will be included in the 2026/2027 fiscal budget.

CONCLUSION:

It is respectfully recommended that the City Council:
a) Conducts a Public Hearing for July 27, 2026.
b) Adopts Resolutions 2026-026 through 2026-038 that accept the Engineer's Report and levy the assessments for Farmersville's 2026/2027 Landscape and Lighting Assessment Districts.

CITY OF Item #: 1
STAFF REPORT Discussion Items
FARMERSVILLE TO: Farmersville City Council
MEETING DATE: July 27, 2026
DEPARTMENT: City Manager
FROM: Michael L Farley, City Attorney
AGENDA TITLE: Discussion and Direction Regarding Councilmember Attendance at Conferences and Use of City Funds Without Prior Council Authorization

ACTION & RECOMMENDATION
Discuss the current practice regarding Councilmember attendance at conferences, trainings, and meetings tunded by the City, and provide direction to staff regarding whether prior City Council authorization should be required before City funds are used for registration, travel, lodging, meals, or other related expenses.

BACKGROUND | ANALYSIS
Councilmembers periodically attend conferences, training seminars, and professional meetings that provide educational opportunities and support effective governance. These events may include conferences hosted by organizations such as the League of California Cities, Cal Cities, the International Council of Shopping Centers (ICSC), and other governmental or professional associations.

The City currently budgets funds for Council training and travel. However, the City Council may wish to establish or clarify a policy regarding when Council approval is required before City funds are expended for these purposes.

Establishing a formal process for approving conference attendance helps ensure consistency, transparency, and accountability in the expenditure of public funds. Requiring City Council authorization before travel expenses are incurred allows the Council to:
• Ensure travel and training expenditures are consistent with the City's budget and priorities. • Promote transparency regarding the use of public funds. • Provide equal opportunity for all Councilmembers to attend conferences and training events. • Confirm that the conference or training provides a public benefit and is related to the Councilmember's official duties.
• Maintain consistent procedures for approving travel, registration, lodging, meals, and related expenses.

Alternatively, the City Council may determine that certain conferences or annual training events should be pre-approved through the annual budget or by adopting a travel policy that delegates approval under specified circumstances.

FISCAL IMPACT
Any conference, travel, lodging, registration, meal, or related expenses are paid from appropriated funds within the City's adopted budget. Requiring prior authorization would not necessarily increase or decrease expenditures but would establish a process for approving the use of those funds before expenses are incurred.
