Owner, for herself, her heirs, successors and assigns, hereby grants and conveys to the City consistent with the conditions, rights, and obligations set forth below, a non-exclusive public easement (“Easement”) in perpetuity to establish, maintain, replace, repair, and make available for public use a trail or trails, approximately 10 to 15 feet in width, in that location depicted on Exhibit 2 attached hereto and incorporated by reference (the “Easement Area”). Owner and City further agree that, in the event it is impracticable for engineering reasons to construct a trail within the Easement Area, Owner agrees to negotiate with the City in good faith to enlarge the Easement Area as necessary to construct the trail.

The Easement includes the responsibility to (i) install within the Easement Area footbridges, steps, retaining walls, and other structures as necessary to facilitate passage to Russ Park and prevent erosion; (ii) install markers and other signs related to the trail(s) and (iii) construct within the Easement Area a vehicular parking area (and associated facilities, including, without limitation restroom facilities) with an appropriate surface and with ingress and egress from Eugene Street or adjacent property for users of the trail(s). The Easement is intended to provide access, whether directly to or by way of any adjacent parcels, to Russ Park, a public park, for the benefit of users of the park. The Easement shall also include the right of entry by the City of Ferndale, its employees, agents, contractors, successors, and assigns to construct and maintain the trail and otherwise address matters of public health, safety, and welfare.

The parties agree that this Easement is a “public easement” granted to a “public entity” within the meaning of California Government Code §831.4 and will be used for “recreational purposes” within the meaning of California Civil Code §846.

Agenda Item Title: Resolution No. 2025-01 Annual Events and Parades Street Closures Presented By: City Manager
Type of Item: x Action Discussion Information
Action Required: No Action x Voice Vote Roll Call Vote

RECOMMENDATION
Approve Resolution No. 2025-01 Annual Events and Parades Street Closures.

DISCUSSION:

Staff is requesting that the street closures listed in the Resolution and Attachment be exempt from Section 7.05 of the zoning ordinance which requires a use permit for any assemblage of persons and vehicles. Instead, the closures will require a city issued “Parade or Assembly Permit”, as well as an Encroachment Permit either from Cal Trans (for Main Street closure) or from the City (for any other street closure).

The parade and event dates herein are based on the Ferndale events page of the Ferndale Chamber of Commerce. Staff will communicate in writing with parade and event organizers to let them know that they will not need to apply for a Use Permit; however, they will need to apply for Encroachment Permits from Cal Trans for Main Street closures; as well as Encroachment Permits from the City for any other street closures, a Parade or Assembly Permit from the City, and provide the City with required insurance certificates.

CITY MANAGER (December 13, 2024 – January 08, 2025)

• Brett from GHD and I will meet and discuss the Drainage project with Arlington property owners on January 20, at 5:30.   Brett from GHD and I will meet and discuss the Drainage project with Arlington property owners on January 20, at 5:30. Brett from GHD will be at our December meeting to give presentations on both the Drainage project on Arlington and 5thStreet, and the rise of the berm around the wastewater lagoon project. The City of Ferndale's wastewater treatment plant (WWTP) equalization pond, situated on Port Kenyon Road, does not have sufficient capacity to store high flows during abnormally wet winters and is susceptible to flood hazards during high-flow events due to its location within the floodplains of Francis Creek and Salt River. The existing perimeter berm, which protects wastewater ponds, is below the FEMA 100-year base flood elevation and could result in flooding of the WWTP facility and wastewater ponds. In February 2019 and again in January 2024, sustained high inflows to the plant required the city to deploy an inflatable water dam along the top of the pond berm to prevent overflows and discharges of untreated flow to the adjacent wetlands and surface waters. The objective of this Technical Assistance is to explore methods to increase storage capacity and mitigate flooding impacts by examining alternatives to raise the existing berm elevation, thereby providing additional capacity and flood protection. The project team has analyzed the system and worked with WWTP staff to develop three design alternatives consisting of an earthen berm, mechanically stabilized earth retaining wall system, and sheet pile wall system.

• We have met with Senior Resource Center representatives on several issues to smooth out some rental issues and interaction with the kitchen area. • Agromin: Compliance for Calrecycle for year 2024. Although we have a deferment from compliance of organics until 2027, we still need to comply with the amount of compost that our city would need to produce if we were not getting a deferment. To be compliant we have to procure the appropriate amount of compost. We may have a different solution in years to come, but right now our only way to comply is by buying compost. • Emergency Response committee. NEW BUSINESS

7.1. RCEA’s Renewable Energy Vehicle Network (REVNet) – Informational presentation Infrastructure Planning Senior Manager Avcollie described RCEA’s RePower Strategic Plan goals to support electric vehicle adoption and develop transportation electrification infrastructure. On- and off-road transportation produces over 80% of Humboldt County’s greenhouse gas emissions. RCEA works to reduce transportation emissions through RCEAfunded electric bike, electric vehicle (EV) and EV charging equipment rebates, and by developing and maintaining Humboldt County’s largest network of Level-2 public EV charging stations. RCEA’s 29-station network operates at a 99.91% reliability rating from Rio Dell to Trinidad and inland to Willow Creek. The California Energy Commission funded a new group of 10 faster charging stations that are being built at “resilience hubs” such as the Orleans Volunteer Fire Department and the Jerold Phelps Community Hospital in Garberville, and in high-use areas like McKinleyville, Eureka and Fortuna. Staff Manager Avcollie described collaboration with cities, Tribal Transportation Departments, the Schatz Energy Research Center and local and regional transportation groups to coordinate alternative fuel infrastructure planning and to site charging stations. Staff have successfully worked with local agencies to add charging stations to their existing paving projects, significantly reducing EV network development costs. There were no public comments on this item.

STAFF REPORTS

10.1 Interim Executive Director’s Report (Information only) Interim Executive Director Verbeck reported on the airport microgrid’s five successful islanding events and grid reconnection during the previous night’s storm. The solar system’s recharging ability will be challenged during this prolonged atmospheric river event. Staff are working as quickly as possible to finalize Department of Energy Tribal Energy Resilience and Sovereignty agreements by year’s end, a process that normally takes at least four months.

Director Moore-Guynup expressed appreciation for Interim Executive Director Verbeck, Contracts and Grants Manager Lexie Perez and other team members’ contract negotiation work. There were no public comments on this item.

FUTURE AGENDA ITEMS
The directors requested a report on the status of offshore wind energy in Humboldt County.

Staff described vigorous, current port facility development work. Staff described recent RCEA attendance at Blue Lake City Council and Planning Commission meetings about the former Blue Lake biomass plant site. RCEA will be a potential offtaker for any future battery storage projects and needs to align further engagement with RCEA’s goals.

Chair Schaefer adjourned the meeting at 4:18 p.m.
