PROCLAMATION
HONORING OLDER AMERICANS’ MONTH
MAY, 2025
WHEREAS, since 1963, May has been designated as Senior Citizen Month, a time for us to recognize and honor Ferndale’s older adults and their immense influence on every facet of American society; and
WHEREAS, through their wealth of life experience and wisdom, older adults guide our younger generations and carry forward abundant cultural and historic knowledge; and WHEREAS, older Americans improve our communities through intergenerational relationships, community service, civic engagement, and many other activities; and WHEREAS, communities benefit when people of all ages, abilities, and backgrounds have the opportunity to participate and live independently; and WHEREAS, the City of Ferndale, along with the Ferndale Senior Resource Agency, must ensure that older Americans have the resources and support needed to stay involved in the community-reflecting our commitment to inclusivity and connectedness.
NOW, THEREFORE, BE IT RESOLVED that the City Council, of the City of Ferndale, proclaim May 2025 as Older Americans Month. This year’s theme, “Flip the Script on Aging”, focuses on transforming how society perceives, talks about, and approaches aging. It encourages individuals and communities to challenge stereotypes and dispel misconceptions. We call upon all residents to join us in honoring older adults’ contributions, exploring the many opportunities for staying active and engaged as we age, and highlighting the opportunities for purpose, exploration, and connection that come with aging.

_______________________________________________________________ 93 _____________________________________________________________ Meeting Date: May 21, 2025 Agenda Item Number 13.b
Agenda Item Title Resolution 2025-05 adopting a list of projects for fiscal year 2025-26 funded by SB 1: The Road Repair and Accountability Act of 2017 Presented By: City Manager
Type of Item: x Action x Discussion x Information
Action Required: No Action Voice Vote x Roll Call Vote
PROJECT DESCRIPTION: SB1 Grant Funding FY 2025-26 Project List Update STAFF RECOMMENDATION: Receive update, accept public comment, and adopt Resolution 2025-05.
DISCUSSION: The Local Streets and Roads Program (LSRP) was created by Senate Bill (SB) 1 – the Road Repair and Accountability Act of 2017. SB 1 dedicated approximately $1.5 billion per year in new formula revenues apportioned by the State Controller to cities and counties for basic road maintenance, rehabilitation, and critical safety projects on the local streets and roads system.
To be eligible for Local Streets and Roads Program funding from the State Controller’s Office each year, cities and counties must adopt a proposed project list at a regular meeting of their board or council and then submit the list of proposed projects to the California Transportation Commission by July 1st.
Once proposed project lists are reviewed and deemed to be complete, the Commission adopts and sends to the Controller a list of cities and counties eligible to receive funding that fiscal year. After the Controller receives the list of eligible cities and counties, the apportionment process begins for that fiscal year, and funds are disbursed monthly by formula.
In FY 2024-25, the City of Ferndale was estimated to be apportioned $35,197, and has so far received $25,121.18 (through April 22, 2025).1 The anticipated apportionment for FY 2025-26 is $36,574. This estimate is based on California Department of Finance statewide revenue estimates released with the Governor's Proposed FY2025-26 Proposed Budget released January 10, 2025. 2 Four of the previous
proposed and adopted projects have been carried over and are relisted in Section 3 of Resolution No. 2025-05. Projects that have been carried over from prior years will remain eligible for funding should the City move forward with construction. The following two projects had been SB 1/RMRA listed projects for several cycles. The City is able remove these two projects because they were constructed during FY 2024-2025:
• Washington and Berding Street Intersection Improvements • Brown and Berding Street Intersection Improvements

As described, the project is for the repair and resurfacing of the travel lanes of the specified City roadways. The roadways listed in this project generally correspond with the streets that have a pavement condition index (PCI) of poor or failed as per the 2021/2022 Pavement Management Program Update report, prepared by Nichols Consulting Engineers (NCE) and the City’s 2024 Road Maintenance Priority List. It is noted that inclusion of roadways on either the SB 1/RMRA list of projects and the City’s 2024 Road Maintenance Priority List in no way diminishes the apparent need for road repair in other parts of the city as is identified in the Pavement Management Program Update prepared by NCE.
The five total projects are listed in the attached resolution, along with a brief project description, location, anticipated project schedule, and useful life. This resolution will be submitted to the California Transportation Commission after Council adoption.

Agenda Item Title: Status report on the 2025 Local Responsibility Area (LRA) Fire Hazard Severity Zones (FHSZ) Map for the City of Ferndale
Presented By: City Planner
Type of Item: Action x Discussion x Information
Action Required: x No Action Voice Vote Roll Call Vote
STAFF RECOMMENDATION:
The City Council is requested to receive and file the status report on the 2025 Local Responsibility Area (LRA) Fire Hazard Severity Zones (FHSZ) Map from the Office of the State Fire Marshall for the City of Ferndale.
BACKGROUND and DISCUSSION
This briefing aims to inform the City Council on the recent updates to the fire hazard severity zone (FHSZ) maps.
The fire hazard severity zone maps have been updated to more accurately reflect the zones in California that are susceptible to wildfire. The hazard mapping process incorporates new science in local climate data and improved fire assessment modeling in determining hazard ratings. These updates impact the mapping of fire hazard severity zones in Local Responsibility Areas (LRA).
Local Responsibility Areas (LRA) are incorporated cities, urban regions, agriculture lands, and portions of the desert where the local government is responsible for wildfire protection. In LRA, wildfire protection is typically provided by city fire departments, fire protection districts, counties, and by CAL FIRE under contract. Private and publicly-owned properties (except for federally owned) are designated as Moderate, High, or Very High Fire Hazard Severity Zones. The owners of properties located in a High and Very High FHSZ must comply with fire prevention measures, including defensible space, building codes, and real estate disclosures.
CAL FIRE’s Office of the State Fire Marshall (OSFM) FHSZ maps identify the hazard potential, not the immediate risk. They do not factor in mitigation efforts such as defensible space, fire-resistant construction, or local firefighting capabilities. Hazard is based on physical conditions that create expected fire behavior over a 50-year period without considering short-term modifications, such as:1
• Terrain and topography
• Vegetation and fuel loading conditions
• Fire history and frequency
• Climate and weather patterns
The OSFM-recommended map for Ferndale (Exhibit A) shows properties inside Ferndale City limits and the adjacent unincorporated areas. There are 253 properties within city limits located south of Shaw and Rose avenues, generally, that are in the Moderate FHSZ. Areas of the City that are not in the Moderate FHSZ are mapped as non-wildland (unzoned LRA). The LRA map for Ferndale shows there are no High or Very High Fire Hazard Severity Zones in Ferndale, or in the adjacent unincorporate area.
A FHSZ map for Ferndale is new because before the enactment of Senate Bill 63 (Stern, 2021), only LRA with Very High Severity Zones were required to adopt FHSZ maps. Because Ferndale did not have Very High Severity 1 CAL FIRE, https://www.paperturn-view.com/cal-fire-communications/lra-legislation-factsheet-flipbookcombined?pid=ODg8841799&v=2 , accessed May 9, 2025.

CITY COUNCIL MEETING
_______________________________________________________________ 99 _____________________________________________________________ Zones, the City was not required to adopt FHSZ maps. On February 24, 2025, the OSFM issued the 2025 Recommended LRA FHSZ map for City of Ferndale along with FHSZ maps for the other LRA in Humboldt county.
Although Ferndale does not have High or Very High Fire Hazard Severity Zones, because there are Moderate FHSZ areas within the City, the City must adopt the LRA map to be consistent with the requirements of Senate Bill 63.
Per State law, the City must adopt the OSFM-recommended LRA map by ordinance within 120 days of its release. State law prohibits local agencies from decreasing the FHSZ level recommended by the OSFM, although local agencies at their discretion may add to or increase the recommended FHSZ level. Some properties contain two FHSZ. Where properties contain two FHSZ, some cities are electing to modify the map provided by OSFM by identifying the higher severity zone for those parcels with more than one severity zone to simplify administration and improve clarity to property owners and other interest parties. In this manner, no parcel contains multiple severity zone ratings. Although some properties in Ferndale are located in both the Moderate FHSZ and the unzoned LRA, City staff is not proposing any additions or increases to the OSFM-recommended LRA map for Ferndale because there is no substantial change in requirements between Moderate LRA and unzoned LRA areas according to information from CAL FIRE (see Figure 1 below).
Figure 1
Prior to adopting the applicable LRA map, the local agencies are required to post the locality’s recommended map for public review and comment for at least 30 days. Accordingly, the City posted the OSFM’s recommended May 21, 2025

During the public review period, the City did not receive any comments. Introducing an ordinance to designate the Fire Hazard Severity Zones consistent with the OSFM-recommended map and State law is planned for the City Council’s June 18, 2025 meeting.
CAL FIRE FHSZ Maps and Insurance
California Insurance Commissioner Ricardo Lara has issued a fact sheet explaining that CAL FIRE hazard maps do not affect insurance rates or availability:
2 The CAL FIRE hazard maps are not used for insurance rates or underwriting decisions. According to the Fact Sheet’s response to the question, “How will the updated CAL FIRE maps affect insurance availability and affordability?”:
CAL FIRE’s maps are intended to drive local planning decisions, not insurance decisions.
Under Commissioner Lara’s new regulation, Safer From Wildfires, finalized in October 2022, insurance companies must provide discounts for wildfire safety actions such as community mitigation and home-hardening, which CAL FIRE’s maps do not assess. In addition, insurance companies are already using risk analysis tools and models that go beyond CAL FIRE’s proposed maps in determining what properties they will underwrite.
For many years, insurance companies have been using alternate wildfire risk tools for determining where they will write and renew policies, and how much premium to charge a policyholder, not the Fire Hazard Severity Zones maps. Therefore, a change in designation on the maps for a single homeowner is unlikely to affect their insurance. The reality is that more accurate risk information enables homeowners and communities to reduce their wildfire risks, and Commissioner Lara’s new wildfire mitigation regulation clarifies what actions you should take to reduce wildfire risks. Once that regulation is fully implemented, if a homeowner or business owner takes those risk mitigation actions, they will be able to see a discount in their insurance premium.
CONCLUSION
No formal action is required at this time. Introducing an ordinance to designate the Fire Hazard Severity Zones consistent with the OSFM-recommended map and State law is planned for the City Council’s June 18, 2025 meeting.

RE: SB 346 (Durazo) Local agencies: transient occupancy taxes: short-term rental facilitator.
Notice of SUPPORT (As Amended on March 20, 2025)
To Whom it May Concern,
The City of Ferndale supports SB 346, which would better equip cities to enforce local ordinances related short-term rentals, including the collection and remittance of transient occupancy taxes (TOT).
Short-term rentals are regulated exclusively at the local level via the adoption of an ordinance that often includes regulations on permitting, tax compliance, noise, parking, occupancy, as well as other responsibilities for hosts and short-term rental facilitators. In some instances, ordinances limit the number of short-term rentals allowed to operate lawfully, other ordinances ban short-term rentals entirely.
Short-term rentals can present numerous challenges to neighborhoods and adjacent property owners.
They may create additional noise, traffic, parking, and public safety issues, decrease available housing stock, and in some cases turn residential neighborhoods into de-facto hotel rows, collectively creating additional demands on local public service providers.
Unfortunately, the enforcement of TOT ordinances and the collection and remittance of these taxes from short-term rentals can be inconsistent, even when voluntary collection agreements are in place with a short-term rental facilitator. Cities lack access to property addresses or other property-related information, even under these agreements, resulting in a difficult choice to either accept tax payments without any way to verify their accuracy and legality or attempt to collect taxes directly from property owners—a costly and time-consuming process. Meanwhile, short-term rental facilitators have full knowledge of these properties’ locations and resist disclosing this information. Cities can only compel May 21, 2025

CITY COUNCIL MEETING

_____________________________________________________________ short-term rental facilitators to disclose this critical information through certain legal action, such as subpoenas. This is not how oversight of public dollars should work.
SB 346 would address the above issues by providing cities with the assessor parcel number of each short-term rental listed on the facilitator’s website and full audit authority of TOT dollars. These changes would ensure the correct amount of TOT is being collected and remitted and would allow for more efficient enforcement against unlicensed units.
For these reasons, the City of Ferndale supports SB 346.

Jay Parrish

CITY MANAGER (April 11, 2025 – May 12, 2025)
Wastewater Treatment Plant Flood Resilience Project
• This project is funded by a technical assistance grant from the Clean Water State Revolving Fund, through the Office of Water Programs. This is a planning grant and includes a preliminary engineering report, preliminary design, CEQA, permit applications, and construction funding application to increase the elevation of the berm around the surge pond to increase the storage capacity during consecutive rain events and protect the pond from high water levels in the Salt River and Francis Creek. This work will be completed around the end of April and the construction funding application will be submitted to the State Water Board. The State often funds the construction of projects that have gone through their planning grants, but timelines for award of construction funding can vary due to several factors (state budget, need/violations, etc.). The best-case scenario would be for the project to be added to the fundable list in 2026 and award of construction funds in late 2026/early 2027.
Drainage and Water Quality Improvement Project
• This project is funded by a State Water Board Sewer Overflow and Stormwater Reuse Municipal Grant and funds design, permitting and construction of stormwater flow and water quality improvements on Arlington Avenue, 5th Street, and the County parcel north of Van Ness. Environmental permits (Coastal Development Permit from the County of Humboldt and Conditional Waiver for the North Coast Regional Water Quality Control Board). Design is currently being finalized, and the project is anticipated to go out to bid in June. Assuming bids come in within the available grant budget, construction will begin this summer/fall and be completed by October/November.
• Met with Salt River Watershed members and funding representatives regarding ways to promote the project and get it moving again. We are to engage Landowners to help us complete the project.
• We are working with County on a process that may help the Salt River Restoration Project to maintain the watershed in a way that allows us to prepare the watershed each year for the yearly flows in a way that maximizes the stability of the drainage. • PG&E’s Rule 20a project on Francis Street: Last conversation with PG&E representatives was that their engineers are working on the design. This project goes from Ocean Avenue up to the end of Francis Street eliminating lines on poles to those lines underground until it gets to end of street.
• Rescheduling Public Works daily activities and recording them in writing and placing them on a calendar so we all can be in the loop and aware of our progress. • Continue to work with Caltrans to try to get a grant that would redesign the collection system in a way that tries to replace the sewer line that goes under Francis Creek and sends the sewer down Shaw Street and then 5th Street.
• Asking the council to schedule a public meeting to talk about Goals and Priorities so staff can institute programs and plans to achieve the council goals. • Working towards improvements to Russ Park and a trail that uses Eugene Street with a connection to Firemen’s Park and then downtown and Main Street.

_____________________________________________________________ • We finished our part on getting the “Hazard Mitigation Plan last month and are waiting for public comments. On May 30th it will then be sent by the County to the State for approval. It will then go to BOS and council approval of the whole plan. • Numerous meetings and discussions to analyze the possibility of a micro-grid to connect some of our public buildings. This would enable those facilities to have power during outages using alternative energy until power is restored from PG&E. We should have a presentation at the council meeting to talk about how we might be able to go through a grant that can look at our town and our buildings and determine if that would be a project that PG&E would believe was worthy of a study grant that would lead to a larger grant that would supply financing to provide the grid and energy source separate from PG&E. • HMP- Hazardous Mitigation Plan. Michelle from Planwest and I have attended numerous meetings regarding our local plan and are quickly moving toward sending our updated plan to the county for inclusion in our county plan. We are trying to get the county’s plan done sometime around July and sent to the state for approval. We sent Ferndale’s plan in on April 4th.
• Met with Shawn and have gone over the Firemen’s Park replacement of the public bathrooms. We spent time going over the sewer collection lateral and he has relayed some information that should help in what and where we may redesign the lateral in a way that may allow us to hookup the pipe in a shorter distance than we had previously thought possible.
• Emergency Response committee. Fire Department, Schools, Fair Board, Cert, Police department, and City Manager. Monthly meetings. These meetings have been especially important and give each organization input on how we respond to different emergencies and knowledge of how we all can collaborate better by all knowing what each organization is contributing to the overall responses. We will be meeting here at City Hall, and we will have Ryan Derby of the County OES here as a special guest.
• Several conversations with Casey from GRS about touring the town and developing some priority projects on paving improvements. Casey thought as soon as the weather improves, we can organize that tour with the Street and Road committee. Casey responded that he was out of town, but the week of April14th might work for us. • Interaction with Per Capita personnel and the Russ Park Committee chairmen regarding new signs obtained for the Eugene trail and possible Kiosks. • Landscaping of the City Hall to improve the image as a long-term aesthetically pleasing part of our city. Met with volunteers regarding landscaping around City Hall. In concert with a representative of the village Club, the Garden Club and other volunteers we have identified plants that we are going to keep and others that we will take out. Public Works has already removed plants to take out and the committee will meet on May 23rd to take out the rest. We will then design and replace the new plants.
• Met with Susan Diehl regarding the landscaping around the new musical instruments. The number of kids playing with those is truly impressive.

2025 Zoning Amendment Update: City Planner Michelle Nielsen provided a PowerPoint and gave the Commission and Public an overview of proposed zoning ordinance amendments.
Nielsen explained that California law requires the city’s zoning map and ordinance be consistent with the General Plan, especially its Land Use and Housing elements. Nielsen added that the city’s adopted Land Use Element includes changes that are not currently reflected in the Ferndale zoning map or ordinance. Nielsen added that a review of the implementation programs in the adopted housing element also shows there are updates to the zoning regulations that have yet to be completed as well. Nielsen stated that these zoning updates will be advanced in three groups and are scheduled to be completed by March 2026. Nielsen provided a summary of each group.
Nielsen explained that Group A is the first undertaking which will update residential zones and development standards within those zones; updating the Zoning Ordinance for consistency with state law.
Commissioner von Frausing-Borch stated his concerns for adding language for the historic district. Commissioner Rudynski agreed with von Frausing-Borch with the addition of the language. Commissioner Rudynski questioned the use of “C” zoning designation.
Nielsen explained the updates that will need to be done in regard to the housing element programs.
Commissioner Rudynski questioned the adoption of the Mills Act which could give potential historic properties that qualify for a significant tax reduction.

CITY COUNCIL MEETING
_______________________________________________________________ 126
_____________________________________________________________ Executive Director Keller-Heckman informed the board of a syncing issue with the Authority’s cloud server that caused errors with dates in the draft budget, and that all corrections will be made prior to distribution of the budget to the Executive Advisory Committee. The Authority’s IT provider will investigate and resolve the syncing issue.
Executive Director Keller-Heckman presented the 2025-26 budget development calendar, proposing a timeline from initial presentation on April 10, 2025, through the approval stages to its final adoption on July 1, 2025. The key topics for discussion are budget assumptions, the waste management fee, Authority reserves, personnel compensation, the Capital Improvement Plan, and items for which staff seeks board direction.
o Revenue assumptions are based on the Authority receiving an estimated 75,000 total solid waste tons, a slight decrease from the prior fiscal year, primarily attributable to a drop in out of area hauling. Expense assumptions include CPI adjustments for applicable contracts and a proposed 2.8% Cost of Living Adjustment for all staff. Backhaul rates have stabilized at about 20%. o Gross Projected Revenue is $15,110,657 (Line 39), a slight decrease from the prior fiscal year.
o Total Projected Expenditures are $15,110,692 (Line 128), also a slight decrease from the prior fiscal year, with Projected Net Income of $0. o The solid waste portion of the Waste Management Fee structure is comprised of three main components – the Countywide Program Fee (charged to all tons), the HWMA Base Fee (charged to all Humboldt County transfer station tons), and Facility Fees (charged to all Hawthorne Street transfer station tons). o Staff proposes increases of approximately 7% for solid waste fees, 3% for greenwaste fees, and 18% on recycling fees (pending cost analysis). o Authority reserves are comprised of the undesignated Operating Reserve, the Capital Improvement Reserve, the Rate Stabilization Reserve, and the Employee Health and Benefits Reserve. The Operating Reserve requires a minimal increase of $14,392 in Fiscal Year 2025-26, while the Capital Improvement Reserve requires an increase of $274,757 to meet funding requirements. The latter two reserves are fully funded for Fiscal Year 2025-26.
o Staff recommends a 2.8% Cost of Living Adjustment for all staff (CPI-W Annual, 2024), and an increase to the annual Employee Clothing allowance of $200 per employee. The draft budget includes funding for an outside agency to complete a full salary survey in Fiscal Year 2025-26 per this Board’s request. o Staff requests Board direction on the use of the Illegal Disposal and Cleanup Funds, the rising cost of merchant fees, and additional benefits such as a potential employer match to the existing supplemental income program (457).
Chairperson Matthews opened the floor to Board questions on the Fiscal Year 2025-26 Draft Budget.
Director Castellano inquired about the decrease in tonnage and requested clarification about the definition of out of area haulers. Executive Director Keller-Heckman explained that out of area haulers are generally businesses like construction companies that self-haul their solid waste out of the area to facilities such as the Anderson landfill.
Director Castellano asked when the Authority had last conducted a user satisfaction survey. Executive Director Keller-Heckman answered that a survey was conducted in May 21, 2025

_____________________________________________________________ 2018 to gauge the amounts of hard-to-dispose items in their waste. Director Castellano inquired about the Illegal Disposal and Cleanup proposed funding and how to improve fund allocation, and Chairperson Matthews followed up with a question about the current fund level. Executive Director Keller-Heckman responded that while the draft budget proposes the same funding level ($50,250) as the prior fiscal year budget, staff feels that the community and the Authority would benefit from being able to allocate a portion of the funds. With about 50% of the current fiscal year’s funds still available, Executive Director Keller-Heckman encouraged member agencies to contact him for clarification on how to identify cleanups that are aligned with the Illegal Disposal policy and educate their staff on how to access the funds.
Chairperson Matthews asked for a brief definition of AB939, which Executive Director Keller-Heckman explained was the original legislation that sought to improve and regulates how jurisdictions dispose of waste in California. Chairperson Matthews inquired about how the waste management fee structure impacts jurisdictions’ franchise rates. Executive Director Keller-Heckman explained that the Authority’s fees are nested inside the jurisdictions’ franchise rates.
Chairperson Matthews inquired if tariffs could impact the cost of proposed Capital Improvement projects. Executive Director Keller-Heckman answered that tariffs would impact the price of steel, a component of several of the Authority’s approved Capital Improvement projects. The Authority’s utilization of CMAS, the California Multiple Award Schedule, a statewide contract program used by government agencies in California to purchase products and services at pre-negotiated prices, will help offset price volatility. Staff will be monitoring these developments.
Director Castellano asked about the increase in minimum disposal fees at the transfer station. Executive Director Keller-Heckman answered that the minimum disposal fee would rise from $12 to $12.50, and that minimum fee transactions represent about 38% of transfer station traffic. Executive Director Keller-Heckman clarified that these increases have also been provided to the franchise haulers to inform their rate setting process.
Director Castellano inquired if the Authority’s Operating Reserve was invested in an interest-bearing account. Director Schwartz indicated that it was not, and Executive Director Keller-Heckman explained that in prior years, the Authority did not have the liquidity of reserves to segregate these funds from operating capital. Staff now seeks board guidance on the purpose and intent of this reserve to better manage the funds.
Chairperson Matthews asked what kind of direction staff is seeking regarding merchant fees. Executive Director Keller-Heckman explained that staff believes that only larger transactions should incur fees for the customer, and that staff would bring a more detailed proposal to recoup these fees to the Board in May. Chairperson Matthews asked what kind of direction staff is seeking regarding an employer 457 match. Executive Director Keller-Heckman noted that several other jurisdictions offer an employer 457 match because it improves employee recruitment and retention. Director Castellano expressed uncertainty about how an employer 457 match might impact rate payers but requested more information about the policies in place at other local jurisdictions.

_____________________________________________________________ Chairperson Matthews inquired about staffing levels. Executive Director KellerHeckman responded that the current draft budget reflects stable staffing levels, but the Authority will budget for staff increases prior to opening the Organics facility, hopefully in July 2026. Chairperson Matthews requested a status update on the Authority’s CalRecycle grant for organics processing. Executive Director Keller-Heckman responded that the Authority is working with CalRecycle to meet grant deadlines, demonstrate compliance, and adjust the approved proposal in response to the revised timeline for organics collection in county.
Director Wilson asked for more information about the decrease in out of area solid waste and recyclables. Executive Director Keller-Heckman explained that out of area selfhaul has always fluctuated with the economy, but this year’s decrease cannot be explained by economic conditions alone. Staff is investigating the issue to eliminate allocation and reporting errors, but the Authority does not have the reach of an enforcement agency. Executive Director Keller-Heckman further explained that the decrease in recyclable tonnage is related to the recent emergence of CRV centers in every member agency jurisdiction, which decreases the recyclable tonnage in the waste stream at the curbside and the transfer station. Director Ostler asked if recycling rates in Humboldt were the same as in other areas, and Executive Director Keller-Heckman said he could not comment on that issue.
Director Castellano inquired if the Board was providing direction for future approval on the draft budget. Executive Director Keller-Heckman affirmed that only Board direction was sought at this time with a final budget to be presented for Board approval at the May meeting. Director Castellano expressed her support for continued funding and flexibility with the Illegal Disposal and Cleanup fund. Director Scafani asked if nonCRV plastic was being recycled, and Executive Director Keller-Heckman clarified that there is variability in non-CRV recycling based on material type, contamination, and end market options. As such, not all non-CRV plastic can be recycled in all areas, but the HWMA and franchise haulers strive to recycle as much as possible.
Chairperson Matthews opened the floor to public comment regarding the Fiscal Year 2025-26 Draft Budget presentation. No public comment was received.
Chairperson Matthews closed the floor to public comment.
5. Standing Item: Board Member Reports
Director Castellano reported that Executive Director Keller-Heckman would be making a presentation at the second April meeting of the Eureka City Council and thanked him for attending.
6. Standing Item: Executive Director’s Report
Executive Director Keller-Heckman reported that the Authority would be partnering with the City of Eureka and Recology to distribute free compost to the community on April 15, 2025, at 555 Vance Avenue in Samoa from 9:00 am to 2:00 pm. Director Scafani inquired if this event was a mechanism to dispose of excess compost. Executive Director Keller-Heckman clarified that the event was a mechanism to provide free compost to the public. Chairperson Matthews inquired if free compost could made available to community members at the Arcata Farmers Market, and Executive Director May 21, 2025

OLD CCE BUSINESS
6.1. Weighted CCE Voting
Executive Director Burks reported on how state law limits Community Choice Aggregation participation to cities and counties. Prior to RCEA’s formation, member agencies deliberated at length and agreed on partially weighing votes for CCE business items, which is reflected in RCEA’s Joint Powers Agreement. All members are encouraged to participate in CCE business discussion, regardless of whether they can vote on the item. All contracts are brought to the full Board for consideration. Categories of CCE and non-CCE business are outlined in the Board Operating Guidelines. There was Board member support to work toward revising state law to allow Tribal nations to participate fully in Community Choice Energy agency boards. There were no public comments on this item.
M/S: Schaefer, Arroyo: Accept updated and unchanged Community Choice Energy weighted Board vote distribution.
Direct staff to revise the RCEA Board Operating Guidelines to require a full Board, non-CCE business vote for:
1. Setting of overall CCA program objectives,
2. Determining power content targets,
3. Procurement strategy and procedures,
And to allow the Chair to call for a roll call vote in randomized order for CCE business items, at their discretion.
The motion passed with a unanimous vote. Ayes: Arroyo, Jorgensen, Scafani, Schaefer, Tuttle, Wilson. Noes: None. Absent: Bauer, Gerace. Abstain: None. NonVoting: Ramos, Woo.

8.2.Northern Rural Energy Network (NREN) Update Presentation Demand-Side Management Director Kullmann described programs the NREN will offer. Staff requested an additional Demand-Side Management Program Specialist to focus on over-thephone energy assessments and to assist with NREN programs. NREN funds would pay for the position. There was no public comment on this item.
M/S: Arroyo, Jorgensen: Receive an update on the NREN program and approve the addition of a Demand Side Management Program Specialist to the RCEA organizational chart.
The motion passed with a unanimous vote. Ayes: Arroyo, Jorgensen, Ramos, Scafani, Schaefer, Tuttle, Wilson, Woo. Noes: None. Absent: Bauer, Gerace. Abstain: None.
NEW BUSINESS
9.1.Annual Regulatory & Legislative Policy Platform Review and Federal Activity Update Executive Director Burks presented proposed changes to RCEA’s Policy Platform to streamline language and processes, reflect NREN’s establishment, add language regarding Diablo Canyon decommissioning and nuclear waste storage, and to address increased affordability concerns, energy efficiency program funding scrutiny, and changing federal policy. The draft reflects Community Advisory Committee recommendations. The Board discussed adding language to support full Tribal Nation membership and participation in community choice aggregation decision-making. Director Ramos described how the state considers Tribal nations to be public agencies while the CPUC does not, which limits Tribal nations’ grant funding pursuits. Director Ramos did not prioritize lobbying the CPUC to change this definition, but others expressed that adding such policy platform language could be helpful should other Tribal nation councils join RCEA. The Board directed staff to incorporate suggested changes to the 2025 Policy Platform for Board approval at a future meeting. There were no public comments.
9.2. Update on Offshore Wind
Executive Director Burks reported on RCEA’s role in offshore wind development as outlined in RePower Humboldt, the agency’s strategic plan, RCEA’s current engagement, and other potential engagement opportunities based on discussions with involved community entities and staff. The Community Advisory Committee prioritized RCEA’s support of a small-scale offshore wind pilot project similar to the CADEMO Project being developed in state waters off Lompoc, CA.
Board directors supported RCEA involvement in: offshore wind small pilot project development; joint public outreach with organizations such as Cal Poly Humboldt, Cal Poly San Luis Obispo and Oregon State University supporting Humboldt port development; regional electricity transmission planning; developing centralized procurement for locallygenerated offshore wind energy; education and training through partnerships and a learning center; and ensuring local community benefits for locally-sourced energy. Directors requested RCEA messaging on what offshore wind development will mean for customer electricity bills, energy reliability, and what benefits customers will experience. There were no public comments.
