Fisk-Becker also stated that previously public works was given a schedule from the Chamber on when different flags were put up and taken down. Councilman Jorgensen stated his agreeance with Councilwoman Fisk-Becker.

Jorgensen added his concerns that flying the flag consistently may take away from the significance of flying the flag during Memorial Day and Independence Day. Councilman Lund stated the city does have a stake in the game since we own the lampposts. Lund also stated that this should have been worked out by the Chamber and Merchants Association. Mayor Cady stated his appreciation for the American Flag. Cady added that he flies his flag constantly and if another flag is to be flown, it should have a second bracket and be set below the American Flag.

Councilman Ostler stated he had spoken with a majority of the downtown business owners who were in favor of keeping the flags up. Mayor Cady opened public comment. Several members of the public spoke opposing the consistent flying of the flag while a few spoke in favor of flying them.

Resolution 2025-05 Adopting a List of Projects for FY25-26 Funded by SB-1: City Manager Jay Parrish explained that every year the City must send their list of streets that is a priority for repairs. Parrish went over each project on the list and explained the progress. Councilman Lund questioned who makes the list. Parrish stated the list is determined by staff and the streets and roads committee. Parrish also added that a few of these are rolled over from previous years.

Lund questioned 5th & A project. Parrish stated the city received a grant for this project and it is currently in the works. Councilman Jorgensen also questioned the progress of the 5th & A project. Parrish stated he will inquire with the engineer on the progress and when it can be expected to go out to bid. Councilwoman Fisk-Becker questioned the Streets & Roads Committee involvement.

Status Report on the 2025 Local Responsibility Area (LRA) Fire Hazard Severity Zones (FHSZ) Map for the City of Ferndale: City Manager explained the recent updates to the FHSZ maps.

Parrish explained the FHSZ map for Ferndale is new because before the enactment of Senate Bill 63 only LRA with Very High Severity Zones were required to adopt FHSZ maps which Ferndale did not have. Parrish explained that earlier this year, OSFM issued the 2025 Recommended LRA FHSZ map for City of Ferndale along with FHSZ maps for the other LRA in Humboldt county, and although Ferndale does not have High or Very High Fire Hazard Severity Zones, there are Moderate FHSZ areas within the City, the City must adopt the LRA map to be consistent with the new requirements. Parrish added that at the next Council meeting, the council will be presented with an Ordinance adopting the LRA map.

Schedule Meeting to Establish Council Goals/Priorities for Staff: Council and staff discussed the different times and dates potentially available. Council and Staff agreed to June 9, 2025, at 3:45pm.

Correspondence: Councilman Jorgensen stated he was glad to see the letter regarding the vacation rentals.

CITY COUNCIL MEETING
_____________________________________________________________ 37 ______________________________________________________________ Meeting Date: June 18, 2025 Agenda Item Number: 9.d
Agenda Item Title: Resolution 2025-06 Approving Annual Military Equipment Report Presented By: Ron Sligh, Chief of Police
Type of Item: X Action Discussion Information
Action Required: No Action X Voice Vote Roll Call Vote
STAFF RECOMMENDATION:

Staff recommends that the Council consider the Annual Military Equipment Report and adopt Resolution 2025-06.

EXECUTIVE SUMMARY:

On September 30, 2021, Governor Newsom signed into law Assembly Bill 481 (“AB 481”), which among other things, added Chapter 12.8 to Division 7 of Title 1 to the California Government Code providing certain requirements for the funding, acquisition, and use of military equipment, as that term is defined in AB 481, by the Ferndale Police Department.

Principally, AB 481 required the City to adopt a written policy governing the use and acquisition of military equipment (defined below). The policy must address each of the following items:
(1) A description of each type of military equipment, the quantity sought, its capabilities, expected lifespan, and product descriptions from the manufacturer of the military equipment.
(2) The purposes and authorized uses for which the law enforcement agency or the state agency proposes to use each type of military equipment. (3) The fiscal impact of each type of military equipment, including the initial costs of obtaining the equipment and estimated annual costs of maintaining the equipment. (4) The legal and procedural rules that govern each authorized use. (5) The training, including any course required by the Commission on Peace Officer Standards and Training, that must be completed before any officer, agent, or employee of the law enforcement agency or the state agency is allowed to use each specific type of military equipment to ensure the full protection of the public's welfare, safety, civil rights, and civil liberties and full adherence to the military equipment use policy.
(6) The mechanisms to ensure compliance with the military equipment use policy, including which independent persons or entities have oversight authority, and, if applicable, what legally enforceable sanctions are put in place for violations of the policy.

The City Council adopted, by way of Ordinance No. 2022-1, a written policy governing the use and acquisition of military equipment in compliance with AB 481.

Among other requirements, the City’s policy requires that the Chief of Police prepare an Annual Military Equipment Report detailing each of the following:
(1) A summary of how the Military Equipment was used and the purpose of its use. (2) A summary of any complaints or concerns received concerning the Military Equipment.
(3) The results of any internal audits, any information about violations of the Military Equipment Use Policy, and any actions taken in response. (4) The total annual cost for each type of Military Equipment, including acquisition, personnel, training, transportation, maintenance, storage, upgrade, and other ongoing costs, and from what source funds will be provided for the Military Equipment in the calendar year following submission of the annual Military Equipment Report.
(5) The quantity possessed for each type of Military Equipment. (6) If the law enforcement agency intends to acquire additional Military Equipment in the next year, the quantity sought for each type of Military Equipment.

The City’s Policy further requires that the Chief of Police submit the annual Military Equipment Report to the Council, make the report available on the City’s website, and hold a public meeting on the report at which the general public may discuss and ask questions regarding the report and the funding, acquisition, or use of military equipment.

The Council must then consider the report and determine, based on the report, whether each type of Military Equipment identified in the report has complied with the standards for approval set forth in Ordinance No. 2022-01.

The purpose of the Resolution is to make the above-described findings. As set forth in the Resolution, the Chief of Police has complied with the requirements of the Ordinance No. 2022- 01, including that (i) the Chief of Police prepared and submitted his annual report to the Council, (ii) the annual report was posted to the City’s website on May 7, 2025, and (iii) the Chief held a public meeting on June 9, 2025. Furthermore, the annual report, a copy of which is attached to the Resolution, contains the information required by the City’s policy.

Accordingly, staff recommends that the City Council adopt the Resolution.

DISCUSSION
Prepare and vote for adoption of an ordinance prohibiting any person in the City, with exceptions, to sell or attempt to sell, offer, distribute, or provide nitrous oxide to any person. The ordinance would address public health and safety concerns arising from the increasing misuse of nitrous oxide as a recreational drug within the City of Ferndale and Humboldt County. The ordinance would further align with the actions of statewide and neighboring jurisdictions to action against nitrous oxide abuse.

BACKGROUND: HUMBOLDT COUNTY ACTION AGAINST NITROUS OXIDE ABUSE Nitrous oxide is a chemical compound legally used in medical, dental, baking, and industrial applications.

However, abuse of nitrous oxide for recreational intoxication use has increased over the years, particularly among college-aged, high school-aged, and middle school-aged children and young adults. The State of California has provided for regulation against nitrous oxide abuse and sale to minors through adoption of Penal Code sections as of at least 1983. Recently, jurisdictions statewide have prepared and adopted ordinances and regulations in efforts to further combat nitrous oxide abuse. Locally, the County of Humboldt as well as various cities within Humboldt County have prepared and adopted ordinances banning the sale of nitrous oxide within their jurisdictions, with exceptions. The recent ordinances adopted by neighboring jurisdictions act beyond the California penal code by restricting sale of nitrous oxide to adults as well as minors, whereas the Penal Code restricts sale to minors exclusively.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FERNDALE AS FOLLOWS:

SECTION 1. Findings
WHEREAS, nitrous oxide use continues to be an urgent public health challenge; and WHEREAS, medical authorities have linked the recreational use of nitrous oxide to serious health problems, including physical illness, mental illness, injury, and even death; and WHEREAS, nitrous oxide continues to gain popularity at an alarming rate, especially among college-aged, high school-aged, and middle school-aged children; and WHEREAS, nitrous oxide has legitimate purposes, including its use in cooking and cake decorating, and is commonly known to boost performance in automobiles. However, nitrous oxide has found its way to illegitimate purposes as an intoxicating drug; and WHEREAS, the California Penal Code, Section 381b, makes it a misdemeanor for anyone to intentionally inhale or ingest nitrous oxide for the purpose of causing intoxication, and anyone who is so intoxicated is also guilty of a misdemeanor; and WHEREAS, the California Penal Code, Section 381c, makes it a misdemeanor to sell or distribute nitrous oxide to anyone under the age of 18 (unless administered by and for medical or dental purposes by a licensed practitioner); and
WHEREAS, the California Penal Code, Section 381e, requires that anyone dispensing or distributing nitrous oxide must inform the purchaser that it is a violation of state law to knowingly distribute or dispense nitrous oxide to a person who intends to breathe, inhale, or ingest it for the purpose of intoxication; and
WHEREAS, in spite of the state law prohibitions, there are loopholes that allow the distribution of nitrous oxide cartridges in quantities of many hundreds at a time without meaningful oversight, which puts members of the community at risk; and
WHEREAS, eliminating the sale and distribution of nitrous oxide in the City of Ferndale will reduce the number of persons in possession of and who use nitrous oxide as an intoxicating drug and will promote the public health, safety, and welfare; and WHEREAS, the City has the affirmative duty to protect the health, safety, and welfare of all its citizens and takes nitrous oxide abuse seriously.

_____________________________________________________________ 50 ______________________________________________________________ Recreational nitrous oxide (NO or whippets) use is a significant health and wellness concern in many areas of Humboldt County. In the 2021, “Your Thoughts on Substance Use in Humboldt County” survey, young people and community members highlighted that nitrous oxide misuse and litter should be a priority area for Public Health’s substance use prevention work.

throughout Humboldt County from 2024
through 2028.

Duzen River near Alton.

DHHS-Public Health’s Substance Use Prevention team conducted a retail landscape analysis from October 2024 through April 2025 to gain an understanding of where recreational nitrous oxide is being sold in Humboldt.

Public Health and key partners from the Health & Social Policy InstituteCommunities Addressing Nicotine (HASPI-CAN) completed the Eel River Valley (ERV) observations. The work was focused primarily at tobacco and vaping retail outlets, including smoke shops, and was expanded as needed to independent shops (aka fringe stores) that could also be selling nitrous oxide products. DHHS-Public Health and HAPSI-CAN completed 28 visits to retail outlets throughout the ERV, including Ferndale, Fortuna, Rio Dell and Scotia.

More information about the landscape analysis in other regions of Humboldt County can be found in the “Humboldt Bay Region, City of Arcata and City of Eureka” and “Unincorporated Humboldt County and City of Trinidad” Nitrous Oxide (NO) Retail Landscape Analysis reports.

CITY COUNCIL MEETING
_____________________________________________________________ 51 ______________________________________________________________ Nitrous oxide was observed at smoke shops and was not available in plain sight at other retail establishments, with the exception of the store in Ferndale. The Ferndale store had a “Creative Whip” cracker and canister set, as well as replacement canisters on display behind the counter, presumably intended for home-based culinary use. A notable finding from these observations was recreational nitrous oxide products were only observed in plain sight within the City of Fortuna (with the exception of Ferndale’s home store) in the ERV. Anecdotally, community members have shared that residents from other jurisdictions in the ERV travel to the outlets in Fortuna to purchase nitrous oxide products. The majority of the observations were undisclosed. The “located in plain sight” NO observations were only disclosed to a small handful of retailers (roughly 8%) where partners from HASPI-CAN or Public Health staff have established relationships and/or felt safe to have these conversations.

A wide variety of NO products and paraphernalia located in plain sight were found at three smoke shops in Fortuna and one home goods store in Ferndale. This includes cases of “Whip-it” canisters, other canisters, crackers, NO tanks and boxed kits of canisters and crackers. NO brand products including “Whip-It,” “Cream Charger,” “Galaxy Gas,” “Baking Bad,” “Creative Whip” and “Breaking Bad” were found. There is an additional retail outlet in Rio Dell which community members and other retailers have disclosed may be selling nitrous products out of plain sight.

PROJECT SUMMARY
A public hearing for the introduction and first reading of Ordinance 2025-02, an Ordinance Designating Fire Hazard Severity Zones in the City of Ferndale. The Ordinance would designate Fire Hazard Severity Zones as recommended by California Department of Forestry and Fire Protection.

RECOMMENDED COUNCIL ACTION

1. Receive staff presentation and review questions with staff.

2. Open the public hearing.

3. Receive testimony.

4. Close public hearing.

5. Motion to hold first reading of Ordinance 2025-02, read by title only.

6. Roll call vote.

BACKGROUND and DISCUSSION
Local Responsibility Areas (LRA) are incorporated cities, urban regions, agriculture lands, and portions of the desert where the local government is responsible for wildfire protection. Private and publicly-owned properties (except for federally owned) are designated as Moderate, High, or Very High Fire Hazard Severity Zones. The owners of properties located in a High and Very High fire hazard severity zone (FHSZ) must comply with fire prevention measures, including defensible space, building codes, and real estate disclosures.

On February 24, 2025, the CAL FIRE’s Office of the State Fire Marshall (OSFM) issued the 2025 Recommended LRA FHSZ map for City of Ferndale along with FHSZ maps for the other LRA in Humboldt county. Although Ferndale does not have High or Very High Fire Hazard Severity Zones, because there are Moderate FHSZ areas within the City, the City must adopt the LRA map to be consistent with the requirements of Senate Bill 63 (Stern, 2021).

The OSFM FHSZ maps identify the potential hazard, not the immediate risk. The OSFM-recommended map for Ferndale (Exhibit A) shows properties inside Ferndale City limits and the adjacent unincorporated areas. There are 253 properties within city limits located south of Shaw and Rose avenues, generally, that are in the Moderate FHSZ. Areas of the City that are not in the Moderate FHSZ are mapped as non-wildland (unzoned LRA). The LRA map for Ferndale shows there are no High or Very High Fire Hazard Severity Zones in Ferndale, or in the adjacent unincorporate area.

Per State law, the City must adopt the CAL FIRE’s Office of the State Fire Marshall-recommended LRA map by ordinance within 120 days of its release. State law prohibits local agencies from decreasing the FHSZ level recommended by the OSFM.

JUNE 18, 2025
______________________________________________________________

CITY COUNCIL MEETING
_____________________________________________________________ 53 ______________________________________________________________ Prior to adopting the applicable LRA map, the local agencies are required to post the locality’s recommended map for public review and comment for at least 30 days. Accordingly, the City posted the OSFM’s recommended LRA FHSZ map for Ferndale beginning on March 21 and accepted public comments until May 3, 2025. During the public review period, the City did not receive any comments. At the City Council’s May 21, 2025, meeting the City Council received a report on the 2025 Local Responsibility Area (LRA) Fire Hazard Severity Zones (FHSZ) Map and the new requirements. As part of the agenda item, the public was given opportunity to provide comments on Ferndale’s LRA Map and the status report, and no substantive comments or other input was given on the agenda item.

COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) This Ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), and the State CEQA Guidelines. City Planning staff has determined that the adoption and implementation of the Ordinance is exempt from further environmental review as both a ministerial action and under the general rule in California Environmental Quality Act (CEQA) Guidelines Section 15061(b)(3). Adoption of the proposed ordinance is a ministerial action because adoption of the LRA map is required by Government Code Section 51179(a), and ministerial actions are statutorily exempt from CEQA pursuant to Public Resources Code Section 12080(b)(1), and State CEQA Guidelines Section 15002(i). Moreover, pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the project may have a significant effect on the environment. CEQA only applies to projects that have the potential for causing a significant effect on the environment. The adoption of the fire hazard severity zone map is required by law, and not involving a commitment to any specific project that may result in a potentially significant physical impact on the environment, it can be seen with certainty that there is no possibility that the ordinance will have a significant effect on the environment. The City Council concurs in these findings and adopts them as its own. The City Council, therefore, directs that a Notice of Exemption be filed with the County Clerk of the County of Sonoma in accordance with CEQA

3. Adopt Resolution 2025-10 Approving the FY2025-26 Annual CPI Adjustment to Sewer Rates

4. Adopt Resolution 2025-11 Approving the FY2025-26 Fees & Fines Schedule
BACKGROUND:

The City is required to adopt an operating budget for each fiscal year. The City of Ferndale has routinely adopted a single-year budget to meet this requirement.

The Annual Budget for the City of Ferndale FY2025-26 has been presented by the City Manager, Staff, and Finance Committee, and is now being brought before the Council for discussion and approval. The proposed budget provides the same level of service as in prior years with changes in the revenues and expenditures to be offset by General Fund reserves.

Pursuant to California Constitution Article XIII (B) (Proposition 4), public entities are also required to conform to budgetary guidelines set forth in the Gann Initiative. The purpose of Article XIII (B) is to constrain fiscal growth in government by limiting the proceeds of taxes that may be appropriated each year. Each year’s limit may be adjusted for increase in cost of living (California per capita income) and population. For special districts, if the district is located entirely within one county, the county’s population change factor is to be used. The limit may also be changed in the event of a transfer of fiscal responsibility. The California Department of Finance is mandated to provide the requisite price and population change data for local jurisdictions to calculate their appropriations limit. Each year the City Council is required to pass a resolution with the finding that the annual budget for the fiscal year is within the appropriations limit. This resolution must be passed by the end of the calendar year.

In conjunction with the annual budget, a yearly review of sewer rates is required as part of the grant received to ensure the revenue is within certain guidelines. Staff has reviewed the sewer system’s income and expenses and determined that a rate increase is needed this year due to a continuing increase in expenses at the Wastewater Treatment Plant. Some of these major expenses include the continued rise in utilities, internet, liability insurance and maintenance related expenses and repairs. Per Resolution 2020-16, an annual increase can be implemented in accordance with the US Department of Labor Consumer Price Index (CPI) if the CPI is above JUNE 18, 2025

CITY COUNCIL MEETING

2.5%. The CPI for 2024-2025 was calculated at an increase of 2.8%, therefore, allowing the city to implement an annual increase of $25.54 per Equivalent Dwelling Unit (EDU). The new rate will be calculated at $931.56 annually per EDU. This rate increase will result in an estimated $23,000, which will help cover a portion of the increased expenses.

The Fees and Fines Schedule is reviewed at the same time as we consider next year’s budget. A fees & fines increase has not been adopted since 2021. Staff reviewed costs with the city engineer and planner, as well as internally. It is particularly important during these economic times that services are paid for by the individuals receiving them at actual costs. In preparing the Fees and Fines schedule for 2025-26, staff also reviewed the fees of other like-sized cities in the County. Staff determined an increase is necessary at this time. The Fees and Fine schedule is attached to Resolution 2025-11 and includes the proposed changes.

CITY MANAGER (May 13, 2025-June 12, 2025)
Wastewater Treatment Plant Flood Resilience Project
• This project is funded by a technical assistance grant from the Clean Water State Revolving Fund, through the Office of Water Programs. This is a planning grant and includes a preliminary engineering report, preliminary design, CEQA, permit applications, and construction funding application to increase the elevation of the berm around the surge pond to increase the storage capacity during consecutive rain events and protect the pond from high water levels in the Salt River and Francis Creek. This work will be completed around the end of April and the construction funding application will be submitted to the State Water Board. The State often funds the construction of projects that have gone through their planning grants, but timelines for award of construction funding can vary due to several factors (state budget, need/violations, etc.). The best-case scenario would be for the project to be added to the fundable list in 2026 and award of construction funds in late 2026/early 2027.

Brett from GHD will be at our council meeting and give an update on the project.

Drainage and Water Quality Improvement Project
• This project is funded by a State Water Board Sewer Overflow and Stormwater Reuse Municipal Grant and funds design, permitting and construction of stormwater flow and water quality improvements on Arlington Avenue, 5th Street, and the County parcel north of Van Ness. Environmental permits (Coastal Development Permit from the County of Humboldt and Conditional Waiver for the North Coast Regional Water Quality Control Board). Design is currently being finalized, and the project is anticipated to go out to bid in June. Assuming bids come in within the available grant budget, construction will begin this summer/fall and be completed by October/November. The states budget shortfall may cause us to ask that we extend the project so that we can let contractors know that they can do some of the construction this year but have more time next year to finish the project and in that way give them more flexibility.
• Met with Salt River Watershed members and funding representatives regarding ways to promote the project and get it moving again. We are to engage Landowners to help us complete the project. RCD sent a letter asking for Watershed Council to share costs to do some maintenance on the Sediment Management Area. It is the consensus of the watershed council that we do not have enough funds to do that.
• We are working with County on a process that may help the Salt River Restoration Project to maintain the watershed in a way that allows us to prepare the watershed each year for the yearly flows in a way that maximizes the stability of the drainage. We are waiting to meet on this to get more information but are still hopeful we may be able to move toward a Storm water flood zone.
• PG&E’s Rule 20a project on Francis Street: Last conversation with PG&E representatives was that their engineers are working on the design. This project goes from Ocean Avenue up to the end of Francis Street eliminating lines on poles to those lines underground until it gets to end of street. It sounds like we may need to have one line at the end of road to hook in with the Lines on the Wildcat because the ground is not stable enough to put the line underground by the Christmas tree.

CITY COUNCIL MEETING
_____________________________________________________________ 101
______________________________________________________________ • Rescheduling Public Works daily activities and recording them in writing and placing them on a calendar so we all can be in the loop and aware of our progress. We are also developing in conjunction a new job description and wage rates for all of our employees. • Continue to work with Caltrans to try to get a grant that would redesign the collection system in a way that tries to replace the sewer line that goes under Francis Creek and sends the sewer down Shaw Street and then 5th Street.
• Asking the council to schedule a public meeting to talk about Goals and Priorities so staff can institute programs and plans to achieve the council goals. I need to schedule this meeting over again as I was sick and unable to make the meeting. • Working towards improvements to Russ Park and a trail that uses Eugene Street with a connection to Firemen’s Park and then downtown and Main Street. • We finished our part on getting the “Hazard Mitigation Plan a couple of months ago and are waiting for public comments. On May 30th it will then be sent to the State for approval. It will then go to the BOS and council approval of the whole plan. We have a meeting of the Steering Committee on Friday the 13th to go over the next steps and what each entity will need to do.
• Numerous meetings and discussions to analyze the possibility of a micro-grid connecting some of our public buildings. This would enable those facilities to have power during outages using alternative energy until power is restored from PG&E. We should have a presentation at the council meeting to talk about how we might be able to go through a grant that can look at our town and our buildings and determine if that would be a project that PG&E would believe was worthy of a study grant that would lead to a larger grant that would supply financing to provide the grid and energy source separate from PG&E. Our energy representatives will come to our meeting to give an update • Emergency Response committee. Fire Department, Schools, Fair Board, Cert, Police department, and City Manager. Monthly meetings. We talk with all these groups so that we may all be aware of what is on the calendar for the next month. This has been a very successful endeavor to keep the groups and their organizations.
• Several conversations with Casey from GRS about touring the town and developing some priority projects on paving improvements. We have several road projects although, we are still not aware of the cost or how much we will be able to do next year, but the first thing we needed to do was score the different projects and get as much done as we can. Our Engineer thinks we can put the A Street intersection with 5th Street out to bid this month.
• Interaction with Per Capita personnel and the Russ Park Committee chairmen regarding new signs obtained for the Eugene trail and possible Kiosks. I want to encourage RPC to start the new trail on the Eugene trail.
• Landscaping of the City Hall to improve the image as a long-term aesthetically pleasing part of our city. Met with volunteers regarding landscaping around City Hall. In concert with a representative of the village Club, the Garden Club and other volunteers we have identified plants that we are going to keep and others that we will take out. Public Works have already removed plants to take out and the committee will meet on May 23rd to take out the rest. We will then design and replace the new plants.

Fantastic volunteers. We still need to put any plants in with a weed barrier. • Met with Susan Diehl regarding the landscaping around the new musical instruments. The number of kids playing with those is truly impressive. Although we were not able to meet, we agreed to make an area close to the equipment that will watch the children’s playground with wood chips until we finish the ultimate design and know that will be a long on-going project.

______________________________________________________________ merchant fees. Generally, staff consider that merchant fees are a reasonable cost given the benefits of convenience, safety, and accuracy, but staff have observed a small number of customers making very large credit card payments which conveys less benefit to Authority staff and rate payers. Staff recommends that the Board consider revising the Authority’s waste management fee resolution to authorize staff to bill customers for merchant fees when their payments exceed $5,000 in one monthly billing cycle.

Chairperson Matthews opened the floor to Board members questions regarding the proposed merchant fees policy. Director Castellano inquired how many customers would be affected by the revision. Director Schwartz indicated that the policy would impact between 3 and 7 customers based on the past nine months of payment data.

Director Castellano recommended educating customers regarding less costly payment methods such as automated clearing house payments (ACH). Director Schwartz discussed Authority staff efforts to educate customers and limitations of the accounting system. Chairperson Matthews asked how the recommended $5,000 threshold was determined. Director Schwartz responded that the amount was chosen to impact the smallest number of customers while still effecting the largest possible cost savings.

Director Wilson asked the percentage amount of the fees by method. Director Schwartz clarified that credit card payments incur a 3% fee while ACH payments incur a 1% fee, and that the proposed merchant fee policy applies to credit card payment fees only.

Director Wilson observed that ACH payment errors take time to identify, which can lead to failed payments.

Chairperson Matthews inquired how and when the merchant fee policy would be implemented. Executive Director Keller-Heckman indicated that, if approved, the Fiscal Year 25-26 Waste Management Fee Resolution would detail the proposed policy methodology. The policy would be implemented when the new fee resolution takes effect on July 1, 2025, the first day of the upcoming fiscal year.

Chairperson Matthews open the floor to public comment on the proposed merchant fees policy. No public comment was received. Chairperson Matthews closed the floor to public comment.

Motion: Director Wilson motioned, and Director Cady seconded, to approve the merchant fees policy as proposed.

5. Set a Special Meeting for the Purpose of Approving the Annual Budget for Fiscal Year 2025-26.

Executive Director Keller-Heckman explained the two reasons why staff recommends scheduling a Special Meeting at the end of May for the purpose of approving the Annual Budget for Fiscal Year 2025-26. First, the jurisdictions have reported that contract negotiations with their franchise hauler are going well, resulting in staff’s expectation that contracts will be in place for organic waste collection within the next few months and that organics collection could potentially begin in Fiscal Year 2026-27. ______________________________________________________________ information from the jurisdictions, staff was under the impression a contract might not be finalized during Fiscal Year 2025-26 and did not include any significant line-item expenses for the Organics division in the draft budget presented at the April meeting.

Staff is now operating under the assumption that a franchise contract may be finalized and that the Authority will need to be ready should organics waste collection begin in July of 2026.

Second, Executive Director Keller-Heckman announced that the Authority will now be able to move forward with its CalRecycle grant to begin preparing the Hawthorne Street transfer station for organics collection services. Staff recommends a Special Meeting in the latter half of May for the purpose of approving the Annual Budget for the Fiscal Year 2025-26 with the above-described revisions.

Chairperson Matthews inquired as to the number of voting members needed to pass the annual budget. Executive Director Keller-Heckman responded that a super-majority of five (5) affirmative votes was required to pass the annual budget. Board members discussed potential dates and availability and tentatively agreed to schedule a Special Meeting on Wednesday, May 28, 2025, at 4:00 pm.

6. Standing Item: Board Member Reports
Director Madrone conveyed his constituents’ requests for organic waste collection in McKinleyville as well as his appreciation for Humboldt Sanitation’s willingness to accept waste materials from community clean ups. Executive Director Keller-Heckman indicated that following successful franchise negotiations in other parts of the county, staff expect the focus of negotiations to now shift to the north county haulers.

Chairperson Matthews expressed gratitude for the efforts of Authority and jurisdiction staff to support the contract negotiations, and her anticipation of Executive Director Keller-Heckman’s upcoming presentation to the Arcata City Council. Director Castellano thanked Executive Director Keller-Heckman for his presentation to the Eureka City Council in April and for providing planning insights for a group of non-profit organizations with whom she is working on a trash collection project. Chairperson Matthews reminded the group that Oyster Fest, a zero-waste event, will be held on June 15, 2025, in Arcata and volunteers are needed.

6.1.Study Session on Electricity Affordability
Executive Director Burks introduced the study session on electricity affordability by noting how goals such as safety, reliability, clean energy and innovative programs must be balanced with electricity affordability. In Humboldt County almost 30% of households qualify for CARE or FERA low-income bill assistance programs, and in most of the County there is a concentration of households earning $18,100/year or less that spend more than 15% of their wages on electricity bills after paying for housing, water and gas. The number of people who stopped paying their electricity bills is rising. The study session covered what is included in electricity bills and efforts to address rising costs.

When RCEA’s Community Choice Energy (CCE) program began in 2017, transmission and distribution costs were roughly equal to electricity usage costs on an RCEA customer bill.

RCEA’s charges are limited to electricity usage. Transmission and distribution charges can now make up two-thirds of both PG&E and RCEA customers’ bills. Energy supply and related costs have also risen. Every 1% of renewable energy RCEA procures above the state requirement increases power procurement costs by 4%. Staff members described aspects of electricity pricing, including the Power Charge Indifference Adjustment, policy drivers affecting rates, and RCEA's customer programs aimed at helping manage energy costs. The board also discussed solar billing, the CPUC General Rate Case which approves electricity transmission and distribution upgrades, and different utility models including municipallyowned utilities.

Staff asked Board members to direct the community to RCEA’s programs, and inform people of RCEA customer benefits including lower electricity bills. Since RCEA’s CCE program began, Humboldt County RCEA customers together saved roughly $7.3 million on their electricity bills compared to if they had remained PG&E customers. Board directors were also asked to help policy makers understand the larger context of the electricity affordability issue, including grid under-investment and externalized fossil fuel costs. There were no public comments on this item.
