Meeting Date: September 23, 2025 Agenda Item Number 7.a Agenda Item Title: Resolution 2025-22 Approving Dark Light, LLC to Film within the City Limits of Ferndale and Allow Hard Road Closure to Traffic and Parking and Intermittent Sidewalk and Pedestrian Traffic Closures on Main Street
Presented by: City Manager and/or Dark Light, LLC Representatives Type of Item: x Action Discussion Information
Action Required: No Action x Voice Vote Roll Call Vote

RECOMMENDATION

1. Review and Discuss Application presented by Dark Light, LLC for the filming on Main Street. .

2. Review and Discuss Conditions of Approval. Additional Conditions can be made.

3. At the Councils desire, Approve Resolution 2025-22 Authorizing the closure of Main Street between Brown Street and Ocean Avenue for the dates and times requested.

DISCUSSION:

This item was tabled from the September 17th, 2025 Council agenda. The staff of Dark Light LLC were unable to attend the meeting due to a previous engagement. The council asked that Dark Light address some concerns that were brought up during the meeting and when reviewing the filming surveys.

Major concern arose from potential noise from generators that were to be used during quiet hours to power lights. These were addressed with an email stating the special film generators were to be used. Film generators only produce approximately 60 decibels which is comparable to a dishwasher in your home.

Another concern included loss of business from the road closures, especially that of Ivanhoe.

Dark Light has been asked to try to negotiate a reasonable solution with the business owners, particularly Ivanhoe, Ferndale Emporium, and the Hometown Store. Dark Light will update the council at the meeting.

Dark Light has already addressed the issue with the Ferndale Reparatory Theatre. This was a conflict that asked that the road closure not be effective until 8:00pm on Friday, October 17th.

We have updated the road closure to reflect the change.

PREVIOUS DISCUSSION:

As set by Business Ordinance 06-01, all motion pictures require permitting within the City Limits of Ferndale. Permits requiring road closures and multiple days of filming must have council approval. Dark Light LLC has submitted an application that will require multiple days September 23, 2025

of road closures on the 300 block of Main Street (Ocean Avenue to Brown Street) as well as intermittent sidewalk and pedestrian closures (please see map in application packet)..

The City Manager, Police Chief, and Chamber of Commerce have all been in contact with company representatives working through concerns with business disruptions, as well as all residential impacts. A filming survey was created for the residents and businesses giving them the ability to express any concerns they may have. A majority of this film takes place at night.

Much of the film will be shot during “quiet hours” which was especially concerning to staff for the residents on the 300 block of Main Street. Staff instructed Dark Light to reach out to those individuals with the surveys to ensure their direct input. The surveys from businesses and residents were due to the city by September 17, 2025 for the Council to review the results.

Results of the survey will be given orally at the council meeting.

Filming and Main Street Closure of 300 block to Traffic and Parking will be as follows:

1. Tuesday, October 14th 12:30pm – 12:30am (Daytime Shooting)

2. Wednesday, October 15 5:00pm – 5:00am (Night Shooting)

3. Thursday, October 16 6:00pm – 6:00am (Night Shooting)

4. Friday, October 17 8:00pm – 8:00am (Night Shooting)

5. Monday, October 20 2:30pm – 2:30am (Night Shooting)
The Police Chief will not be providing traffic control for the road closures. Dark Light has been asked to contract with a local traffic control outfit that was recommended by the Police Chief..

Permits are being requested from Caltrans. Approval from the Ferndale Police Department and Ferndale Fire Department are also being requested as conditions of approval.

More filming will also take place from October 21 – November 7. This activity will take place inside a private business and a residence.

Dark Light will bring in revenue to the city and local businesses by way of lodging, catering, restaurant usage, and using local services as much as possible.

Staff will obtain all documents and fees pertaining to the application.

FINANCIAL IMPACT:

Unknown at this time.

Dear Ms. Hall:

Attached please find an updated permit application for Motion Picture Production for our upcoming film, Dark Light.

This updated application provides more detail to the application submitted on August 12, and reviewed by the City Council on August 20. An application fee has been sent to your oWice under separate cover.

Enclosed with this application are:

1. Insurance Certificate for the City of Ferndale

2. Proof of Workers Compensation Insurance

3. A schedule of location photography, including a request for street closures on the 300-block of Main Street in Ferndale

4. A map of proposed street closures

5. Location Agreements and Certificates of Insurance for the Valley Grocery at 339 Main Street and a private residence at 718 Berding Street
We have begun discussing the proposed street closures with Police Chief Ronald Sligh and will also submit a separate filming permit request directly with CalTrans for our proposed Main Street shooting days. Chief Sligh has advised us that an outside vendor may be necessary to facilitate traWic management.

We know that filming can be inconvenient to local businesses and residents, so we have begun speaking with the Ferndale Chamber of Commerce members, individual businesses, and particularly businesses and residents along the 300-block of Main Street. At your request, we will ask each business and resident on the block to complete a Filming Survey for the City Council’s review.

We are committed to ensuring as smooth a filming experience as possible with minimal disruptions for the community.

We are happy to answer any questions you or the City Council may have when considering our application.

Best,
Matthew Hsu

Re: Dark Light Filming Permit
Dear City of Ferndale City Council and Interim City Manager Kris Hall, Thank you for considering the independent feature film Dark Light for filming in Ferndale. At the film commission, we understand how exciting and financially beneficial a movie production can be; while also recognizing the potential disruptions it may cause to a community. Our goal is always to ensure the benefits outweigh the challenges.

The team behind Dark Light is a small but experienced group. While they are not backed by a major studio, collectively they bring a wealth of knowledge and problem-solving ability to address any concerns the city might have. The producers are unable to attend tonight’s meeting in person because their first film, Xeno, premiered this week in Los Angeles. The premiere has already received strong reviews:
• Film Threat gave Xeno an 8/10, praising Lulu Wilson’s performance and the alien design by Jim Henson’s Creature Shop, calling it heartfelt and bold. • Blu-ray.com (Brian Orndorf) graded it a B+, noting there is “a lot to like and even love,” especially the Renee–alien relationship.
• Movieguide described it as “a heartfelt, exciting story promoting kindness,” with “masterfully done” effects.

I understand there are concerns about the requests made for filming in Ferndale. The production has shown flexibility and a willingness to collaborate. For example, when they initially asked for daytime parking restrictions to ensure clear streets for night shoots, they realized this was too disruptive and adjusted their request to something more workable for the community. Film production is often about compromise and finding solutions that balance both sides, rather than rigid yes-or-no requests.

12 ________________________________________
I also know some businesses still need more details. For example, Ivanhoe has raised concerns about operations during filming. The production has assured me they are not requesting the closure of the business and, in fact, hope to rent rooms there if available. Their request is simply to close Main Street in front of the building to vehicles during filming, while keeping pedestrian access open between takes. Vehicle traffic would be rerouted to Ocean Street, maintaining full access around the block.

If the Council feels certain concerns must be addressed directly by the producers before filming is approved, and since they are the only ones who can speak to those details, I respectfully suggest the option of pausing tonight’s decision and holding a short follow-up meeting (possibly next week) once the producers return.

Humboldt is facing financial challenges, and productions like Dark Light bring outside dollars to our communities. With thoughtful planning, the city can minimize disruption while benefiting economically. If the film succeeds, it could also bring long-term value through film tourism, as we’ve seen with other productions in the region.

Thank you for your time and consideration. I appreciate all you do for your community. Please don’t hesitate to reach out to my office with any questions.

Best wishes,
Cassandra Hesseltine
Film Commissioner

Meeting Date: September 23, 2025 Agenda Item Number 7.b Agenda Item Title: Resolution No. 2025-23 Authorizing a Street Closure on October 29, 2025 from 4:00pm – 8:00pm for a Block Party Assembly Presented By: City Manager
Type of Item: x Action Discussion Information
Action Required: No Action x Voice Vote Roll Call Vote

RECOMMENDATION
Approve Resolution No. 2023-10 Authorizing a Street Closure for Block Party Assembly on October 29, 2025 from 4:00pm – 8:00pm
DISCUSSION:

The Ferndale Chamber of Commerce is requesting that the street closure listed in the Resolution be exempt from Section 7.05 of the zoning ordinance which requires a use permit for any assemblage of persons and vehicles. Instead, the closures will require a City issued “Parade or Assembly Permit”, as well as an Encroachment Permit from Cal Trans (for Main Street closure).

In addition, if any city street will be temporarily closed, a City Encroachment Permit will also need to be applied for and obtained.

The Ferndale Chamber of Commerce has already submitted the City of Ferndale Parade, Assembly, or March Permit and received an approval letter from Police Chief Ron Sligh. If the council approves the resolution for the road closure, staff will send the information to the Chamber of Commerce so they may obtain the encroachment permit from Caltrans. The city also will require insurance to be submitted.
