Challenging City Council/Successor Agency Decisions
: Any legal action by an applicant seeking to obtain a judicial review of the City Council/Successor Agency’s decision on a hearing or issue listed on this Agenda may be subject to the 90-day filing period of, and governed by, Code of Civil Procedure § 1094.6. Additionally, if you challenge the actions of the City Council/Successor Agency in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in the public notice, or in written correspondence delivered to the City Council/Successor Agency at, or prior to, the public hearing pursuant to California Government Code § 65009.

APPROVAL OF REVISION TO THE FY 2022-23 TRANSPORTATION DEVELOPMENT ACT CLAIM FOR LOCAL TRANSPORTATION FUNDS AND ADOPTION OF RESOLUTION It is recommended that the City Council:
1. Approve the revised application for FY 2022-23 Transportation Development Act Funds; and,
2. Adopt Resolution No. 22-3908 authorizing the City Manager or his designee to sign and file a revised claim with the Ventura County Transportation Commission for FY 2022-23 Transportation Development Act funds on behalf of the City of Fillmore.
The following alternatives to the staff recommendation are available to the City Council:
1. Do not adopt Resolution No. 22-3908; and/or
2. Provide other direction to staff.

AWARD OF CONTRACT FOR CONSTRUCTION OF PROJECT SPECIFICATION NO. 22-01: NEIGHBORHOOD STREETS REHABILITATION AND ADA IMPROVEMENTS AT TWO RIVERS PARK PROJECT That the City Council:
1. Approve the award of contract to J & H ENGINEERING GENERAL CONTRACTORS, INC. in the amount of $1,344,035.00 for the construction of Project Specification No. 22-01,
2. Authorize the City Manager to approve construction change orders up to the contingency amount of $67,200.00, as recommended and approved by the Construction Manager and City Engineer, and
3. Allocate additional budget of $503,790 to the capital funds for this project by transfer of $488,300 from Local Transportation (TDA Article 8a) fund, account code 204-8500- 0000-467, to account code 467-0000-0400-204, and transfer of $15,490 from RMRA fund, account code 205-8500-0000-467, to account code 467-0000-0400-205 to cover the total project cost of $1,563,790.
ALTERNATIVES
1. Reduce scope of work by eliminating street segments to award a reduced contract within previously identify budget.
2. Reject all bids and direct staff to revise the contract documents and re-advertise the street work contract with reduced scope of work.

CONSIDERATION OF A PROFESSIONAL SERVICES AGREEMENT WITH LARRY WALKER ASSOCIATES FOR TECHNICAL SUPPORT FOR RENEWAL OF THE WASTEWATER DISCHARGE REQUIREMENTS PERMIT Approve a budget adjustment to add $75,800 to line item 301-4638-0021-245; and Authorize the City Manager to execute a Professional Services Agreement with Larry Walker Associates for an amount not-to-exceed $75,800.
