RESOLUTION 26-4125

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FILLMORE ADOPTING CITY COUNCIL POLICY NO. 26-105 REGARDING SOCIAL MEDIA POLICY AND SUPERSEDING CITY COUNCIL POLICY NO. 19-105
WHEREAS, the City of Fillmore (“City”) uses social media to provide information to the community about City services, events, programs, public meetings, and emergencies; and WHEREAS, on May 28, 2019, the City Council adopted Resolution No. 19-3712, approving City Council Policy No. 19-105, “Social Media for Public Use”; and WHEREAS, Council Policy No. 19-105 addresses the manner in which members of the public interact with City social media, but does not address the creation and administration of official City social media accounts, the authorization of staff to post on the City’s behalf, account security, accessibility, emergency communications, or the archiving of social media records; and WHEREAS, Council Policy No. 19-105 does not permit public comments on City social media posts, and the City Council desires to establish standards and procedures under which the City may enable public commenting and moderate comments in a viewpoint-neutral manner; and WHEREAS, the proposed policy provides that, where the City enables public commenting on an official City social media account, the comment areas of that account are limited public forums for discussion of the topics of the City’s posts, and that moderation decisions shall be based only on the viewpoint-neutral rules set forth in the policy, applied consistently to all commenters; and
WHEREAS, the proposed policy further addresses accessibility consistent with the Americans with Disabilities Act, public records considerations under the California Public Records Act, and the retention of social media records consistent with the City’s records retention schedule and applicable law; and
WHEREAS, the City Attorney’s Office has reviewed the proposed policy; and WHEREAS, the City Council desires to adopt an updated social media policy that supersedes and replaces Council Policy No. 19-105.
