RECOMMENDATION:

It is recommended the City Council: '1) review the program and available funding options and staff recommendations; 2) open the public hearing; 3) receive public comment regarding the Community Development Block Grant (CDBG) program and possible activities and projects to be considered for funding under the upcoming NOFA process; 4) close the public hearing; 5) discuss potential applications/recommendations; and 6) direct staff to prepare a CDBG application for Council consideration.

BACKGROUND:

The Community Development and Economic Development Allocations of the State CDBG program will be published in a "Notice of Funding Availability" (NOFA) each program year. On August 30, 2024 the California Department of Housing and Community Development (HCD) released the 2024 NOFA making $34 million available to non-entitlement communities.

Under the Community Development Allocation, eligible cities and counties will be allowed to apply for a maximum of $3,600,000 for up to two activities. The NOFA will again include an "Over the Counter" (OTC) component for infrastructure, housing, and economic development, as well as a competitive component for planning and public service programs.

Eligible activities under the above allocations in the NOFA consist of the follow OTC categories: public improvements, public facilities, homeownership assistance, housing rehabilitation, business assistance and microenterprise activities. The other options allowed under the competitive component are planning studies and public service programs. Eligible activities paid for with state CDBG funds must meet one or more of the three national objectives listed in CDBG federal statutes as follows: benefit to low-income households or persons; elimination of slums and blight; or meeting urgent community development need (a need from a state or federally declared disaster
Staff anticipates submitting an application under lhe 2024 NOFA. OTC activities are those that are funded on a first come first served basis and are not ranked by competitive criteria.

The eligible activities under the 2024 CDBG NOFA may include the following up to the maximum of $3,600,000:

Public Service (maximum grant of $300,000), for two services. Examples include childcare, health care, recreation programs, fair housing counseling, drug and alcohol abuse counseling and testing, homeless services, food bank, senior services, and nutrition services benefiting low- and moderate-income persons. a
a Plannino and T nical Assistance (maximum grant of $250,000 for one study/plan) The product must show a connection to assisting with an eligible CDBG activity that, if implemented, meets a National Objective. Completed planning documents are submitted to the State at the time of completion. The grants may require match; in the past a $5,000 cash match to be expended prior to expenditure of CDBG funds - the NOFA will outline this final amount. Examples include studies, analysis, data gathering, preparation of plans, and identification of action that will implement plans, NEPA and environmental plans.

Housing Programs (maximum grant of $1,500,000 - OTC Activity):
costs.
improvements of owner-occupied units.

Business Assistance or Microenterprise Assistance (maximum grant of $1,500,000 for either Business Assistance or Microenterprise Assistance - OTC Activity). Examples of Business Assistance include financing of working capital, furniture, equipment, and property repairs/improvements. Examples of Microenterprise include business training, financing of working capital, furniture, equipment, and property repai rs/improvements.

Public lnfrastructure (maximum grant of $3,300,000 - OTC Activity). Provides funding for all construction, project implementation, design, federal compliance and overlay requirements, environmental and other soft costs related to the project. Projects may include water, sewer, storm drain, sidewalks, roadways, wells, water storage tanks and other public infrastructure systems.

Provides funding for project equipment, construction of community/senior centers, homeless facilities, park and recreation facilities, fire stations, fire equipment, health facilities, and other public facilities that meet the national objective of the program.

DISCUSSION:

The purpose of this public hearing is to solicit ideas and input from the general public, discuss staff recommendations and provide direction to staff on potential programs to include in the CDBG applications (NOFA and Program lncome).

The application may include the following:

MaximumAward: $3,600,000
Maximum Activities:2
Public Service: Up to $300,000
Planning Grants: Up to $300,000
OTC Activities: Up to $3,300,000
Other grant requirements include:
. Activities should address serious health & safety needs . Activities should primarily benefit lower income households (defined as at or below 80% of the median income)
. Applicants must demonstrate capacity to complete the project within the grant term (36 months)
a OTC projects and programs must be ready to bid or implement the program within 90 days of contract execution
Single audit must be completed and submitted
Housing Element must be up to date with HCD

Staff have reviewed projects/programs that meet the requirements of the CDBG program.

Based on staff's internal discussion and initial outreach, it is recommended the City Council consider submittal of an application for up to $3,600,000 to include one OTC project and one public service competitive application which are further described below.

OTC Project - Maldonado Park Expansion - Funds would be used to complete the final phase of the Maldonado Park which as been sought after for many years. The final phase would be used to develop the adjacent parcel to the existing park facility. Components to be constructed would include: playground, basketball court, sports lighting, soccer field, pathways, landscaping and required infrastructure. lt is estimated that this portion of work will require the full $3.3. million that is available for funding.

Public Service Application - Salvation Army Food Distribution and Hot Meal Program - This program is currently being funded with CDBG funds and doing extremely well. Salvation Army utilizing the money to pay for the cost of food and personnel to operate the programs above. The hot meal program is well attended each week and the food box program averages 300 boxes per distribution. lt is anticipated that $150-$200k would be requested for this program.

COST ANALYSIS
The City's grant consultant for CDBG, Adams Ashby Group, will be preparing the application at a cost of $10,000. lf the application is awarded, the funding by the grant will cover all costs associated with implementation of the grant.

ALTERNATIVES:

The following alternatives are presented for Council consideration: 1. Approve staff's recommendations and direct staff to proceed with preparation of the application; 2. Direct staff to proceed with the application process with a different proposed item(s); 3. Direct staff not to prepare a CDBG grant application; or 4. Provide other direction to staff.

EASEMENT AGREEMENT
This Easement Agreement ("Agreement") is dated 91112024 between McDONALD'S USA, LLC, a Delaware limited liability company ("Grantor") and the CITY OF FIREBAUGH, located in the State of California ("Grantee" and the "City"). The following statements are a material part of this Agreement:

WITNESSETH
A. Grantor is at the time of recording of this document, the owner of the property described on Exhibit A attached ("Grantor's Property").

B. Grantor desires to create a non-exclusive easement to install, operate, repair, maintain, replace, read, and engage in other conduct associated with the operation of a water meter ("Water Meter Easement") in favor of Grantee over a portion of Grantor's Property ("Easement Area") as depicted on Exhibit B attached, upon the terms and conditions set forth herein.

C. This Water Meter Easement does not create any construction, maintenance or repair obligation upon Grantee for Grantor's Property or any improvements upon Grantor's Property except for the water meter and fittings confined to the meter box installed in the Easement Area.

NOW, THEREFORE, Grantor does hereby create, establish and grant this Water Meter Easement to Grantee for the specific purpose of access by Grantee, for Grantee to provide municipal services to Grantor's Property, such as services to existing utilities and water meter reading.

1. WATER METER EASEMENT
A. As the property owner, Grantor or its successors, shall be responsible for all construction, maintenance and repairs to Grantor's Property and the water system on Grantor's Property. Grantee's need to access the Easement Area to install, operate, repair, maintain, replace, and read the water meter and engage in other activities associated with the operation of the water meter is a result of the meter being installed within the Easement Area, and not within the City of Firebaugh's right of way as normally required. Grantor has proposed this Water Meter Easement in lieu of connecting the building pad water services directly to the City's water main with a water meter located in the City's right of way.

B. lt is acknowledged that Grantor, or its successors, intends to construct improvements upon Grantor's Property, and nothing contained herein shall be deemed to prohibit or restrict Grantor or its successors from constructing any buildings or improvements upon Grantor's Property in a manner that does not interfere with Grantee's easement rights hereunder, subject to the requirements of Grantee or any other controlling governmental authority.

C. Unless expressly written, this Water Meter Easement does not create any liability or responsibility to construct, maintain or repair Grantor's Property or any improvements located on Grantor's Property, including the water system that provides connections for water, fire sprinklers, fire hydrants and irrigation services to any building upon Grantor's Property.

Conversely, this Agreement does not excuse Grantor from the requirements of any applicable state or local laws or regulations governing the water system.

D. Grantor grants to Grantee the right of ingress and egress across Grantor's Property for any purposes stated in this Agreement and Grantee will exercise such ingress and egress rights in a reasonable manner.

2. USE OF EASEMENTAREAS
Grantor reserves the right to use the Easement Area for landscaping or other purposes that do not then or later interfere with the granted easement uses, including but not limited to curbing, asphalt, paving, lighting, and signage. Should Grantor or a member, manager, employee, invitee, contractor, or agent of Grantor cause damage to City's water meter or associated improvements within the Easement Area, Grantee may, at Grantor's sole cost, repair or replace the damaged improvements; payment from Grantor to Grantee for repair or replacement work shall be due in full within thirty (30) calendar days of Grantor's receipt of an invoice from Grantee.

3. GRANTEE'S COVENANTS
Grantee covenants and agrees that Grantee will not use the easement granted under this Agreement in such a manner as to: (i) invalidate, modify, jeopardize, or cause a breach of any permits, approvals, or other agreements that benefit or bind Grantor, or (ii) diminish Grantor's legal ability or right to use Grantor's Property. Such covenants shall not, however, prevent Grantee from exercising its authority as a water service provider under state and local laws and regulations.

4. RUNNING OF BENEFITS
All provisions of this Agreement, including the benefits and burdens, run with the land and are binding upon and inure to the benefit of the heirs, assigns, licensees, invitees, successors, tenants, employees and personal representatives of the parties.

5. TERMINATION OF LIABILITY
Whenever a transfer of ownership of either parcel takes place, the transferor will not be liable for a breach of this Agreement occurring after a transfer, except that Grantee will remain liable if it transfers its interest to a licensee or subsidiary corporation. 2 6. NOTTCE
Grantor's address is 110 N Carpenter St, Chicago lL 60607-2101, Attention: Director, U.S. Legal Department, L/C: 004-5150, and Grantee's address is Firebaugh City Hall, 1133 P Street, Firebaugh, CA 93622 . Any party may lodge written notice of a change of address. All notices will be sent by reputable overnight courier with written confirmation of delivery or by certified mail, return receipt requested, to the addresses provided for in this paragraph and will be deemed to have been given when deposited with such courier or when placed in the mail, as applicable.

7. ANTI-TERRORISM REPRESENTATION AND WARRANTY
Grantor and Grantee each represent and warrant that neither they nor the officers and directors controlling Grantor and Grantee, respectively, are acting, directly or indirectly, for or on behalf of any person, group, entity, or nation named by the United States Treasury Department as a Specially Designated National and Blocked Person, or for or on behalf of any person, group, entity, or nation designated in Presidential Executive Order 13224 as a person who commits, threatens to commit, or supports terrorism; and that they are not engaged in this transaction directly or indirectly on behalf of, or facilitating this transaction directly or indirectly on behalf of, any such person, group, entity or nation. Each Party agrees that in the event of a breach of this provision or any applicable law relating to the subject of this provision, the non-breaching Party may take such action as may be necessary in order to comply with this provision and/or the applicable law, including but not limited to terminating this Agreement.

B. WAIVER OF TRIAL BY JURY
Grantor and Grantee agree to waive any right to have a trial by jury with respect to any lawsuit based on, or arising under this Agreement or any course of conduct, course of dealing, statements or actions of Grantor and Grantee in connection with this Agreement.

9. ATTORNEYS' FEES AND VENUE
lf an action at law or in equity is necessary to enforce or interpret the terms of this Agreement, the prevailing party shall be entitled to reasonable attorneys' fees, costs and necessary disbursements in addition to any other reasonable relief to which he may be entitled. With respect to any suit, action or proceeding arising out of or related to this Agreement, or the documentation related hereto, the parties hereby submit to the jurisdiction and venue of the Superior Court for the County of Fresno, State of California for any proceeding arising hereunder.

10. GOVERNING LAW

11. WAIVER
