STAFF REPORTS
 Finance Director, Pio Martin – Will be working on the budget so will not be working on any staff reports during that time.
 City Attorney, Nick Matioan – Nothing to report.
 Acting Deputy City Clerk, Olga Flores –Attended Post Office Clerk Nora’s retirement lunch with Ben and Elsa, and we presented her with an appreciation award on behalf of the city. Will be sending out business and tobacco license renewals at the end of May.  City Engineer, Mario Gouveia – Allies are ongoing, Beehive will take the longest because of the pump station. HWY 33 beautification project was done since last week and will be getting a final inspection Thursday and there will be some items they will need to fix and will be brought to council for acceptance maybe in June.  City Manager, Ben Gallegos – Both him and Elsa went to past Council Member Jim Lowe’s funeral services in Monterey on behalf of the city. Both him and Mayor Pro Tem went to Sacramento advocating for parks infostructure, fire, police but right now they are not funding any projects due to state funds not looking so great. Ben, Elsa, and Silvia met with Assemblywoman Soria and voiced some of the concerns for the city. Also spoke to her about the solar projects and mentioned the procurement and hopefully she can get away from that due to some businesses possibly not wanting to apply for it.  Public Works Director/Fire Chief Michael Molina – “Q” Street is done, tomorrow the paving will start where the exercise equipment is so it can also be used in the winter, also spoke to Ben about the water park at Maldonado; with the well not putting out what it is supposed to maybe going down to one day a week, a weekend or maybe cutting down the hours to 2-3 hours a day, especially during the peak season in July when Toma Tek starts up to help the plants and supply water to the residents. Once it is decided on, it will be brought to council for approval. The well is currently back online and is putting out more than expected but the test will come in the summer to see what we can handle.  Battalion Chief Hector Marin- Reported that 38 weed abatement notices went out and 8 properties are cutting their weeds. The fire department is getting ready for their annual dinner dance.
 Council Member Lopez – Nothing to report
 Council Member Perez – On May 3rd he was in San Joaquin for the Measure C meeting and took over 40 people from Firebaugh and Mendota. Members from COG were surprised to see because we filled the hall asking for more funding for the rural areas for streets, sidewalks and other things.
 Council Member Jenkins – Nothing to report
 Mayor Pro-Tem Renteria – When her and Ben attended state they spoke to other cities and they all have the same problems and issues with funding, it was a great meeting and they asked a lot of questions, the one thing they came out knowing is if you have something shovel ready and they need to spend money you will be called, so it’s really good when you have projects that are shovel ready. The lunch with Soria, its really great to speak with her and hear how fond she is of Firebaugh and she does a lot for Firebaugh has brought us a lot of money.
 Mayor Valdez – Measure C renewal is coming up for vote, and it is a necessity for rural communities. We have fought and have been successful in getting allocations. Freddy stated along with Mendota’s Mayor Victor Martinez at COG they were able to reshape some monies that were going to leave the west side into passing lanes on HWY 33, stating there are ways to battle the allocation but need community feed back and doing those surveys are important for driving your tax dollars into what you need them to do.

Firebaugh received four million dollars which was used for streets and school bought more busses. Check out the Measure C websites and you can also see the projects here in Firebaugh. Freddy was also voted from COG on to the Rail Authority which is all things rail as well as the CID Board which does all the live scan and blue chip.

METHOD OF APPORTIONMENT OF ASSESSMENT
LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT NO. 1
(Pursuant to the Landscaping and Lighting Act of 1972)
Method of Assessment Spread
The basic objective of the Assessment Spread is to distribute costs in accordance with the benefits received. Costs are to be spread equally to each residential unit (RU) as follows:
(a) For 2025-2026, Tracts 4010, 4060, 4459, 4608, 4850, 5202, 5367, 4851 Phases I, II, III, Parcel “A”, Parcel “B” and Hacienda Villa Apartments have been completed and accepted by the City. The combined tracts consist of 390 lots or parcels. Each single-family residential lot is considered an assessable unit. The total square footage of each multiresidential lot is divided by 6,000 square feet to determine the number of assessable units for each multi-residential lot. There is a total of 387 single-family RU lots and 3 multiresidential lots consisting of 107.17 RU lots for a total of 494.17 RU assessable units, each of which benefit equally from the improvements maintained by this landscaping and lighting maintenance district.
(b) For 2025-2026, Tract 5529 has been completed and accepted by the City. The total number of RU lots in this subdivision is 186, each of which benefit equally from the improvements maintained by this landscaping and lighting maintenance district. (c) For 2025-2026, Tract 6257, 6313, & 6314 have been completed and accepted by the City.

The total number of RU lots in this subdivision is 131, each of which benefit equally from the improvements maintained by this landscaping and lighting maintenance district. (d) For 2025-2026, Tract 6252, Outlot “A” (Del Rio Place Apartments), and Outlot “B” (Public Park) have been completed and accepted by the City. Tract 6252 consists of 33 single family residental lots and Outlot “A” consists of 56 Muti-family units. The total number of RU lots in this subdivision is 89, each of which benefit equally from the improvements maintained by this landscaping and lighting maintenance district.

Computing Individual Assessment
(a) The total number of assessable units is 494.17 RU. The assessment will be $35.00 per RU for 2025-2026 due to the limitations of assessments below. The total calculated amount to be assessed for Fiscal Year 2054-2026 is $17,296.00 based on $35.00 multiplied by 494.17. This sentence does not apply to Tract 5529, 6257, 6313, 6314, & 6252. (b) Tract 5529 - The total number of assessable units is 186 RU. The total estimated cost to be assessed for Fiscal Year 2025-2026 is $42,768.00. The maximum allowable assessment increase is equal to the change in CPI and shall not exceed 3.0%. The change in the CPI for Fiscal Year 2024-2025 was 2.4%. Consequently, the total assessable cost of $42,768.00 will not be fully recovered through the FY 2025/2026 assessment since the maximum assessable amount is limited to the FY 2024/2025 assessment escalated by

2.4%, or $23,346.72 x 0.024, equaling $23,907.04. The assessment will be $128.52* per RU for 2025-2026 for a total of $23,904.72. This applies only to Tract 5529. (c) Tract 6257, 6313, & 6314 - The total number of assessable units is 131 RU. The total estimated cost to be assessed for Fiscal Year 2025-2026 is $11,998.35. Limitations on Assessments
(a) Normally, the assessable costs may be revised upon preparation of the Engineer’s Report for each fiscal year for which assessments are to be levied and collected as provided for in the Landscaping and Lighting Act of 1972 (State Streets and Highways Code Section 22500) and Division 15 Part 2 as amended per Proposition 218; however, this assessment district was created utilizing a fixed assessment of $35.00 per assessable unit. This sentence does not apply to Tract 5529.
(b) This Subsection (b) only applies to Tract 5529. Assessments in each successive year are subject to an annual adjustment tied to the Consumer Price Index-U for the San Francisco Bay Area as of December of each succeeding year (the “CPI”), with a maximum annual CPI adjustment not to exceed 3%. The calculation of the change in the CPI shall use December 2006 as the base year CPI. In the event that the annual change in the CPI exceeds 3%, any percentage change in excess of 3% can be cumulatively reserved and can be added to the annual change in the CPI for years in which the CPI change is less than 3%. If the actual assessment rate for any given year is not increased by an amount equal to a minimum of 3% or the yearly CPI change plus any CPI change in previous years that was in excess of 3%, the maximum authorized assessment shall increase by this amount. In such event, the maximum authorized assessment shall be equal to the base year assessment as adjusted by the increase to the CPI, plus any and all CPI adjustments deferred in any and all prior years.

The increases in these assessments, according to the formula described above, was approved by a majority vote of the owners of the lots in Tract No. 5529 voting in a land owner ballot proceeding on the issue of the assessment conducted on August 6, 2007, in accordance with Article XIIID of the California Constitution and Section 53753 of the California Government Code.
