Escrow Holder or its affiliates also may elect to enter into other business transactions with or obtain loans for investment or other purposes from the depository institution. All such services, accommodations, and other benefits shall accrue to Escrow Holder or its affiliates and Escrow Holder shall have no obligation to account to the parties to this escrow for the value of such services, accommodations, interest or other benefits..

All disbursements shall be made by check or wire of Escrow Holder. The parties to this escrow are hereby notified that the funds deposited herein are insured only to the limit provided by the Federal Deposit Insurance Corporation. Any instruction for bank wire will provide reasonable time or notice for Escrow Holder's compliance with such instruction. Escrow Holder's sole duty and responsibility shall be to place said wire transfer instructions with its wiring bank upon confirmation of (1) satisfaction of conditions precedent or (2) document recordation at close of escrow. Escrow Holder will NOT be held responsible for lost interest due to wire delays caused by any bank or the Federal Reserve System and recommends that all parties make themselves aware of banking regulations with regard to placement of wires.

TO: Honorable Freddy Valdez and Council Members
FROM: Jenna Chilingerian and Luke Risner, Contract Planners DATE: April 6, 2026
SUBJECT: Resolution No. 26-13 – A Resolution of the City Council of the City of Firebaugh Authorizing Application to and Participation in the Prohousing Designation Program RECOMMENDATION:
1. Council by motion adopts Resolution No. 26-13 authorizing application to and participation in the Prohousing Designation Program.
2. Directs the City Manager (or designee) to submit the Prohousing Designation Program application to the California Department of Housing and Community Development.
BACKGROUND:
The City of Firebaugh is pursuing a pro-housing designation under the State of California’s Prohousing Designation Program administered by the California Department of Housing and Community Development (HCD). The Prohousing Designation recognizes jurisdictions that have adopted policies and programs that support housing production and reduce barriers to housing development.
Obtaining the Prohousing Designation demonstrates the City’s commitment to addressing housing needs and promoting the development of a range of housing types. In addition to recognizing local housing-supportive policies, the designation may improve the City’s competitiveness for certain State funding opportunities that support housing, infrastructure, and community development projects.
As part of the application process, the City is evaluating existing policies and programs that facilitate housing development and encourage diverse housing opportunities. To qualify for designation, a jurisdiction must achieve a minimum score of 30 points based on existing and proposed policies. Proposed policies must be implemented within two years of application submittal.
Existing Policies
The City of Firebaugh has adopted several policies that support housing development and reduce barriers to new housing. These include:
• Sufficient sites to accommodate 125-149% of current RHNA. • Density Bonus Program
• Increases allowable density in low-density areas by permitting 1 ADU and 1 JADU. • Zoning that allows supportive, transitional, and employee housing. • Neighborhood Commercial zone: allow for residential in non-residential zones. • Acceleration of Housing Production through General Plan. • Priority permitting process for ADUs/JADUs.
• Establishment of a standardized application form.
• Adopted pre-approved ADU design packages.
• Accelerate innovative housing types, example: Residential Mobile Home Park zone. • Adopted universal design ordinance pursuant to Health and Safety Code Section 17959.
Return to Agenda
Based on these existing policies, the City currently achieves a total of 26 points under the Prohousing Designation Program.
Proposed Policies
To meet the minimum threshold of 30 points, the City has identified additional proposed policies to include in the application. These include:
• Permit missing middle housing uses by right in R-1 and R-1 (TN) zone. • Priority permit processing for homes affordable to Lower-Income Households. • Limit total number of public hearings to 3 or fewer.
• Waiver of development impact fees for housing affordable to Lower-Income Households (case-by-case basis and subject to discretion of City Manager or their designee).
These proposed policies are required to be implemented within two years of the application submittal; the City intends to submit the application in April 2026, so the proposed policies will be required to be implemented by April 2028.
PUBLIC REVIEW AND COMMENT:
The Draft Prohousing Designation Program Application was made available for public review at City Hall and on the City's website: The Prohousing Designation Program – The City of Firebaugh. A bilingual public notice (English/Spanish) was posted at City Hall, distributed via TextMyGov alert to residents, and fliers were placed at key community locations. The 30-day public review period ran from February 27 through March 30, 2026.
Two public workshops provided opportunities for input: a Joint City Council/Planning Commission meeting on March 16, 2026, and a dedicated Community Workshop on March 18, 2026 (2 attendees), both at Firebaugh Community Center with Spanish translation offered. Targeted outreach reached the Housing Element stakeholder list (developers, service providers) and Downtown Infill Initiative participants (Fresno COG, legislators, Fresno EDC).
One public comment was received from resident Marcia Sablan (March 13), supporting smaller lots, duplexes, "tiny houses," and shared spaces for low/moderate-income access. This input was incorporated into the rationale for Proposed Policy #1 ("missing middle housing by-right in R-1 zones"). No other comments were received.
REASON FOR AUTHORIZATION
Pursuing the Prohousing Designation would position the City of Firebaugh to be more competitive for State funding opportunities, including the Affordable Housing and Sustainable Communities (AHSC) funding program, while demonstrating the City’s commitment to supporting housing development and reducing barriers to housing.
FISCAL IMPACT
None.

Subchapter 6.6 Prohousing Designation Program requires applicants to confirm that its treatment of encampments on public property complies with and will continue to comply with the constitutional rights of persons experiencing homelessness. An application must include a one-page summary demonstrating how the applicant has enacted best practices in their jurisdiction related to the treatment of unhoused individuals camping on public property, consistent with the United States Interagency Council on Homelessness’ “7 Principles for Addressing Encampments (June 17, 2022). The following template and certification are included to help jurisdictions meet this threshold.
• Principle 1: Establish a Cross-Agency, Multi-Sector Response to Encampments – Describe how system partners (name partners) work together to prioritize health and safety both for residents and unsheltered individuals. (350 characters max) Firebaugh will work with Fresno County, Fresno Madera CoC, and regional partners like Catholic Social Services, Fresno Rescue Mission, and Fresno-Madera Area Agency on Aging to coordinate encampment responses prioritizing health and safety for residents and unsheltered individuals, per Housing Element Program 3. • Principle 2: Engage Encampment Residents to Develop Solutions – Describe street outreach efforts to engage with encampment residents to find alternative shelter, housing, and service options using the housing first approach before an existing encampment is closed. (350 characters max)
Street outreach will engage encampment residents via regional CoC partners, offering shelter, housing, and services using a Housing First approach before closures, building on Firebaugh's commitment to cooperate with agencies serving the homeless. • Principle 3: Conduct Comprehensive and Coordinated Outreach – Describe multidisciplinary connection strategies and linkages to resources and permanent housing solutions that is customized to individual needs. If applicable, describe how the jurisdiction uses the coordinated entry system to connect individuals to resources and permanent housing. (350 characters max)
Multidisciplinary outreach through CoC's Coordinated Entry System will link individuals to customized medical, behavioral health, benefits, and housing resources based on assessed needs, consistent with regional services listed in the Housing Element. • Principle 4: Address Basic Needs and Provide Storage – Describe efforts to meet basic needs, health, safety, and access to storage (timeframes) for people experiencing unsheltered homelessness while creating clear pathways to permanent housing. (350 characters max)
25 Partners will provide hygiene supplies, trash services, health outreach, and time-limited storage while connecting residents to shelter and housing pathways, supporting Firebaugh's programs for extremely low-income and homeless residents. • Principle 5: Ensure Access to Shelter or Housing Options – Describe how low barrier resources to housing and supportive services are communicated to encampment residents. Include how strategies involve alternative measures to criminalization, focusing on service engagement and harm reduction. (350 characters max) Low-barrier shelter, housing, and harm-reduction services will be communicated via outreach and materials from CoC partners, emphasizing voluntary engagement over criminalization, in line with the City's homelessness cooperation commitments. • Principle 6: Develop Pathways to Permanent Housing and Supports – Describe Housing First strategies emphasizing low barriers, a harm-reduction model, and services to support people obtaining permanent housing more efficiently. Identify efforts to align federal, state, and local funding/programs to provide clear pathways to permanent housing. (350 characters max)
Housing First strategies with low barriers and harm reduction will leverage aligned federal, state, and local funds through CoC partners for rapid rehousing and supportive housing, per Firebaugh's inter-agency service programs.
• Principle 7: Create a Plan for What Will Happen to Encampment Sites After Closure – Describe plans for former encampment spaces (long-term solutions to prevent encampments from reoccurring). Include efforts to emphasize safety, accessibility, and inclusivity that improve infrastructure. Example: Communities can include curb cuts to increase mobility access and enhanced lighting to encourage safety. (350 characters max) Closed sites will be monitored and improved with safety features like lighting and accessibility upgrades (e.g., curb cuts), preventing recurrence through ongoing outreach and public space activation, tied to regional homelessness efforts.

28 Appendix 7: Additional Information and Supporting Documentation Public Participation Checklist Narrative Response for Appendix 6 Outreach through a variety of methods and languages to ensure access to the public process and provide opportunities for public input.
The City of Firebaugh conducted extensive outreach using multiple channels to maximize public awareness and participation. A dedicated Pro-Housing Designation webpage was created at firebaugh.org featuring the draft application, bilingual public notices (English/Spanish), workshop flyers, and clear instructions for submitting comments. Public notices were posted at City Hall and in the local newspaper. A TextMyGov alert was sent to all registered residents notifying them of the application, comment period, and workshops.
Fliers were distributed at key community locations. All materials offered Spanish translation, reflecting Firebaugh's demographics where Spanish is widely spoken. The 30-day public comment period ran from February 27 to March 30, 2026 (5:00 PM), with multiple submission options including email, phone, mail, and in-person at workshops.
Specific effort to engage all segments of the community, including individuals or representatives of lower-income and special needs households, for-profit and nonprofit developers, and special needs service providers.
Targeted outreach reached diverse stakeholders using the City's Firebaugh Downtown Infill Initiative, including Fresno Council of Governments, Fresno EDC, West Hills Community College District, Assemblywoman Esmeralda Soria's and Senator Ana Caballero's offices, and Fresno County representatives. These efforts mirror the City's Housing Element public participation process, ensuring broad representation across income levels and community interests.
Availability of the draft document to the public, including notification to interested parties and all segments of the community, for thirty (30) calendar days and subsequent versions for seven (7) calendar days.
The draft Pro-Housing Designation Application was posted continuously online at firebaugh.org and available in print at City Hall (1133 P Street) throughout the full 30-day comment period (February 27–March 30, 2026). All residents and stakeholders were notified via TextMyGov alert, website posting, public notices, workshop announcements, and targeted stakeholder emails. Multiple comment channels were provided: email ([email protected]), phone (559-659-2043), mail (City Hall), and verbal comments at workshops. Spanish translation was available for all materials, ensuring accessibility. No subsequent draft revisions were needed as the single comment received was incorporated without requiring application changes.
Public hearings and informative meetings.
Two public workshops were held to inform the community and gather input:
1. Joint City Council/Planning Commission Meeting: March 16, 2026, 5:30 PM at Firebaugh Community Center (1655 13th Street). Held during the regular City Council meeting, this satisfied HCD's public hearing requirement while providing program overview.
2. Dedicated Community Workshop: March 18, 2026, 5:30 PM at Firebaugh Community Center. Two community members attended. Presentation covered program details, existing/proposed policies, and timeline. Spanish translation offered. Both meetings were properly noticed per Brown Act requirements.
Consideration of comments, including incorporation of comments into a jurisdiction's application and Prohousing Policies as appropriate.
One written public comment was received during the comment period:
Marcia Sablan (resident), March 13, 2026: "In order to facilitate access to home ownership for residents with low/moderate income... decreased lot size for smaller houses, duplexes, possibly 'tiny houses' with foundations. Consider creative ways to allow 'common spaces'... access to home ownership at an entry level for more families, seniors." Response/Incorporation: Ms. Sablan's comment directly supports the City's Proposed Policy #1: "Permit missing middle housing uses by right in R-1 and R-1 (TN) zone" (4 points).
Her suggestions for smaller lots, duplexes, and shared spaces align perfectly with "missing middle" housing types. This community input is cited in the application rationale as evidence of local support for the policy. No other written or verbal comments were received despite extensive outreach.

Hi Ben, I was happy to see this program. In order to facilitate access to home ownership for residents with low/moderate income,I think about several issues. First, decreased lot size for smaller houses, duplexes, possibly “tiny houses “ with foundations. Consider creative ways to allow “common “ spaces : parking in the back, common landscape areas, outdoor eating and recreation areas. Of course, wise use of space and construction placement hopefully would allow access to home ownership at an entry level for more families ,seniors.
Some of these things are what Oscar and I are looking at doing on the vacant lots on Q and 8th,but continue to run into problems. Thanks for your work and interest in this designation. Marcia Sent from my iPhone

Quick Recap:
This was the sixth meeting for the Firebaugh Downtown Infill Initiative, a comprehensive program aimed at revitalizing the city's downtown core through higher-density, mixed-use development projects. The meeting covered progress on downtown revitalization efforts, including updates on property acquisitions, and development plans aimed at creating a catalyst project with improved connectivity. The meeting was held at the Firebaugh City Hall and via zoom.
Key Discussion Points:
§ Ben Gallegos provided an overview of recent developments in Firebaugh. Mr.
Gallegos noted the new Starbucks is opening this week. Maldonado Park improvements, the Fire Station, Police HQ, La Jolla apartments phase I and II, and Del Rio apartments, Habitat for Humanity (seven homes) as recent developments within the past three years.
§ Michael Sigala provided an update on the site acquisition progress and noted that they were able to come to an agreement for two additional sites along O Street.
Those properties are now in escrow. The City now has in their possession two sites that can accommodate a housing project, and one site that will be used as a public plaza and surface parking to compliment the housing project. § Michael Sigala noted that a request for proposals for residential mixed-use was issued last week and he reviewed the RFP document with the group. Responses to the RFP will be due in late March.
§ The RFP will coincide with the Notice of Funding Available for the California Affordable Housing and Sustainable Communities (AHSC) program that was released on March 4th. If all goes according to plan, responses to the RFP and then a quick turnaround on an AHSC application will be developed in the next two months.
§ Updates were shared on securing a ProHousing designation, PLHA funding, and other potential funding sources to support the initiative. Michael Sigala asked Supervisor Pacheco’s office for assistance in reaching additional funding contacts at the County.
§ The team also discussed sustainable transportation improvements which are pedestrian, bike and transit improvements that will be part of the AHSC application.
The City is working on identifying these improvements at this time. § Michael Sigala asked Fresno EDC for assistance in the meeting local workforce development and hiring practices requirements of the AHSC program. He went over some the areas the City needs help on and indicated he would follow up with Will Oliver about this subject. Firebaugh does not have a local hiring ordinance, but Marc Benjamin suggested looking at the City of Clovis and other Fresno County cities for examples.
§ Letters of Support from all members of the Initiative will be needed for the AHSC application. Michael Sigala will provide a template and follow up with additional information.
§ There was a discussion about the need for community workshop in late April, should a project and AHSC application move forward.
Next Steps:
• If all goes according to plan, the City of Firebaugh, consultant team, and chosen housing developer will be working diligently on a AHSC funding application to the State of California by May 4, 2026….stay tuned.
The next Stakeholder meeting is scheduled for Wednesday, May 13, 2026, at 10 AM.

The City Council hereby determines that APN 008-071-10 and APNs 008-074-04, 18, and 19 (collectively, the “Properties”) qualify as Exempt Surplus Land because they meet the exemption criteria contained in Government Code section 54221(f)(1)(F)(i) and 54221(f)(2) as the Properties are intended for the development of affordable housing, contingent on the California Department of Housing and Community Development (“HCD”)’s 30-day review and approval of this resolution.

Dear Fresno COG members,
On behalf of the City of Firebaugh, and in my capacity as a planning consultant supporting the implementation of the Community Connectivity and Downtown Revitalization Study (the “Study”), I am writing to express strong professional support for the City’s grant proposal to amend the Zoning Ordinance in support of implementation of the Study.
Throughout preparation of the Study, the City conducted land use analysis, infrastructure review, and immense stakeholder outreach to identify practical strategies for strengthening downtown Firebaugh and improving connectivity and improving downtown to be an active, pedestrian-scaled environment.
Through stakeholder outreach, it is apparent the residents of Firebaugh want to see pedestrian-scaled development in the downtown area. The proposed zoning text amendments will serve as an implementation mechanism for the Study’s goals. By aligning the City’s Zoning Ordinance with the Study’s vision, the City would be taking a critical step toward integrating land use and transportation planning.
We appreciate Fresno COG’s continued coordination and support as the City advances this implementation effort.
Thank you for your consideration.
Respectfully,
Michael Sigala, MCP

Del Rio Bus Stop and Sidewalk Project - TOD Application Capital Improvement Project Description
1. Introduction
Please provide a description of project objectives, setting, and relationship of the proposed project to existing and planned infrastructures in the project area.
2. Nexus to Transit Oriented Development
Describe the nexus of the proposed project to transit oriented development. Through an existing policy or an adopted plan, explain how the project will boost transit ridership, encourage biking & walking and support a livable and viable transitoriented community.
The City has been implementing the improvements identified within the Regional Active Transportation Plan (ATP) as funding opportunities have become available. The ATP identified the proposed area as lacking pedestrian facilities (see Figure 6-8).
Additionally, the project area is not currently supported by Regional Transit facilities.
These barriers, coupled with connectivity constraints to the City’s nearest regional transit bus stop (the Senior Center), deter residents from this area from utilizing Regional Transit Busing.
Once completed, the proposed project would remove these barriers by offering a Regional Transit Stop and pedestrian facilities necessary to access it The City of Firebaugh (City) is proposing to design, bid, and construct bus stop and sidewalk improvements in a Medium Density Residential neighborhood on the North end of the City (see Fig-01). The existing neighborhood was established under Fresno County governance prior to annexation into the City of Firebaugh. The County improved the street section, curbs, and gutters prior to the City taking over as the governing jurisdiction. This area of the City is connected to the broader community by SR 33, which lacks continuous pedestrian connection to the core infrastructure and services available to residents.

3. Land Use Characteristics of the Project Area
Please provide demographic and business profile of the project area. Identify existing and planned residential density, employment intensity and industrial mixes if any in the project area. Please also identify, if applicable, any affordable housing that the project supports.
The project area is located at the northern end of the City within a R-3 Medium Density Multifamily Residential District, which is intended to develop at a density of one dwelling per 1,500 square feet of lot area and provide a suitable environment for family life with space for community facilities. The R-3 district also supports affordable housing by requiring that residential development on parcels ¾-acre or larger accommodate a minimum of 20 dwelling units per acre consistent with state affordability standards, unless it can be demonstrated that affordability can be achieved at a lower density. Portions of the project area are also zoned C-3 General Commercial, which allows a wide variety of commercial and service uses intended to serve the daily needs of Firebaugh and the surrounding area.
The project is located within Census Tract 84.05. Approximately 15% of the population in the tract is estimated to be 60 years or older, compared to 10.1% citywide and 11.5% countywide, indicating a comparatively older population within the project area. The higher proportion of older residents underscores the importance of providing safe, accessible pedestrian infrastructure and reliable transit access within the project area.
Additionally, of the working population aged 16 and older, approximately 77% commute via single-occupancy vehicle in this census tract, compared to 82.8% citywide and 73.2% countywide, suggesting limited availability of alternative transportation options and connectivity within the project area.

4. Transportation Characteristics of the Project Area
Please identify the distance of the proposed project to the nearest BRT station.
Describe the transit, bike and walk environment in the project area, and explain, if applicable, how the proposed project will contribute to providing multi-modal transportation choice to people who live or work in the area.
5. Urban Design & Parking Policy
Describe the existing or planned design characteristics or policies in the project area.
Explain, if applicable, how the project will contribute to creating a positive image of the surrounding areas.
Describe, if any, existing or planned parking policies that are transit friendly.
6. Green Building
Please describe, if applicable, any green building element in the project.
The project area is located approximately 1.2 +/- miles from the closest BRT station at the Firebaugh Senior Center [1601 Thomas Conboy Ave]. The northern end of the City has a number of gaps in the pedestrian facilities, creating barriers for residents who want to utilize the Regional Transit services provided by FCRTA. Many of the families within the City struggle to access services due to deficiencies in the pedestrian infrastructure and limited vehicle access or availability. In many households, a single vehicle is primarily used for commuting to work, restricting transportation options for other family members. The introduction of pedestrian infrastructure and a bus stop has the potential to establish a new transportation corridor for the residents in the area.
The project is located within an existing residential area where on-street parking is typically used by residents and visitors. The proposed project improvements would not alter existing parking availability for the residents in the area. However, the frontage adjacent to the City property where the proposed bus stop would be located will be designated for bus pick up and drop off.
Currently, the City-owned lot has not immediate development plans. Developing the site as a bus stop would activate the property and create a positive presence for transit within the neighborhood.
There are no proposed green building elements included in the project improvements. 6 City of Firebaugh

7. Quality of Project and Additional Information
Describe the level of community support for this project. Describe how the proposed project will address the issues in the community, how the project will help create a sense of place, and potential economic impact such as attracting private investment in the project area, etc. Please also identify any potential obstacles to the successful completion of the entire project.
The residents have requested sidewalk improvements within the project area since the subdivision was annexed into the City. The City Council has also directed Staff to pursue potential funding opportunities for the project improvements. While some of the properties within the subdivision have developed, a number of lots remain vacant. The construction of this project has the potential to spark further development within the subdivision. There is also potential for the Commercial zoned properties to develop into services that would directly benefit residents in the area.
The City is requesting TOD funds solely for the Design and Environmental Clearance of the project. Completion of this phase of the project work will position the City to pursue CMAQ funding for the remaining portion of the project costs. A completed PSE package will allow the City to be more competitive in the next call for projects. 7 City of Firebaugh

8. Project Schedule and Scope of Work
Please outline the scope of work for this project. Please briefly describe deliverables and anticipated completion dates for each deliverables. Please also provide estimates of project expenses funded by the TOD program, and project revenue for the entire project.
The City is requesting TOD funding for the design and environmental clearance of the project. The deliverables for the project will be a complete Plans, Specifications, and Estimate (PSE) package. Funding completion of the PSE for the project will position the City to apply for CMAQ funding and receive additional points for being a Construction Ready Project. The City plans to pursue CMAQ funding in an upcoming call for projects in order to fund the construction of the project improvements.
As part of the application process a Preliminary Engineer’s Estimate has been included as an attachment to this application (see Fig-02).
The City has site control over the areas where project improvements will be constructed including the site of the proposed bus stop. No Right of Way acquisition is needed to complete the proposed project improvements.
The following describes the proposed project schedule:

Staff Report to Council- March Activity Summary
During the month of March, officers were actively engaged in a variety of enforcement and community safety efforts.
Following a lengthy investigation into allegations of narcotics sales, the CIWS team served a search warrant in the 1400 block of Del Rio. The operation resulted in the arrest of several individuals and the seizure of illegal narcotics.
With Spring Break underway, officers have increased their presence throughout the city. This has included a high volume of citizen contacts and proactive patrols during daytime/nighttime hours to ensure public safety.
The Outside Market began last week. Officers were assigned to the event and will continue to have officers specifically assigned to this detail to help prevent disturbances and maintain a safe environment for attendees and vendors.
Additionally, officers have been working under the OTS grant, focusing on traffic enforcement.
Numerous citations have been issued, primarily for speeding, stop sign violations, and distracted driving. End of Report.
