AGENDA ITEM
TO: HONORABLE MAYOR AND COUNCIL
SUBJECT: AMENDMENT TO CHAPTER 8 OF THE FIREBAUGH MUNICIPAL CODE RELATING TO THE

BUILDING AND HOUSING CODES
DATE: APRIL 20,2026
BACKGROI]ND
The model codes are updated every three years. This allows the codes to improve and adjust to the newest materials, methods of construction and technological advances in the industry.

The California Building Standards Commission adoption of the 2025 code comes after a comprehensive multistate agency and stakeholder update ofthe 2l22building codes.

The objective is to produce a practical building code that ensures public safety first and foremost while implementing the most efficient technology available to conserve the state's natural resources and energy use.

California's building code is applied to virtually every commercial and residential structure in the state.

The new 2025 California Building Standards Code contains thirteen parts that incorporate public health, life safety, and general welfare standards used in the design and construction of buildings in California. These parts incorporate the latest national standards in the International Building, Residential and Fire Codes, California Green Building Code, California Energy Code, National Electrical Code, and Uniform Mechanical and Plumbing Codes. Along with the usual Energy and Green code updates, below are a few noteworthy updates:
o New Part 7 stand-alone code book for Wildland-Urban Interface (WUD, was Chapter 7 A in the CBC. r The Energy and Green codes continue to expand Electric Vehicle Charging requirements to install EV charging infrastructure including receptacles and chargers to new multifamily dwellings, single family homes, hotels, and motels.
o Electric-ReadyBuildings:

The code encourages electric-ready buildings to facilitate future adoption of cleaner electric technologies for cooking and water heating.

Health and Safety Code Section I 894 I .5 mandates that the Building Standards contained in the 2025 California Building Standards Code shall be effective 180 days after publication by the California Building Standards Commission. If these codes are not adopted by ordinance, they become effective by default without any amendments. The proposed effective date for the City of Gustine will be January l, 2026. As part of the adoption process this department has made every effort to notifu all the parties affected of the proposed changes.

STAFF REPORT

Firebaugh City Council
Luke Risner, Planning Consultant
Density Bonus for Mixed-Use Development Project located on O St. and 1lth st.

Summarv/lte commendations :

Site Plan Review 2026-01proposes to establish and develop two (2) 3-story buildings that include atotalof 38 apartment units, an interior community space, and two commercial spaces. The project is located on two sites at 1031 O Street (Site 1) and 1466 1lth Street (Site 2), identified as Fresno County Assessor Parcel Numbers (APNs) 008-071-10 (Site 1) and 008-074-04, 008-074-018, and 008-074-19 (Site 2), that total approximately 0.95-acres in size.

With 100 percent of the proposed residential units designated for lower-income households, the project qualifies for a density bonus and associated incentives pursuant to California Government Code Sections 65915 and 65918 and applicable provisions of the Firebaugh Municipal Code. A Density Bonus Agreement, in the form of a covenant recorded on the properties, is required to formalize the provision of long-term aflordable units and associated incentives.

The subject properties are zoned C-2 (Central Trading District - Central Commercial), which permits mixed-use development subject to Site Plan Review approval.

It is recommended that the City Council take the following actions:
1) Ask the City Planner to deliver the staff report;
2) Ask any questions of staff regarding the project;
3) Open the hearing to the public and ask for any public testimony; 4) Ask for motion on the project by adopting Resolution26-16 (to approve the Density Bonus application).

Backeround: +
The applicant, Pacific West Communities, Inc., has submitted an application to develop two (2) sites into mixed-use developments: Site 1 located on the north side of O Street, between 1Oth Street Return to agenda
and 1lth Street (APN 008-071-10), and Site 2 located on the southwest corner of O Street and 1lft Street (APNs 008-074-04, -018, and -019).

The sites are zoned C-2 (Central Trading District) with a General Plan land use designation of Central Commercial. Pursuant to the Firebaugh Municipal Code, mixed-use developments are permitted within the C-2 zone district and Central Commercial land use designation, subject to approval of a Site Plan Review by the Planning Commission.

Because 100 percent ofthe proposed residential units are designated for lower-income households, the project qualifies for a density bonus and associated incentives pursuant to California Government Code Sections 65915 through 65918. The applicant has submitted a request for a Density Bonus to ensure long-term aflordability of the units and to implement applicable concessions and waivers. The Density Bonus is being processed concurrently with the Site Plan Review and requires a recommendation by the Planning Commission and final approval by the City Council.

At a regular meeting of the Firebaugh Planning Commission on April 13, 2026, the Planning Commission adopted Resolution P22026-01approving the Site Plan Review subject to Conditions of Approval. These Conditions of Approval required a redesign of the building architecture and building placement, subject to further review and approval by the Planning Commission.

Furthermore, at the same meeting, the Firebaugh Planning Commission adopted Resolution PZ 2026-02 recommending approval of the Density Bonus to the City Council.

Proposal and Analysis:

Site Plan Review:

Pursuant to Firebaugh Municipal Code (FMC) Chapter 25, Section 2I.4, a Site Plan Review is required for any mixed use development. FMC Chapter 25, Section 41.3 govems the site plan review process for mixed-use developments in which the Planning Commission has the authority to approve or deny a site plan review. As stated previously, the Planning Commission voted to approve the Site Plan Review, subject to conditions, at theirApril 13,2026 regular meeting.

General Plan Land Use:

The subject properties are currently designated'oCentral Commercial" by the Land Use Element of the 2030 Firebaugh General Plan, which is consistent with the subject properties'existing zone district of C-2. The Central Commercial designation is intended to accommodate a mix of retail, office, mixed-use, and multifamily residential uses in a pedestrian-oriented environment. The proposed mixed-use development, which integrates residential units with ground-floor commercial space, is consistent with the intent and policies of the General Plan and supports infill development within an established commercial corridor.

Density Bonus:

Pursuant to California Govemment Code Section 6591s(bxl)(G) and 65915(0(3)(DXi), this project is eligible for an 80% density bonus and associated incentives because one hundred percent of all units in the development, including the total units and density bonus units, are for lower income households, as defined by Section 50079.5 of the Health and Safety Code. As a result, this project qualifies for a density bonus.

In accordance with State law, this project qualifies for up to an 80% increase in units above the maximum allowed by the site zoning as long as 100% of the rental units are reserved for lowincome households. This represents an additional 23 units above the27 permitted by the C-2 zone district (1 dwelling units for every 1,500 square feet of site area) for a total of 50 allowable units on the sites. The applicant proposes a total of 38 units, below the 50 units permitted by the density bonus.

In addition to the density bonus, the project also qualifies for up to four (4) development concessions in accordance with California Government Code Section 65915(dX2)(F), which include the following concessions:
o Maximum height limit from 3S-feet to 40-feet
. Minimum number of parking spaces from 60 to 35
. Minimum parking lot shading requirement of 50%;o to an amount to be determined after development of the landscaping and inigation plans
Furthermore, the project may receive waivers on development standards, such as setbacks, if the standard physically precludes the construction of development to meet densities permitted by the density bonus. As proposed, the applicants have requested the following waivers:
o Reduction in side yard setback to 10 feet
o Reduction in front yard setback to 0 feet
o Reduction in rear yard setback to 5 feet
Any future development concessions and waivers andlor changes to currently proposed development concessions and waivers shall first be reviewed and approved by the City.

In accordance with State law, the affiordable units must remain restricted for a minimum of 55 years, as ensured through an affordability covenant to be recorded against the properties. The density bonus is subject to review and recommendation by the Planning Commission and final approval by the City Council. As stated previously, the Planning Commission voted to recommend approval of the density bonus to the City Council at their April 13, 2026 regular meeting.

Proposed Site Plan:

Analysis on the Site Plan Review is presented for informational purposes for the City Council; the Site Plan Review is acted on by the Planning Commission only. It should be noted that the Planning Commission voted unanimously to approve the Site Plan Review with conditions on April 13, 2026. These conditions include the requirement for the building design to be in compliance with the requirements of the RFP released for the subject properties.

As noted previously, each site is proposed to include the following Project Design Site 1 Site 2

A total of35 parking spaces are proposed, including four designated for accessible parking and four designated as electric vehicle (EV) charging stalls. The proposed development, as conditioned, is consistent with the applicable development standards of the C-2 (Central Commercial) zone and Mixed Use Development. The building height requirement, setback requirements, number of parking spaces, and lot shading requirements have been modified by the requested Density Bonus incentives and waivers.

Utility services, including water and sewer, will be provided through existing City infrastructure.

Existing improvements include curbs, gutters, and sidewalks along the frontages of both O Street and 1lth Street, which will continue to serve the project.

Environmental Review:

The proposed mixed use development projects are subject to the California Environmental Quality Act (CEQA). Staff has reviewed the project under the provisions of CEQA and determined the project was categorically exempt pursuant to CEQA Guidelines Section 15332 (Class 32 - Infill Development) because it meets the criteria of a Class 32 exemption:
a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations. b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses.
c) The project site has no value as habitat for endangered, rare, or threatened species. d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water qualrty.
e) The site can be adequately served by all required utilities and public services.

Conclusion:

Staff believes the project, as conditioned, meets City standards and will be a significant improvement over the vacant parcels. The project has been reviewed by City staff and staff recommends the City Council vote to approve the application for the Density Bonus.

AGENDAITEM: CONSIDERATION OF RESOLUTIONS 26-17,26-18, and 26-19 AUTHORIZING ACTIONS

FOR THE FIREBAUGH DOWNTOWN INFILL INITIATIVE INCLUDING THE SELECTION

AND ACCEPTANCE OF PACIFIC WEST COMMUNITIES AS THE DEVEOLOPER, APPROVAL OF A LEASE OPTION ON CITY PROPERry FOR AFFORDABLE HOUSING, ALLOCATION OF CITY REAP 2.0 PROJECT FUNDING, AND AUTHORIZATIONS FOR

THE DEVELOPER AND CITY AS JOINT APPLICANTS TO THE ROUND TEN AFFORDABLE HOUSING AND SUSTAINABLE COMMUNITIES PROGRAM.

MEETING DATE: APRIL 20,2026
pREPARED BY: Ben Gallegos, City Managerand MichaelSigala, Housing Consultant

RECOMMENDATION
Staff recommends that the City Council adopt resolution s 26-17, 26-18, and 26-19 approving several actions for the Firebaugh Downtown lnfill lnitiative's application to the State of California's Round 10 Affordable Housing and Sustainable Communities (AHSC) Program.

BACKGROUND
\n2024, the City of Firebaugh was awarded $1.5 million in REAP 2.0 funding from the Fresno Council of Governments to create and implement the Firebaugh Downtown lnfill lnitiative, a comprehensive predevelopment effort focused on accelerating residential mixed-use infill development in the City's downtown core. The initiative supports the REAP 2.0 objectives of promoting compact infill housing, affirmatively furthering fair housing, and reducing vehicle miles traveled through improved land use and mobility planning.

Over the course of the past 18 months, the City has convened regular meetings of a Stakeholder Advisory Committee including meeting with local and regional partners, community-based organizations, the Firebaugh Center Community College, Fresno Economic Development Corporation, Supervisor Pacheco's office, Fresno Council of Governments, and several state and federal representatives.

During this time, the City has also conducted multiple studies and implemented collaborative efforts with partners to support future mixed use housing downtown. Those studies include a housing market report, commercial retailand office market study, transit consultation and rural mobility planning with the Fresno County Rural Transit Agency, Return to agenda
conceptual building plaza renderings, a mobility options study with the UC Davis lnstitute of Transportation Studies, and infrastructure analysis and planning.

To facilitate higher-density housing near amenities and services, the City has worked with private owners and secured site control (fee simple ownership) of three downtown parcels shown on the map below:

To support the implementation of the Firebaugh Downtown lnfill lnitiative, an application to the State of California's Affordable Housing and Sustainable Communities (AHSC) Program was contemplated by the StakeholderAdvisory Committee. TheAHSC Program is a major funding source and supports affordable housing developments (new construction or renovation) and transportation infrastructure. This may include sustainable transportation infrastructure, such as new transit vehicles, sidewalks, and bikeways; transportation-related amenities, such as bus shelters, benches, or shade trees; and other programs that encourage residents to walk, bike, and use public transit.

The City of Firebaugh was provided by the State of California AHSC technical assistance from California Rural Housing and Enterprise Community Partners. Further consultations with the technical assistance providers lead to the conclusion that an application to the AHSC Program was a viable option for Firebaugh. The application deadline for Round 10 of the AHSC Program is May 4,2026, hence considerable work had to be conducted in a short timeframe.

A Request for Proposals was issued by the City in late February 2026 to solicit developer interest for a residential mixed-use project on two of the city owned properties. One developer responded, Pacific West Communities, Inc. Pacific West is one of the nation's largest affordable housing developers and is based in ldaho. City staff has been working in "good faith'with the developer to arrive at a housing project in concept for submittal to the AHSC Program.

An option to lease the land from the city to the developer is being proposed. The City would receive $20,000 per year for a longterm ground lease from the developer. ln addition, the action forApril 20th involves the City committing up to $500,000 in REAP 2,0 funds for the housing project. This was negotiated by City staff and the developer to help offset some of the cost associated with providing elevators in the buildings.

As part of the Sustainable Transportation lmprovements for the AHSC application, the City is proposing to utilize the property at O street and 11th for a public plaza. Conceptual renderings for the plaza and intersection improvements are shown below. i

The City, as the co-applicant to the AHSC Program, is also proposing bulb out improvements at the intersection of O street and 11th, new and improved bikes lanes and sidewalks citywide, improvements to the River Trail, discounted public transit service to residents of the housing project, trees in the downtown area, and EV carsharing services (one car at each new housing site) for residents. Staff will present maps of the citywide improvement at the April 20th meeting.
.f
Program partners for the AHSC application include:

Fresno County Rural Transit Agency, who will be providing service to a new bus stop location at the proposed public plaza; Miocar EV carsharing, who will be providing two cars at the housing locations; Fresno County Economic
Development Corporation, who will be provide workforce
development opportunities and training; and, Central Valley Community Land Trust, who will be developing antidisplacement strategies for the residents of Firebaugh. Funding for these activities is provided by the AHSC funds to the City under the Program category with no adverse impact to the City funds, if awarded.
pacific West Communities and the City of Firebaugh are the proposed "co-applicants" for the AHSC application that is due May 4,2026. Action at the April 20th council meeting approves both entities as co-applicants and authorizes the City Manager to execute all retated application materials and submit the application on behalf of the City. mlocar

PUBLIC REVIEW AND COMMENT
A community workshop was held on April 20th at 4:30 p.m. at the Firebaugh Community Center to present the project information to residents and business owners and solicit feedback on the various proposed improvements.

REASON FOR RECOMMENDATION
An approximate $21 million program award from the Affordable Housing and Sustainable Communities Program would have a transformational impact to the City of Firebaugh, particularly its downtown. The Housing project would receive approximately $10.6 million in the form of a forgivable loan from AHSC program. The total cost of the housing project, including other housing funding such as low-income housing tax credit financing and private lending, is approximately $22 million. The Sustainable Transportation lmprovements represent a $9 million investment in Firebaugh in the form of a grant from the State of California. An additional $600,000 from AHSC funding will support Program activities such as transit passes and EV carsharing operations. The total investment, in downtown Firebaugh will be approximately $32 million. This total investment represents a tremendous opportunity for the City of Firebaugh to enhance the vitality of its downtown, provide additional affordable housing to its residents, and provide enhanced walking, biking, transit and mobility options for the community. The project funding is a catalyst investment for the larger Downtown lnfill Initiative and will provide incentives and synergy for additional investment in the future.

FISCAL IMPACT
tf awarded, the AHSC funding would be an approximate $9.6 million grant to the City, and a $10.6 million forgivable loan to the developer. The City would be allowed to take up to a 5 percent administration fee on the $9.6 million grant totaling approximately $480,000.

The ground lease agreement with the developer will result in a $20,000 payment from the developer to the City for the S5-year life of the housing project.

The City is committing $500,000 in REAP 2.0 funds for the housing project in the form of a residual receipts forgivable loan.

The session was held on Thursday, April 9,2026, atthe Tulare Public Library Council Chambers. The training focused on several key areas critical to the City's infrastructure management and risk exposure:

Legal Standards & Liability: A review of Califomia Government Code Section 835 and how it pertains to "dangerous conditions of public property."
Inspection and Maintenance Programs: Best practices for establishing a proactive vs. reactive inspection schedule. The training emphasized that having a documented plan-and following it-is the strongest defense against negligence claims.

Innovative Repair Solutions: Evaluation of cost-effective repair methods, including horizontal saw cutting, grinding, and the use of rubberized sidewalk materials near heritage trees where root growth is a persistent issue.

Adjacent Property Owner Responsibility: Strategies for enforcing local ordinances that shift certain maintenance or repair costs to the abutting property owner under Streets and Highways Code 5610.

Olga Flores and Marlim Contreras recently completed a comprehensive online curriculum focused on advanced communication and service strategies. The training covered several key areas, including:
. Effective Communication: Mastering verbal and non-verbal cues to ensure clear information exchange with residents.
. Conflict Resolution: Techniques for de-escalating difficult situations and finding mutually beneficial solutions.

Re: Staff Report
The Firebaugh Police Department continues to remain active in enforcement, training, and community engagement efforts.

On April 25th, the police department will have an information booth at the Autism Walk. Officers will also be volunteering at the event, supporting and engaging with the community.

Criminal Investigations & CIWS Operations
In early April, the CIWS Team conducted a search warrant operation in the city. Evidence was seized and this investigation remains open and ongoing.

BSCC officer remains busy and continues to investigate the anonymous tips that continue to come into our department.

Traffic OTS Grant
Our motor traffic officer Lee Xiong continues proactive enforcement, including DUI saturation patrols funded through the OTS grant. He has issued citations for stop signs, unlicensed drivers, license not in possession, red light violations, cell phone use while driving, and other equipment violations.
2 Training & Personnel Updates
Last week, Officer Khoua Xiong completed 40 hours of Traffic Collision Investigation training in Fresno. Additionally, Officer Victor Albarran completed 24 hours of Interview and Interrogation Training through POST Certification.

Dispatch personnel are scheduled to attend Dispatch/Customer Service Training through POST beginning in May of 2026, which will further enhance service delivery to the community. -Personnel Updates
The department currently has two applicants undergoing background investigations for Reserve Officer Positions, along with a part-time dispatcher.

Corporal Fernando Campa has taken the lead and is currently coordinating a community oriented event at the La Joya Complex. While still in the early stages, the event is intended to foster positive interactions with youth and residents. Updates will be provided, and a future invitation will be extended to council and City Manager.
