City Council Special Meeting
MINUTES
Tuesday, November 12, 2025 5:00 PM
CALL TO ORDER
The special City Council meeting was called to order at 5:00 pm with Mayor Aquino presiding.

ADJOURNMENT TO CLOSED SESSION FOR THE FOLLOWING PURPOSES:
1. Conference with Legal Counsel - Existing Litigation - Pursuant to Government Code Section 54956.9(d):
i. Gregory Wheatfill v. City of Folsom, County of Sacramento, West Prairie Estates, LLC, Oak Avenue Holdings, LLC, HBT Hillsborough, LLC, and Bulldog Office Properties LLC; Sacramento County Superior Court Case No. 25CV025144
ii. Robert Delp v. City of Folsom, Sacramento County Superior Court Case No. 23WM000125
2. Conference with Legal Counsel – Anticipated Litigation, Initiation of Litigation Pursuant to Government Code 54956.9(d)(4): One Potential Case
3. Conference with Real Property Negotiator - Pursuant to Government Code Section 54956.8:
Purchase and Sale of Real Properties Located Along Sutter and Leidesdorff Streets (APN 070- 0042- 003, APN 070-0046-026, APN 070-0046-024 1108 Sutter Street, and 070-0042-002 1118 Sutter Street). Negotiating Parties: City Manager Bryan Whitemyer on Behalf of the City of Folsom, and Turton Commercial Real Estate on Behalf of D/S Charitable Remainder Unitrust.

Motion by Councilmember Kozlowski, second by Councilmember Leary to adjourn to closed session. Motion passed by the following roll-call vote:
AYES: Rohrbough Kozlowski, Leary, Raithel, Aquino
NOES: None
ABSENT: None
ABSTAIN: None
RECONVENE
City Attorney Steven Wang announced that the City Council unanimously authorized the City Attorney to seek appellate review in the case of Delp v. City of Folsom.
ADJOURNMENT
There being no further business to come before the City Council, the meeting was adjourned at 6:30 pm.
