A PUBLIC HEARING HAS BEEN SCHEDULED BEFORE THE CITY COUNCIL OF THE CITY OF FONTANA FOR THE FOLLOWING:
Master Case No. 22-072; and Municipal Code Amendment No. 22-006: Update to the City of Fontana Municipal Code for amendments to modify Chapter 30 and add Chapter 33 to regulate cannabis businesses and activities, along with a provision for commercial cannabis operations for certain commercially designated properties along with standards, operating requirements, maximum number of commercial cannabis businesses, and permit requirements.
Environmental Determination: This project qualifies for a categorical exemption pursuant to the California Environmental Quality Act (CEQA) Guidelines Sections 15061(B)(3) (the common-sense exemption), or, in the alternative, 15303 (new construction or conversions of small structures), along with Sections 3.07 and 3.22 of the 2019 Local Guidelines for Implementing CEQA. Section 15303 pertains to “construction and location of limited numbers of new, small facilities” including up to three (3) “stores” in “urbanized areas.“ Here, Section 15303 applies as the Ordinance could, at most, only reasonably foreseeably result in the construction and location of only three (3) new retail facilities in an urban area.
