RESOLUTION NO. 23-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FONTANA REPEALING RESOLUTION NO. 90-273 AND ESTABLISHING UPDATED RULES AND REGULATIONS RELATING TO EMPLOYER-EMPLOYEE RELATIONS WHEREAS, the Meyers-Milias-Brown Act (California Government Code Sections 3500 et seq.) has enacted for the purpose of promoting improved employer-employee relations between public employers and their employees by establishing uniform and orderly methods of communication between employees and the public agencies by which they are employed; and WHEREAS, Government Code Section 3507 empowers a city to adopt reasonable rules and regulations after consultation in good faith with representatives of its employee organizations for the administration of employer-employee relations; and WHEREAS, it is incumbent upon the municipal employee relations officer to establish specific rules and regulations governing the personnel system; and WHEREAS, the City of Fontana has adopted and amended such rules and regulations as authorized by law in City of Fontana Resolution No. 90-273; and WHEREAS, after good faith consultations with representatives of its employee organizations, the City of Fontana desires to update its current rules and regulations governing the personnel system as authorized by law; and WHEREAS, these updated rules and regulations shall not deprive said employees of any right to representation which they may have under Section 3500 et. seq. the California Government Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Fontana resolves as follows:
Section 1. The above recitals are true and correct and are incorporated herein by this reference.
Section 2. Resolution No. 90-273 is hereby repealed and replaced in entirety by this Resolution No. 23-XX.
Section 3. The City Council of the City of Fontana does hereby adopt an updated policy establishing orderly procedures for the administration of employer employee relations between the City and its employees and employee organizations representing City employees, and for resolving disputes regarding terms and conditions of employment, as set forth in Exhibit “A” attached hereto and incorporated herein by reference.
Section 4. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable.
Section 5. Effective Date. The City Clerk shall certify to the adoption of this Resolution. This Resolution shall become effective upon the passage by the City Council.
