RESOLUTION NO. 2024 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FONTANA
AUTHORIZING EMERGENCY FLOORING REPAIR WORK AT THE
FONTANA SENIOR CENTER.
WHEREAS, Fontana Municipal Code ("FMC") section 10-136 provides that an "emergency" means a condition or possible safety situation which makes bidding procedures, either formal or informal, impractical or not in the best interests of the City; and
WHEREAS, FMC section 10-147(a)(6) provides that contracts for public work projects may be excused from the procedures in Article V, Section 10 of the FMC if such purchases are deemed by the city council to be of urgent necessity for the preservation of life, health, or property; and
WHEREAS, an unsafe condition exists at the Fontana Senior Center that requires immediate repair work to the main level's flooring as it has lifted due to moisture intrusions; and
WHEREAS, such repair work is necessary to preserve the health and safety of the public and the property, and is necessary to re-open the facility in a timely manner; and WHEREAS, the City of Fontana staff recommends the award of a contract to Custom Craft Flooring for said repair work in the amount of $214,700.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fontana, California, as follows:
Section 1. Recitals. The above recitals are true and correct and incorporated herein by this reference.
Section 2. CEQA. This Resolution is exempt from further environmental review under the State of California Environmental Quality Act ("CEQA") Guidelines, Section 15301, because it authorizes the repair of an existing structure involving no expansion of existing or former use. Council, therefore, directs that a Notice of Exemption be filed with the County Clerk of the County of San Bernardino in accordance with CEQA Guidelines.
Section 3. Adoption. The City Council hereby authorizes and directs the City Manager to take any action and execute any documents necessary to carry out the purposes of this Resolution.

Section 4. Severability. If any provision of this Resolution or the application of any such provision to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. The City Council declares that it would have adopted this Resolution irrespective of the invalidity of any particular portion of this Resolution.
Section 5: Certification. The City Clerk shall certify to the adoption of this Resolution.
Section 6: Effective Date. This Resolution shall become effective immediately upon its adoption.
Section 7. Custodian of Records. The documents and materials that constitute the record of proceedings on which this Resolution is based are located at the City Clerk's office located at 8353 Sierra Avenue, Fontana, CA 92335. The custodian of records is the City Clerk.
