PURPOSE:
The purpose of this policy is to acknowledge that in order to support recycling and to minimize environmental impacts, the City of Fontana will purchase recycled content and environmentally preferred products whenever practicable The City of Fontana recognizes our employees can make a difference towards improving environmental quality. All departments shall, whenever possible, purchase recycled products to meet their needs. This policy is enacted to demonstrate compliance with the Waste Management Reduction Act and to foster market development for recycled products Nothing in this policy shall be construed as requiring a department to procure products that do not perform adequately for their intended use or not available at a reasonable price in a reasonable period of time.
DEFINITIONS:
• “City” means City of Fontana
• “Recycling” means the process of collecting, sorting, cleansing, treating, and reconstituting materials that would otherwise become solid waste, and returning them to the economic mainstream in the form of raw material for new, reused, or reconstituted products that meet the quality standards necessary to be used in the marketplace.
• “Waste Prevention” means any action undertaken by an individual or organization to eliminate or reduce the amount or toxicity of materials before they enter the municipal solid waste stream. This action is intended to conserve resources, promote efficiency, and reduce pollution.
• “Practicable” means sufficient in performance and available at a reasonable price and within a reasonable time.
• “Environmentally Preferable Products” means products that have a lesser or reduced effect on human health and the environment when compared with competing products that serve the same purpose. This comparison may consider raw materials acquisition, production, manufacturing, packaging, distribution, reuse, operations and/or disposal of the product.
• “Post-consumer Recycled Materials” means a finished material that would normally be derived of as a solid waste, having completed its life cycle as a consumer item. Examples of post-consumer recovered materials include, but are not limited to, old newspapers, office paper, green waste, steel and/or aluminum cans, glass, plastic bottles, oil, asphalt, concrete, and tires.
“Recycled Products” means materials and products that has been recovered or diverted from the waste stream and have been utilized in place of raw or virgin material in manufacturing a product. It is derived from post-consumer waste (material that has served its intended end-use and been discarded by a final consumer), industrial scrap, manufacturing waste, agricultural waste and/or other waste material that otherwise would not have been used.
“Recovered organic waste products” means products made from California, landfill-diverted recovered organic waste processed at a permitted or otherwise authorized operation or facility.
“Virgin Material” means any material occurring in its natural form. Virgin Material is used in the form of raw material in the manufacture of new products.
GENERAL POLICY:
1. The City of Fontana commits to procure environmentally preferable products and services where criteria have been established by governmental or otherwise recognized authorities (e g. Energy Star)
2. All departments shall use recycled products whenever practicable. Special emphasis shall be placed on the purchase of products manufactured with post-consumer recycled materials.
3. All departments may at their option with the Purchasing Division’s concurrence require procurement of designated recycled products, recovered organic waste products, or recycled products about the levels required by this policy.
4. The City of Fontana shall require its contractors and consultants to use and specify recycled and recovered organic waste products in fulfilling contractual obligations whenever practicable.
5. The City of Fontana Management Services Department with support from the Public Works Department will implement this procedure by establishing a list of recycled and recovered organic waste products that shall be purchased by all Departments of the City of Fontana whenever practicable and will develop a mechanism for maintenance additions and deletions to the list of recycled products available for procurement. Maintenance of this list will include the addition of new products containing recycled and recovered organic waste materials as they become available. Specifications of these new products and their suggested use will be made available to all departments through the intranet. The Environmental Control Division of the Public Works Department will also work with all departments to establish minimum recycled content standards for designated recycled products to maximize recycled product availability, recycled content, and competition.
Recovered organic waste products shall comply with 14 CCR Division 7. Department of Resources Recycling and Recovery, Chapter 12. Short-Lived Climate Pollutants, Article 12. Procurement of Recovered Organic Waste Products.
6. The City of Fontana will make resource conservation and waste reduction an integral part of its waste reduction and recycling program. The practice of discarding materials in all City facilities is wasteful of natural resources energy and money.
7. The City will integrate the concept of resource conservation including waste reduction and recycling into its environmental programs. All city departments and divisions shall practice waste prevention and recycling.
8. The City will decrease the amount of waste of consumable materials by reducing the consumption of consumable materials whenever possible and by fully utilizing all materials prior to disposal and continued minimizing the use of non-biodegradable products wherever possible.
9. The City will cooperate with and participate in recycling efforts being made by the City and County. As systems for recovering waste and recycling develop within the City, the City will participate by appropriately separating and allowing recovery of recyclable waste products.
10. The City will purchase, where financially viable, recycled and recovered organic waste products. The City will also encourage suppliers, both private and public, to make recyclable products and unbleached paper products available for purchase.
11. The city of Fontana shall solicit the use of recycled content, recovered organic waste products, and other environmentally preferred products in its procurement documents. Contractors shall certify in writing, under penalty of perjury, the minimum percentage of postconsumer material in the Paper Products and Printing and Writing Paper offered or sold to the City. This certification requirement may be waived if the percentage of postconsumer material in the Paper Products, Printing and Writing Paper, or both can be verified by a product label, catalog, invoice, or a manufacturer or vendor internet website
11. 12. Representatives of the City will actively advocate, where appropriate, for resources conservation practices to be adopted by the local, regional, and national levels.
