RE: Response to Golden State Environmental Justice Alliance Appeal of MCN 21-038
T&B Planning, Inc. (T&B Planning) is the environmental consulting firm that prepared the Environmental Impact Report (EIR) for the Cypress and Slover Warehouse project (Master Case No. 21-038, hereinafter “Project”). T&B Planning has prepared this memorandum in response to the March 25, 2024, letter sent to the City of Fontana by the Golden State Environmental Justice Alliance as an appeal to the Fontana Planning Commissions decision from March 19, 2024, to approve the Project (hereinafter “Appeal Letter”).
The Golden State Environmental Justice Alliance state that their concern for the environment and their opinion that the Project’s EIR is inadequate form the basis of their appeal of the Project’s approval. The Golden State Environmental Justice Alliance note that all of their concerns related to the Project’s potential environmental impacts and purported inadequacies of the Project’s EIR were outlined in a comment letter provided to the City on June 28, 2023 (hereinafter “Comment Letter”). Detailed, point-by-point responses to the Comment Letter are provided in the Project’s Final EIR, see Pages F-73 through F-115. As addressed by the responses to the Comment Letter provided within the Final EIR: 1) the Project’s potential environmental impacts were fully disclosed in the EIR; 2) the Project’s environmental analysis utilized appropriate assumptions and analysis methodologies that were reasonable and appropriate; and 3) the conclusions in the EIR were correct, legally adequate, and supported by substantial evidence. Because the Final EIR addressed all of the comments from the Comment Letter and because the Appeal Letter does not raise any new comments that were not previously addressed by the Final EIR, no further responses are necessary.
