Subject: Appeal of Master Case No. 20-027R1 (July 16, 2024, Planning Commission meeting) Attachments: Scanned File.pdf
To the City of Fontana Planning Division:

Pursuant to Section 30-25 (a) of the Fontana Zoning and Development Code, this email, together with the attached Appeal Form, constitutes an appeal from Master Case No. 20-027R1 for which the Fontana Planning Commission, at its meeting on July 16, v 2024, approved a CUP modification ("CUP Modification") to permit the sale of certain alcoholic beverages at 16119 Foothill Boulevard in the City.

Please be advised that I file this appeal for purposes of enabling the Fontana City Council to consider the merits of the CUP Modification, as approved by the Planning Commission. I do not take a position on whether or not the City should ultimately approve or deny the CUP Modification, but instead bring this appeal so that the City Council may consider and discuss whether the approval is consistent with past and present City policy regarding the particular sale of such goods, and whether all of the required findings for approval under the Zoning and Development Code may be made.

The third and final finding required for approval or denial of the CUP Modification is the primary basis for this appeal, although the other two required findings should be considered, as well. A focus of this appeal is a certain Fontana Police Department memorandum provided to the Planning Commission as part of its deliberations. The memorandum indicates that the Fontana Police Department raised concerns regarding such an approval. In addition, it is my understanding and belief that the City has in the past denied one or more similar requests for a CUP modification, or the like, pertaining to sale of the goods in question. This suggests a need for City Council discussion of consistency and policy, especially with regard to the third finding referenced above.

Thank you for placing this appeal on an upcoming City Council meeting agenda.
