RESOLUTION NO. 2024-135
AN RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FONTANA, CALIFORNIA, ADOPTING AN AMENDED CITY OF FONTANA TREE POLICY MANUAL AND AMENDED MASTER TREE LIST.
WHEREAS, the City of Fontana is responsible for maintenance of the urban forest, consisting of trees located in the public right of way, parks and parking lots; and WHEREAS, trees in urban environments offer numerous benefits, including improved air quality by absorbing pollutants and releasing oxygen, and temperature regulation through shade and transpiration, which cools the air and reduces the urban heat island effect; and WHEREAS, trees enhance aesthetics and property values, reduce noise by acting as sound barriers, and support biodiversity by providing habitats for various species; and WHEREAS, the City of Fontana considers trees as one of its most valuable assets and is committed to the preservation, proper maintenance and continued growth of urban forestry throughout the City; and WHEREAS, Fontana Municipal Code Section 28-34 requires a City Tree Policy Manual, adopted by resolution of the City Council, which defines and illustrates policies and procedures for care and maintenance of trees to be updated periodically; and WHEREAS, Fontana Municipal Code Section 28-28 requires a Master Tree List, adopted by resolution of the City Council, which designates certain species of trees that may be planted within the City and is to be updated periodically; and WHEREAS, the current “City of Fontana Street Tree Palette” and the proposed “City of Fontana Street Tree Palette,” which results in the removal of thirty-three (33) tree types and the addition of ten (10) tree types to the Master Tree List, are included for the City Council’s consideration (Exhibit “A”).
WHEREAS, the City now desires to amend the City of Fontana Tree Policy Manual and the Master Tree List, which is included as the “City of Fontana Street Tree Palette” within the Tree Policy Manual (Exhibit “B”).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fontana, California, as follows:
Section 1. Recitals. The City Council hereby finds that the foregoing recitals are true and correct and incorporated herein by this reference as substantive findings of this Resolution.
Section 2. CEQA. Amending the City’s new tree polic through this Resolution does not commit the City of Fontana to any action that may have a significant effect on the environment. As a result, such action does not constitute a project subject to the requirements of the California Environmental Quality Act. The City Clerk is authorized and directed to file a Notice of Exemption with the appropriate official of the County of San Bernardino, California, within five (5) days following the date of adoption of this Resolution.
Section 3. Approval. The City Council approves and adopts the City of Fontana Amended Tree Policy Manual which includes the Amended Master Tree List (Exhibit “B”).
Section 4. Severability. If any provision of this Resolution or the application of any such provision to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. The City declares that it would have adopted this Resolution irrespective of the invalidity of any particular portion of this Resolution.
Section 5. Certification. The City Clerk shall certify to the passage and adoption of this Resolution.
Section 6. Effective Date. This Resolution shall become effective immediately upon its adoption.
