Now, Therefore be it Resolved by the City Council of the City of Fontana, California, as follows:
Section 1: Recitals. The above recitals are true, correct and by this reference incorporated herein.
Section 2: CEQA. This Resolution is not a project within the meaning of Section 1538 of the State of California Environmental Quality Act (“CEQA”) Guidelines, because it has no potential for resulting in physical change in the environment, directly or indirectly. The City Council further finds, under Title 14 of the California Code of Regulations, Section 15061(b)(3), that this Resolution is nonetheless exempt for the requirements of CEQA in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Council, therefore, directs that a Notice of Exemption be filed with the County Clerk of the County of San Bernardino in accordance with CEQA Guidelines.
Section 3: City Council Meeting Time. The City Council hereby sets the times of its regular meetings to 2:00 p.m. on the second and fourth Tuesday of each month. Additional special meetings may be called, as provided by law, as needed at other dates and times. Any regular or special meetings may, from time to time, be adjourned to another date.
Section 4: Parks, Community and Human Services Commission. City Council hereby sets the times of the Parks, Community and Human Services Commission regular meetings to 7:00 p.m. on the fourth Thursday of each month. Additional special meetings may be called, as provided by law, as needed at other dates and times. Any regular or special meetings may, from time to time, be adjourned to another date.
Section 5: Planning Commission. City Council hereby sets the times of the Planning Commission to 6:00 p.m. on the first and third Tuesday of each month. Additional special meetings may be called, as provided by law, as needed at other dates and times. Any regular or special meetings may, from time to time, be adjourned to another date.
Section 6: Effective Date. This Resolution shall take effect thirty (30) days after the adoption of City Council Ordinance No. 1965, provided however, if Ordinance No. 1965 is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, or otherwise does not go into effect for any reason, then this Resolution shall be null and void and have no further force and effect.
Section 7: Severability. If any provision of this Resolution or the application of any such provision to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. The City Council declares that it would have adopted this Resolution irrespective of the invalidity of any particular portion of this Resolution.
Section 8: Certification. The City Clerk shall certify to the adoption of this Resolution.
Section 9: Custodian of Records. The documents and materials that constitute the record of proceedings on which this Resolution is based are located at the City Clerk’s office located at 8353 Sierra Avenue, Fontana, CA 92335. The custodian of records is the City Clerk.
