B. COST PROPOSAL
The undersigned hereby proposes and agrees to furnish all design services, construction labor, materials, equipment, including management and oversight, to perform all work required for the Project in the manner and time described in the undersigned’s desi gn proposal and documents.
The Cost Proposal, set forth below, includes all costs of the scope of work as requested in the RFP, and required by the provisions of the Design-Build Contract, including the cost of bonds, insurance, sales tax, and every other item of expense, direct or indirect, incidental to the scope of work.

The undersigned, having fully examined the RFP and any and all attachments, exhibits, and addenda thereto, and site of the Project, proposes to furnish all design and construction labor, materials, and equipment, and do all work in compliance with the term s and conditions of the RFP, without exception, and the herein proposal, for a Contract Price of:

(b) The undersigned has become familiar with local site conditions under which the work is to be performed and has correlated personal observations with the requirements of the RFP.
(c) The proposal submitted by the undersigned is made in accordance with the RFP and is based upon the materials, systems, and equipment specified therein that will support or exceed the minimum quality, service, utilization, performance, and other levels specified therein, without exception; and the undersigned agrees that City is not responsible for any error or omission in this proposal or in its preparation.
(d) The undersigned will design and construct facilities that are fully functional and meet or exceed a ll function, program, performance, and other requirements of Project in the manner and time described in the undersigned’s desi gn proposal and documents.

City as identified in the RFP, and for the Contract Price specified above. (e) If City recommends the undersigned be awarded the Design -Build Contract, the undersigned will meet with City to review in detail this proposal and will make any necessary changes or revisions to this proposal, including any and all design submittals and proposed materials, systems and equipment to ensure delivery to City of fully functional facilities which meet or exceed all requirements of City as identified in the RFP without revision to the Contract Price. (f) The undersigned acknowledges and warrants that the Design -Build Entity includes, at a minimum, architects, engineers, other necessary or specified design professionals and consultants, and a general contractor as identified and pre-qualified in the Request for Qualifications process. Substitutions of architects, engineers and other design professionals and consultants, or general contractors as identified in the Statement of Qualifications and any identified in this proposal, will not be made without City’s written consent to such substitution(s). (g) The undersigned and each of its subconsultants, contractors, and subcontractors shall at all times during the execution of the work contemplated by the RFP, be qualified to complete the work, and each shall comply with all applicable State of California an d City of Fontana professional and business licensing and registration requirements.
(h) The undersigned will not modify, amend, revoke or withdraw this proposal, without written permission of City for a period of not less than ninety (90) calendar days following the submission due date and time specified in the RFP or until a final Design-Build Contract has been executed, whichever occurs first. (i) The undersigned, or any member of the Design -Build E ntity or Design -Build Team, or any agent or representative thereof, has not collaborated or communicated with, or entered into any understanding agreements, whether written or oral, whether direct or indirect, or otherwise, with any other Design - Build Entity or Design-Build Team, or any agent or representative thereof, in the preparation of this proposal.
(j) The undersigned has reviewed in detail the Design-Build Contract attached to this RFP and takes no exception to its terms and conditions and warrants tha t nothing contained in the Design-Build Contract would preclude the Design -Build Entity from entering into the Design-Build Contract.
(k) This proposal is genuine and is not a sham or made in the interest of, or on behalf of, any person or entity not herein named.
(l) The undersigned, or any member of the Design -Build Entity or Design -Build Team, or any agent or representative thereof, has not engaged in any communication or contact with City or any City employee, or any City consultants, except as specifically allowed and limited by this RFP.

Greetings Mr. Smethurst - Thank you for the opportunity to provide our response to the requested refinements to our design indicated in our December 12th, 2024 Request for Proposal submission.

Clarifications to the Prescribed and Optional Alternates Prescribed Additive Alternate #1 - Parking Guidance System The RFP called for “A camera based, single space detection, red light / green light / blue light PGS shall be included as an add-alternate to the design. Dynamic signage to be included with the add-alternate that identifies the quantity of available spaces per floor level. Signage to be provided in two locations: one at the northwest entry off Nuevo Avenue and the other at the northeast entry off the alley.” In response to discussions with the City to economize on this Prescribed Additive Alternate, we now propose a parking guidance system with a single dynamic sign mounted at the Nuevo Avenue ground level drive entrance indicating available spaces per level (levels 2 through 5) with no camera based single space detection. The new not to exceed cost for this revised system: Add $155,000
Delete Valet Entrance
In response to discussions with the City to revise the design and to economize on project cost, the southeast drive entrance has been removed. This change saves the aforementioned cost but does not gain additional parking stalls. The new description of the Optional Alternate is now:

In response to discussions with the City to revise the design and to economize on project cost, the Bicycle Storage Room within the Ground Level Secured Parking area has been removed. This revision removes a single hollow metal door and approximately 170 square feet of concrete masonry unit wall Deduct -$5,000
