The CITY OF FONTANA, a California municipal corporation , do (does) hereby grant to SOUTHERN CALIFORNIA EDIS ON COMPANY, a corporation, its successors and assigns, (hereinafter referred to as "Grantee"), an easement to construct, use, maintain, alter, add to, repair, replace, inspect, relocate and/or remove at any time and from time to time, stub poles, guy wires, anchors and other appurtenant fixtures and/or equipment needed for anchorage purposes (hereinafter referred to as "Grantee’s Facilities"), in, on, over and across two (2.0) strips of land (the “Easement Areas”) lying within that certain real property of the Grantor, situated in the County of San Bernardino, State of California, described as follows:
THAT PORTION OF THE SOUTHWEST 1/4 OF SECTION 33, TOWNSHIP 1 SOUTH, RANGE 5 WEST, SAN BERNARDINO BASE AND MERIDIAN, IN THE CITY OF FONTANA, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, MORE PARTICULARLY DESCRIBED AS “OPEN SPACE AREA 1,” AS IN THAT CERTAIN GRANT DEED, RECORDED AUGUST 15, 2022, AS INSTRUMENT NO. 2022-0279980, OF OFFICIAL RECORDS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY.
Said Easement Areas are more particularly described on the Exhibit “A” and more particularly shown on the Exhibit “B ,” both attached hereto and by this reference made a part hereof.
The Grantee shall have free access to said facilities, and every part thereof, at all times, for the purpose of exercising the rights herein granted.
Grantor shall not grant any other easement or easements on, over or under the Easement Area nor permit facilities to be installed in the Easement Area without Grantee’s prior written consent in each instance.
